What Is Evolution? A Response To Bamforth, Michael J. O'Brien, R. L. Lyman, R. D. Leonard Jan 2003

What Is Evolution? A Response To Bamforth, Michael J. O'Brien, R. L. Lyman, R. D. Leonard

History Faculty Publications (Archived)

Douglas Bamforth's recent paper in American Antiquity, "Evidence and Metaphor in Evolutionary Archaeology," charges that Darwinism has little to offer archaeology except in a metaphorical sense. Specifically, Bamforth claims that arguments that allegedly link evolutionary processes to the archaeological record are unsustainable. Given Bamforth's narrow view of evolution: that it must be defined strictly in terms of changes in gene frequency: he is correct. But no biologist or paleontologist would agree with Bamforth's claim that evolution is a process that must be viewed fundamentally at the microlevel. Evolutionary archaeology has argued that materials in the archaeological record are phenotypic in …

Decision Support For Software Projects: The Role Of Spc And Simulation Metamodeling, Omar F. El-Gayar Jan 2003

Decision Support For Software Projects: The Role Of Spc And Simulation Metamodeling, Omar F. El-Gayar

Research & Publications

While many researchers have attempted to directly apply statistical process control (SPC) to the software domain, several difficulties in applying SPC to software development, in particular, the inability to compute meaningful control limits for the process. In this research, we propose a framework for applying SPC to software projects. The framework integrates SPC concepts and simulation metamodeling to create meaningful control limits on process and project inputs. The framework is demonstrated using a case study.

A Content Analysis Of The Effects Of Media Framing Of Naming Rights On Corporate Sponsorship., Douglas Scott Lovell Jan 2003

A Content Analysis Of The Effects Of Media Framing Of Naming Rights On Corporate Sponsorship., Douglas Scott Lovell

Graduate Theses, Dissertations, and Problem Reports (ETD)

This paper addresses the relationship between corporate sponsorship and naming rights concerning sporting venues. It is hypothesized that corporations are more positively framed in the media when granted naming rights of major sporting venues. The literature review establishes the history of corporate sponsorship (as related to sports), naming rights, reviews the effects of advertising, and cites examples of previous and current examples of this type of relationship. Manifest content analysis was utilized to examine media coverage in the Pittsburgh Post Gazette newspaper of articles concerning naming rights of Heinz Field and PNC Park. Results indicated more intense as well as …

Ethical And Legal Standards For Research In Prisons, Karen C. Kalmbach, Phillip M. Lyons Jan 2003

Ethical And Legal Standards For Research In Prisons, Karen C. Kalmbach, Phillip M. Lyons

Psychology Faculty Publications (Archived)

Biobehavioral research, especially that which is conducted with prisoners, has become much more closely regulated in the last 30 years. State and federal law, as well as professional standards, regulate the conduct of many types of research; in the case of prisoners, this regulation is even more stringent. However, currently no mandatory, uniform, national regulatory or oversight process exists, and many privately funded research endeavors are operating in a regulatory void. In response to this, the National Bioethics Advisory Commission has argued for the creation of a single, national, independent regulatory body to oversee all human participant research, regardless of …

Industry In Harper's Ferry, West Virginia, 1861-1865., Coral L. N. Totten Jan 2003

Industry In Harper's Ferry, West Virginia, 1861-1865., Coral L. N. Totten

Graduate Theses, Dissertations, and Problem Reports (ETD)

Harperís Ferry, West Virginia began its existence as a small settlement in the Northern Neck of colonial Virginia. Originally it was a point of departure for westward expansion, but due to its geographical location, the cultural background of the immigrants who settled there, and technological advancements in transportation, communication and manufacturing, it became a model of industrial development in the nineteenth century. Although it possessed all the factors necessary for continued growth, unwise land management practices, due in part to the Civil War, as well as the consequences of war itself, and technological advancements in steam power, led to the …

Building Peace In Northern Ireland: Christian Reconcilers In An Economy Of Hate, Eric Getty Jan 2003

Building Peace In Northern Ireland: Christian Reconcilers In An Economy Of Hate, Eric Getty

Journal of Hate Studies

The Ardoyne neighborhood is not a place a tourist would want to visit. Its streets today are the front lines of what some would classify as a religious holy war, and are the regular backdrop for violent scenes of masked demonstrators, burning cars, and heavily armed soldiers and riot police. Guard towers, walls topped with barbed wire, armored cars, and helicopters are part of daily life in this area, but this neighborhood is not in the Middle East. Rather, it lies far to the north in Belfast, Northern Ireland, part of industrialized Western Europe. Here, row upon row of run-down …

Spsm And Spc For Software Process And Project Management, Omar F. El-Gayar Jan 2003

Spsm And Spc For Software Process And Project Management, Omar F. El-Gayar

Research & Publications

Software process simulation modeling (SPSM) provides a platform for process and project management. On the other hand, statistical process control (SPC) provides the means to assess a process for stability and capability through visualization. This paper provides a framework for integrating SPSM and SPC. The framework realizes their synergy by leveraging the investment in supporting software measurement processes, ensuring the stability of the underlying development process, and enhancing simulation output using visualization techniques made possible through SPC. The paper illustrates the framework by integrating SPC to an existing SPSM. The integrated model is then used to evaluate the underlying process …

A Comparative Review Of A College Education's Effect On Law Enforcement Officers Relating To Internal Affairs Complaints, Bill Griffin Jan 2003

A Comparative Review Of A College Education's Effect On Law Enforcement Officers Relating To Internal Affairs Complaints, Bill Griffin

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The purpose of this research is to determine if a relationship exists between higher education levels and misconduct allegations for Deputy Sheriffs. Official documentation from 128 internal affairs reports were collected from the Palm Beach County Sheriff's Office. Significant relationships were found to exist between higher education levels and the misconduct allegations. While some college exposure may be beneficial for job performance, a four-year degree may not yield the desired results.

American Exceptionalism And Us Foreign Policy: Public Diplomacy At The End Of The Cold War, Steve Yetiv

Political Science & Geography Faculty Publications

This book offers an interesting foray into an important and timely subject. The author explores chiefly how American leaders have used the idea of American exceptionalism to realize foreign and domestic goals, including building support for government policies. But the work also deals more broadly with rhetoric and its meaning in American public diplomacy and foreign policy.

From Realism To Minimalism And Back Again: A Comparison Of Anton Chekhov And Raymond Carver, Olga Olegovna Cherchesova Jan 2003

From Realism To Minimalism And Back Again: A Comparison Of Anton Chekhov And Raymond Carver, Olga Olegovna Cherchesova

Dissertations and Theses @ UNI

This thesis involves a comparison of two short story writers: Anton Chekhov and Raymond Carver. Anton Chekhov has been acknowledged as one of the most significant influences upon the American literature; in particular, he had a strong personal and professional influence on Raymond Carver. Examination of these authors' works traces the tradition of literary inheritance and the development of the short story genre itself in the twentieth century. This thesis explores the survival of Chekhovian narrative tradition in American postmodern short story as epitomized in the work of Raymond Carver.

Bi-Polar And Polycentric Approaches To Human Rights And The Environment, Michael Burger Jan 2003

Bi-Polar And Polycentric Approaches To Human Rights And The Environment, Michael Burger

Sabin Center for Climate Change Law

Within the well-established human rights system, there exist at least three ways to promote environmental ends (each of which is discussed further in Section III below): (1) mobilizing existing rights to achieve environmental ends; (2) reinterpreting existing rights to include environmental concerns; and (3) creating new rights, such as the right to a clean environment. To justify engaging in any one of these processes, an advocate must recognize both their moral legitimacy and legal utility. As one author has argued, "the justification for rights is to be found in the way in which they enable us to address a key …

Battering, Forgiveness And Redemption, Brenda V. Smith

Scholarly Articles in Law Reviews & Journals

This Article focuses on a topic that, though frequently discussed, has been dismissed in the domestic violence discourse - forgiveness. The author draws upon personal narrative to frame the challenge of forgiveness. The article explores forgiveness - for domestic violence survivors, for batterers, and for communities - through a personal lens and drawing upon mediation, restorative justice and indigenous peace and reconciliation models. The article concludes that exploration and embrace of models that address forgiveness and reconciliation are overdue and would contribute greatly to practice and discourse on domestic violence.

International Responses To Separatist Claims: Are Democratic Principles Relevant?, Diane Orentlicher Jan 2003

International Responses To Separatist Claims: Are Democratic Principles Relevant?, Diane Orentlicher

Scholarly Articles in Law Reviews & Journals

Although a perennial feature of global politics, separatist movements had scant prospect of success for nearly half a century after World War II. And so the recent proliferation of new states has shattered settled expectations. In the 1990s, Yugoslavia fractured into five states, the Soviet Union split into fifteen, Eritrea separated from Ethiopia, Czechoslovakia divided into the Czech Republic and Slovakia, and East Timor won independence from Indonesia. The success of breakaway movements from Slovenia to Eritrea has given new impetus to a raft of other separatists across the globe. And small wonder: the surge in state making in the …

Clergy Interest In Innovative Collaboration With Psychologists, R. Allen Lish, Mark R. Mcminn, C. Richelle Fitzsimmons, Alicia M. Root

Faculty Publications - Doctor of Psychology (PsyD) Program

What forms of innovative collaboration are possible between clergy and psychologists? A total of 117 clergypersons (63% response rate) rated 6 scenarios of collaboration, indicating their level of interest and the extent to which they would like to remain involved with the psychologist. The scenarios were derived from two categories of collaboration articulated by in previous research: mental health services and enhancing parish life. Overall, clergy expressed relatively modest levels of interest in innovative collaboration, though they were somewhat interested in mental health consultation services. Many clergy refer troubled parishioners to clinical or counseling psychologists for treatment, but appear less …

What Happened To The Skeptical Environmentalist, David Schoenbrod, Christi Wilson Jan 2003

What Happened To The Skeptical Environmentalist, David Schoenbrod, Christi Wilson

Articles & Chapters

This essay focuses on the critical reaction to Bjorn Lomborg's book, The Skeptical Environmentalist. After the book was glowingly reviewed in the Washington Post, the Economist, and other influential publications, it was critically reviewed in Scientific American, Nature, and Science and criticized by environmental organizations. The criticism went beyond trying to show him wrong on environmental policy to claim that he should be disqualified as a participant in debates on environmental policy. The basis for the disqualification was that he does not understand the science or was disingenuous in his treatment of it. In analyzing this effort to disqualify him, …

Legal Services In The Doha Round, Sydney M. Cone Iii. Jan 2003

Legal Services In The Doha Round, Sydney M. Cone Iii.

Articles & Chapters

As a subcategory of professional services and a sub-subcategory of business services, legal services, when supplied transnationally, are the subject of negotiation in the current round of multilateral trade negotiation known as the Doha Round. The negotiations on legal services that take place in the Doha Round have considerable potential for affecting the economics and activities of lawyers and law firms, and for influencing the content of local professional rules governing the practice of law. This article examines that potential.

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii. Jan 2003

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii.

Articles & Chapters

This article examines the nexus between two international topics, namely, trade negotiations, and regulation of the cross-border practice of law. Admittedly, this nexus is not found at a conventional crossroads. Legal services lie somewhat at the periphery of international trade measured in terms of the global value of goods, services and investment used to define major international economic relationships, or to define priorities in the formulation of national and transnational economic policies. Moreover, trade negotiators hardly figure amongst the principal regulators having responsibility for the professional conduct of individuals and firms engaged in the practice of law.

Notwithstanding the somewhat …
