Reflections On New Partnerships Between Women And Local Self-Government In India: A Rural Revolution?, Santosh Nandal

Journal of International Women's Studies

This essay reflects on strategies for women’s empowerment in light of the enactment of the 73rd constitutional amendment, Panchayati Raj, in the Indian Constitution, in 1992. It begins with the assumption that women’s empowerment implies progressive elimination of gender disparities at the grassroots level. As such, a perspective on women’s empowerment differs from ideas about women’s development in some important ways. Women’s development is primarily a socio-economic concept while women’s empowerment is essentially a political project. It is argued here that women’s empowerment is indeed a precursor to women’s development. The author offers suggestions for increasing women’s effectiveness in …

The opinions of experts in prediction in civil commitment hearings should help the courts, but over thirty years of commentary, judicial opinion, and scientific review argue that predictions of danger lack scientific rigor. The United States Supreme Court has commented regularly on the uncertainty of predictive science. The American Psychiatric Association has argued to the Court that "[t]he professional literature uniformly establishes that such predictions are fundamentally of very low reliability." Scientific studies indicate that some predictions do little better than chance or lay speculation, and even the best predictions leave substantial room for error about individual cases. Depressive Deficits In Forgetting, Paula T. Hertel, M. Gerstle

The aim of this study was to investigate whether difficulties in forgetting (like difficulties in remembering) are associated with depressive states. First, dysphoric and nondysphoric students learned 40 word pairs, each consisting of a positive or negative adjective and a neutral noun (target). Next, the students practiced responding with some targets and suppressing others, when given the adjective as cue, for a varied number of repetitions. On the final test, they were told to disregard the prior instruction to suppress and to recall the target associated with every cue. Transfer Of Training Emotionally Biased Interpretations, Paula T. Hertel, A. Matthews, S. Peterson, K. Kintner

Non-anxious college students first performed a semantic-judgement task that was designed to train either threat-related or threat-unrelated interpretations of threat-ambiguous homographs (e.g. mug). Next they performed an ostensibly separate transfer task of constructing personal mental images for single words, in a series that included new, threat-ambiguous homographs. In two experiments, the number of threat-related interpretations in the transfer task significantly increased following threat-related experience during the training phase, compared to other training conditions. We conclude that interpretive biases typically shown by anxious people can be established in non-anxious students in ways that generalize to novel tasks and materials.

This Article questions the practice of framing problems concerning auditors' professional responsibility inside a principal-agent paradigm. If professional independence is to be achieved, auditors cannot be enmeshed in agency relationships with the shareholders of their audit clients. As agents, the auditors by definition become subject to the principal's control and cannot act independently. For the same reason, auditors' duties should be neither articulated in the framework of corporate law fiduciary duty, nor conceived relationally at all. The Qualified Legal Compliance Committee: Using The Attorney Conduct Rules To Restructure The Board Of Directors, Jill E. Fisch, Caroline M. Gentile

The Securities and Exchange Commission introduced a new corporate governance structure, the qualified legal compliance committee, as part of the professional standards of conduct for attorneys mandated by the Sarbanes-Oxley Act of 2002. QLCCs are consistent with the Commission's general approach to improving corporate governance through specialized committees of independent directors. This Article suggests, however, that assessing the benefits and costs of creating QLCCs may be more complex than is initially apparent. Importantly, QLCCs are unlikely to be effective in the absence of incentives for active director monitoring. This Article concludes by considering three ways of increasing these incentives.

Perspectives On State And Federal Antitrust Enforcement, Stephen Calkins

This Article reviews federal and (especially) state antitrust enforcement in light of the Microsoft proceeding. Criticism of state enforcement based on that case is misplaced. The Article identifies three consensus comparative advantages of state enforcers: familiarity with local and regional markets, closeness to state and local institutions, and ability and experience in compensating individuals. A review of state enforcement activities finds that the vast majority are consistent with one or more of these advantages. The Article also identifies hallmarks of generally accepted federal civil non-merger enforcement: both antitrust agencies participate actively, using a variety of tools, while showing support for …

The following Essay by Vice Chancellor Leo Strine of the Delaware Court of Chancery advocates the enactment of legislation that authorizes the Court of Chancery to handle "mediation-only" cases. Such cases would be filed solely to invoke the aid of a Chancellor to mediate a business dispute between parties. By advocating this innovative dispute resolution option, the Essay embraces a new dimension of the American judicial role that allows American businesses to more efficiently solve complicated business controversies. Sec Enforcement Heuristics: An Empirical Inquiry, James D. Cox, Randall S. Thomas, Dana Kiku

This Article examines the overlap between SEC securities enforcement actions and private securities fraud class actions. We begin with an overview of data concerning all SEC enforcement actions from 1997 to 2002. We find that the volume of SEC enforcement proceedings is relatively modest. We next examine the scope of the recently enacted "Fair Fund" provision that authorizes the SEC to designate civil penalties it recovers from defendants to benefit defrauded private investors. We conclude that this provision offers only limited potential relief for private investors. We complete this Part of the Article with an analysis of the serious resource …

To probe one case of free-ranging textual circulation, and to address issues associated with producers' rights to textual ownership and authorial credit, Robbins examines the Americanized versions of British writer Anna Barbauld's Lessons for children. Robin states that examining multiple specific cases of distributed authorship, and linking them to contemporary textual ownership issues, may well lead to nuanced extensions of the basic framework for understanding intellectual property that pioneers in the field have already formulated.

Functional Interaction Between The Bloom's Syndrome Helicase And The Rad51 Paralog, Rad51l3 (Rad51d), Jp Braybrooke, J-L Li, L Wu, Et Al

Bloom's syndrome (BS) is a genetic disorder associated with short stature, fertility defects, and a predisposition to the development of cancer. BS cells are characterized by genomic instability; in particular, a high rate of reciprocal exchanges between sister-chromatids and homologous chromosomes. The BS gene product, BLM, is a helicase belonging to the highly conserved RecQ family. BLM is known to form a complex with the RAD51 recombinase, and to act upon DNA intermediates that form during homologous recombination, including D-loops and Holliday junctions. Press Releases

Citing considerations for the health of students, faculty, staff and campus visitors, Lawrence University President Richard Warch announced Friday that the college would broaden its current non-smoking policy to include all Lawrence-owned facilities beginning July 1, 2004.

The new policy will extend a smoke-free designation to all student residences, college-owned guesthouses, the Viking Room in the student union, Lawrence’s study center in London, and college-leased vehicles.

Beginning in 1994 with Kohler Hall, a student residence, Lawrence has progressively increased the number of buildings designated as smoke free. Since 2000, smoking has been prohibited in all Lawrence academic buildings and administrative …
