Sexual Violence As Genocide: The Developing Law Of The International Criminal Tribunals And The International Criminal Court, Jonathan M.H. Short

This note will explore the treatment of the two primary violent sexual acts, rape and forced pregnancy, in modern international criminal law; more specifically in its treatment as genocide. The woman as an individual is the primary sufferer of sexual violence during armed conflict, however sexual violence is a calculated means by which perpetrators seek to destroy an entire ethnic group. Sexual violence is both an attack against the woman and an attack against the ethnic group, and should be prosecuted as such. While crimes against individuals are best prosecuted as crimes against humanity or under domestic law, crimes committed …

A restorative justice paradigm emphasizes healing relationships between offenders, their victims, and the community in which the offense took place. It rejects retribution as a response to crime, focusing instead on the needs of all parties involved. This Note discusses the necessity for, and possible benefits of, using restorative justice principles when responding to international crimes and conflicts. Prosecution, war, and other violent means remain the most common responses to crime and conflict today. Such retributive reactions often lead to further violence rather than healing and peace. In the aftermath of the September 11th attacks, the United States has held suspected terrorist detainees captured during the military campaign in Afghanistan indefinitely at the United States military facility at Guantanamo Bay, Cuba. Among those currently detained are members of the al-Qaeda terrorist group and the Taliban. Currently the detainees are in the peculiar situation of generally being outside the scope of protections offered by both the international humanitarian law and the Unites States criminal law regimes.

It is indisputable that the international arbitration world is an identifiable epistemic community that transcends national borders, and whose members are shaped by their own experience. Increasingly, that experience reflects an American influence, be it heritage, training, affiliation, or client base. This study explores how top management teams make strategic decisions. The findings indicate that the top management team performs a variety of monitoring and control functions within most firms, but that a single team with stable composition does not make strategic choices in most organizations. Instead, different groups, with members from multiple organizational levels, form to make various strategic decisions. A stable subset of the top team forms the core of each of these multiple decision‐making bodies. While in times of peace a growing number of multilateral environmental agreements serves to protect the environment, existing international law affords only very limited protection against the threats of war to the environment. This is the finding of a study by Prof. Daniel Bodansky, University of Georgia, USA on behalf of the German Federal Environmental Agency (Umweltbundesamt) which reviews the adequacy of the law of war and of the general principles of international law to protect the environment. At present international law leaves nation states with a wide degree of discretion to justify environmental harm caused by acts of war.

Of the discussions that took place at the highest policy levels during the administration of Dwight D. Eisenhower, those concerning the possibility of a diplomatic solution to the arms race with the Soviet Union were among the most urgent and, perhaps, the most consequential in their failure. In the United States, members of the Eisenhower cabinet and other agencies and departments analyzed and addressed the consequences of various diplomatic proposals. This is an examination of the various cultural groups who have attempted to extend hegemony control over what is now the state of Arizona. Each chapter focuses on the ways different societies adapted to the region's challenging environment; paying particular attention to those that sought to integrate their neighbors into their own socioeconomic systems, whether by force or through negotiation. The rise and fall of the indigenous Hohokam civilization marks the first phase in this struggle for hegemony, while conflicts between Spaniards and Indians characterize the second. The Reverend Jesse Louis Jackson has addressed the Democratic National Convention through five consecutive election cycles. Jackson's political involvement works to challenge the majority value system. Each address aims to create a community consisting of minority voices in America by bringing them into the Democratic Party in hopes of changing national policy. Metaphorical strategy is used to symbolically create a community consisting of minority voices, the Democratic Party, and Jackson himself as the prophetic leader. Symbolically unifying the community against a common enemy strengthens Jackson's community.

Effects Of A Heat Acclimation Program On Physiologic And Psychological Responses To Work And Heat While Wearing Fire Ensemble, Dale Anthony Branks

Heat acclimation program effects on rectal temperature and heart rate during walks in the heat wearing structural fire protective ensemble (FE) were examined. On six consecutive days, male subjects (N = 7) walked 30 minutes on a treadmill (46--53% V˙O2peak) within a 40 +/- 2°C, 20--22% r.h. environment, wearing FE. Rectal (Trec) mean skin (Tsk), and rectal-skin temperature gradient (T rec-Tsk), heart rate (HR), oxygen uptake (VO2), minute ventilation (VE), rating of perceived exertion (RPE), rating of thermal discomfort (RTD), sweat rate and Na+ and K+ were assessed daily. Significance (p < 0.05) was determined by one way repeated measures ANOVA. Average heart rate, and daily sweat Na+ and K+ concentrations were the only variables observed to decrease significantly during the six days. These changes however were small and represent a questionable practical benefit. Therefore, a six day heat acclimation program during summer months provides no benefit to work in the heat while wearing FE.

The “China Lobby,” a common term applied to groups and individuals aggressively seeking America’s political commitments to and financial aid for Chiang Kai-shek’s Guomindang (GMD) regime in China, came into popular use in the 1950's, especially as it fit into the highly volatile context of the Cold War. A closer investigation of this lobby, however, reveals that it originated not in the postwar turmoil of Cold War politics but a decade earlier in the equally difficult debate over the proper role of the United States during the “China Incident” of the late 1930's. The Ardoyne neighborhood is not a place a tourist would want to visit. Its streets today are the front lines of what some would classify as a religious holy war, and are the regular backdrop for violent scenes of masked demonstrators, burning cars, and heavily armed soldiers and riot police. Guard towers, walls topped with barbed wire, armored cars, and helicopters are part of daily life in this area, but this neighborhood is not in the Middle East.
