Focusing Failures In Competitive Environments: Explaining Decision Errors In The Monty Hall Game, The Acquiring A Company Problem, And Multiparty Ultimatums, Avishalom Tor, Max Bazerman

This paper offers a unifying conceptual explanation for failures in competitive decision-making across three seemingly unrelated tasks: the Monty Hall game (Nalebuff, 1987), the Acquiring a Company problem (Samuelson & Bazerman, 1985), and multiparty ultimatums (Messick, Moore, & Bazerman, 1997). We argue that the failures observed in these three tasks have a common root. Specifically, due to a limited focus of attention, competitive decision-makers fail properly to consider all of the information needed to solve the problem correctly. Using protocol analyses, we show that competitive decision-makers tend to focus on their own goals, often to the exclusion of the decisions …

By default, the courts are inventing health law. The law governing the American health system arises from an unruly mix of statutes, regulations, and judge-crafted doctrines conceived, in the main, without medical care in mind. Courts are ill-equipped to put order to this chaos, and until recently they have been disinclined to try. But political gridlock and popular ire over managed care have pushed them into the breach, and the Supreme Court has become a proactive health policy player. The goal of this Article is to participate in the challenging project of carving out a new area of study in the place where international law, comparative law, and domestic law intersect. In this Article, I use the story of flawed rule-of-law assistance efforts to demonstrate the importance of this inquiry. I take as a basic premise that there are many situations in which it is justifiable and beneficial for the U.S. and other actors to seek to promote human rights and the rule of law abroad, and that at times even military interventions are a necessary and justifiable part …

Harold Jacobson was not only a fine scholar and excellent teacher who devoted a career to the University of Michigan, but he was also a very trusted colleague and a close friend. His scholarly work was very well recognized and admired. He was one of my colleagues while I taught at Michigan, to whom I willingly recommended students for a multidisciplinary approach to international relations. He was a theorist of political science and international relations who was willing and able to come to grips with the role of law in those fields.

Jake and I were professional colleagues and friends for more than twenty years, but it was in the last fifteen years that we worked closely together, bridging the supposed divide between political science and international law. Tematem artykułu jest identyfikacja elementów konstrukcji ekonomiczno- prawnej spółek kapitałowych (spółki z ograniczoną odpowiedzialnością i spółki akcyjnej) z punktu widzenia ich wewnętrznej organizacji i funkcjonowania. Dotyczy to zwłaszcza uwarunkowań podejmowania decyzji korporacyjnych i zarządczych. Identyfikacja taka ma na celu ułatwienie dokonania wyboru typu spółki w praktyce, co rzutuje na sposób zarządzania. Podstawowym kryterium wyboru typu spółki kapitałowej jest odmienność konstrukcji obu spółek, która przejawia się w osobowo . kapitałowym charakterze spółki z o.o. i czysto kapitałowym charakterze spółki akcyjnej; fakt ten ma bezpośredni wpływ na sposób zarządzania przez właścicieli.
