International Law And The Pre-Emptive Use Of Force: Afghanistan, Al-Qaida, And Iraq, Christopher Greenwood

San Diego International Law Journal

This Article will review the legal framework on the use of force and suggest that there are cases in which the use of "preemptive force" may be justified, provided that certain important conditions are satisfied. Parts III and IV will then apply this analysis to the two cases that have focused attention on the whole issue of preemptive action, namely, the threat from international terrorism (Part III) and the situation in Iraq (Part IV). The writer's conclusions are summarized in Part V.

American force transformation is about building a new expeditionary model with flexible, modular forces that can be managed on a global basis to protect U.S. interests. Breaking the tyranny of geography on military forces is a key aspect to change.

Transformation represents a shift in the demand side of the defense industrial business to provide for these new capabilities. The Department of Defense (DOD) is seeking system-of-systems management to deliver capabilities to the services and for joint military operations. Turbulence plays an important role in ship wake flows. Without the knowledge of turbulent intensities and length scale information it is virtually impossible to model and predict turbulence characteristics in complex flows, such as ship wake flows. Moreover, the behavior of ship wakes requires an understanding of the turbulence near a free surface. The present study will focus on identifying the contributions of various mechanisms, but primarily that of the free surface, to the process of turbulence generation and dissipation in the wake of a turning ship using the large eddy simulation (LES) technique. If the ICC is truly to become a world criminal court, then this body should begin to clothe itself with all the traditional components of a criminal justice system. A successful international criminal court cannot be dependent on the political will of so-called cooperating states. Crimes that fall within the jurisdiction of the ICC should be subject to prosecution by the court, which requires that there exist some body or agency capable of enforcing indictments and arresting suspected individuals. A new method for design and scale-up of photocatalytic and thermocatalytic processes is disclosed. The method is based on optimizing photoprocess energetics by decoupling of the process energy efficiency from the DRE for target contaminants. The technique is applicable to photo-thermocatalytic reactor design and scale-up. At low irradiance levels, the method is based on the implementation of low pressure drop biopolymeric and synthetic polymeric support for titanium dioxide and other band-gap media. At high irradiance levels, the method utilizes multifunctional metal oxide aerogels and other media within a novel rotating fluidized particle bed reactor.

Keeping sensitive information private in a public world is a common concern to users of digital credentials. A digital credential may contain sensitive attributes certifying characteristics about its owner. X.509v3, the most widely used certificate standard, includes support for certificate extensions that make it possible to bind multiple attributes to a public key contained in the certificate. This feature, although convenient, potentially exploits the certificate holder's private information contained in the certificate. There are currently no privacy considerations in place to protect the disclosure of attributes in a certificate. The project that follows is my attempt to respond to two serious problems within the field of ethics. Firstly, I believe that too many ethical systems begin with an abstracted conception of how human beings should act in the world, only afterwards taking account of a conception of the way we are in the world, a conception that becomes deeply influenced and distorted by the ethical imperatives already formed.
