Stages Of Legal Reasoning: Formalism, Analogy, And Realism, Wilson R. Huhn

In the late 19th Century, legal reasoning was dominated by formalistic analysis. Judges and lawyers reasoned deductively from base principles. Legal historians have persuasively described how leading judges and scholars fomented a revolution in legal thought in the 20th Century. Starting about 1910, legal realism--or policy analysis-- entered legal reasoning to the point that today it would be unusual to find a judicial opinion or brief that fails to explore the policy implications of an interpretation of the law. This historical shift from formalism to realism suggests that there are stages of legal reasoning.

Performance Verification Of Personal Aerosol Sampling Devices, Steven T. Luecke

International standards establish criteria for size-selective aerosol sampling for industrial hygiene. Commercially available aerosol samplers are designed to conform to these criteria. This study uses semi-monodispersed aerosols generated in a vertically aligned test chamber to compare the performance of three commercially available respirable dust samplers, one of which can simultaneously sample for thoracic and inhalable dust fractions. Comparison methods are used to calculate a theoretical fractional value based on the appropriate sampling conventions of the total dust concentration and size distribution of test materials. Performance of actual samplers can be conducted by comparing observed results to the theoretical value. Results …

The Enterovirus genus within the family Picornaviridae contains over 100 serotypes, of which sixty-four are known to be human pathogens. Infection with this group of RNA viruses produces a myriad of clinical conditions including poliomyelitis, meningitis, encephalitis, respiratory illnesses, and hand-foot-and-mouth disease. Outbreaks have been documented worldwide; significant morbidity and mortality exist to warrant laboratory surveillance.

Traditionally, enteroviruses have been identified to the level of serotype by the serum neutralization assay. However, numerous problems are associated with this assay. Body Image As A Function Of Colorism: Testing A Theoretical Model, Alicia V. Hall

A Covariate Structure Model was used to examine a possible relationship between colorism as a component of body image and global psychological functioning in the hypothesized model. Two hundred-fifty-five African-American women were recruited from undergraduate psychology and social work classes to participate in the current study from state and community colleges in the southeastern United States, and from social groups and church organizations. The results indicated that the hypothesized model was not a good fit to the data; therefore, the model was re-evaluated. The results of the analysis of the revised model indicated that the revised model was not plausible. …

Incidence of suicide has been shown to increase dramatically during adolescence. Despite an established pattern of depression and hopelessness leading to suicide in adults, no such pattern emerges in the adolescent literature. Recent investigations suggest that impulsivity may play a key role in adolescent suicide attempts. This study examined the role of impulsivity in adolescent suicidal gestures, as well as the relationships among demographic variables, anger expression, impulsivity, and suicidal behavior. A total of 100 participants (ages 11-17; 71 females and 29 males) were recruited from 2 inpatient crisis centers for children. The Children’s Depression Inventory, Hopelessness Scale for Children, …

Littoral Dripstone And Flowstone--Non-Spelean Carbonate Secondary Deposits, Danko Taborosi, Kevin Stafford

Speleothem-like dripstone and flowstone deposits can form in the non-spelean environments of marine notches on tropical carbonate coastlines. Hereby termed “littoral dripstone” and “littoral flowstone” to distinguish them from genuine cave deposits, they reflect the basic speleothem types: draperies, stalactites, stalagmites, and columns. Nevertheless, these formations lack the luster and crystallinity of cave analogues, and are not nearly as well-developed, dense, and massive. They are composed of layered microcrystalline aragonite and calcite, are generally highly porous, and invariably overlie dissolutional and bioerosional karren. Change is the basis for improving and expanding individual, group, and organizational effectiveness, performance, and learning. However, HRD has utilized and developed few empirically validated individual change models or theories. Because HRD is a multidisciplinary in nature, it is important for researchers and practitioners to consider what models or theories others have to offer. One influential model from the health and medical field that has promising utility in HRD is the Transtheoretical Model (TTM) of individual change. There has been increasing demand for rigorous methods for evaluating biodiversity, one of the ecosystem services that sustains and fulfills human life. After carefully examining the literature, we found three key points that should be taken into account when we evaluate biodiversity. The first point is that any "indicator species" tends to be a leaky target of biodiversity. The second point is that "buffering" that is useful for representing the ecological concept of boundaries should have scientific meanings. The third point is that a "watershed" that integrates most natural processes is advantageous as the spatial range for evaluation. Based on …

What do we mean by legal justice, as opposed to distributive, or social, or political justice; what is the justice, that is, we hope law promotes? What is the justice that lawyers and judges, peculiarly, are professionally committed to pursue? What is the virtue around which, arguably, this profession, and the individuals within it, have defined their public lives?

Conservatives are taking aim at the field of public health, targeting its efforts to understand and control environmental and social causes of disease. Richard Epstein and others contend that these efforts in fact undermine people’s health and well-being by eroding people’s incentives to create economic value. Public health, they argue, should stick to its traditional task—the struggle against infectious diseases. Because markets are not up to the task of controlling the transmission of infectious disease, Epstein says, coercive government action is required. But market incentives, not state action, he asserts, represent our best hope for controlling the chronic illnesses that …

This review essay considers the tension between the evidence-driven vision of science's mission and the fears of malicious use and terrible consequences that have come to the fore since the terrorist attacks of September 11, 2001. These fears have led some to call for government restrictions on the substance of scientific research and communication. In general, this approach is likely to do far more harm than good.
