The note then presents the Supreme Court's analysis and reasoning for reversing the lower court. Part III discusses the jurisprudence leading to the Court's decision and part IV addresses the impact of the Court's decision.

Jurors' Evaluations Of Expert Testimony: Judging The Messenger And The Message, Sanja Kutnjak Ivkovic, Valerie P. Hans Apr 2003

Jurors' Evaluations Of Expert Testimony: Judging The Messenger And The Message, Sanja Kutnjak Ivkovic, Valerie P. Hans

Cornell Law Faculty Publications

Jurors are laypersons with no specific expert knowledge, yet they are routinely placed in situations in which they need to critically evaluate complex expert testimony. This paper examines jurors' reactions to experts who testify in civil trials and the factors jurors identify as important to expert credibility. Based on in-depth qualitative analysis of interviews with 55 jurors in 7 civil trials, we develop a comprehensive model of the key factors jurors incorporate into the process of evaluating expert witnesses and their testimony. Contrary to the frequent criticism that jurors primarily evaluate expert evidence in terms of its subjective characteristics, the …

Crimes On College Campuses, Angela M. Turner Apr 2003

Crimes On College Campuses, Angela M. Turner

Masters Theses

A college or university is not a place where crime is expected. Crime was not recognized as a discrete campus problem until recently. Information on this topic is limited and difficult to obtain. The purpose of my research is to measure the amount of crime on the campus of Western Michigan University (WMU). My research is focused on the crimes of rape, sexual assault and theft. The victims I study are students and resident hall assistants. My research method includes a self-report survey from a sample of 300 students and resident hall assistants enrolled at WMU.

I provide statistics from …

Congress, Civil Liberties, And The War On Terrorism, Neal Devins Apr 2003

Congress, Civil Liberties, And The War On Terrorism, Neal Devins

William & Mary Bill of Rights Journal

In exercising his war-making powers, the President has historically pursued war-related initiatives that implicate civil liberties. Meanwhile, the Congress, with little incentive to resist these initiatives, has played a steadily declining role in warmaking. In this Essay, Professor Devins examines this dynamic, and argues that with Congress largely standing on the sidelines as the President leads the nation in war, it is the American public that has become the principal check on the powers of the President in wartime.

Reflections On Civil Liberties In An Age Of Counterterrorism, Conor Gearty Apr 2003

Reflections On Civil Liberties In An Age Of Counterterrorism, Conor Gearty

Osgoode Hall Law Journal

This article examines the historical origins of civil liberties and shows their importance to systems of government rooted in the principles of representative democracy. It argues that the subject of civil liberties needs to be distinguished from issues related to criminal justice and human rights, and that too broad a deployment of the language of civil liberties can lead to the importance of civil liberties being underappreciated by the wider public. The article considers how the integrity of the language of civil liberties and the representative system of democracy as a whole can be preserved in the face of the …

No Exit: Racial Profiling And Canada's War Against Terrorism, Reem Bahdi Apr 2003

No Exit: Racial Profiling And Canada's War Against Terrorism, Reem Bahdi

Osgoode Hall Law Journal

After September 11, 2001, some scholars and policy-makers promoted the racial profiling of Arabs and Muslims as a means towards greater national security. While racial profiling has not been officially sanctioned in Canada, it attracts popular support and undeniably takes place. The first part of this article identifies three different categories of racial profiling in the context of Canada's War against Terrorism. The second part identifies the problems associated with racial profiling. It argues that racial profiling undermines national security while also heightening the vulnerability and exclusion of Arabs, Muslims, and other racialized groups in Canada.

It Does Take A Village To Raise A Child, Rebecca J. Boyd Apr 2003

It Does Take A Village To Raise A Child, Rebecca J. Boyd

Sociology & Criminal Justice Theses & Dissertations

Utilizing Cullen's (1994) Social Support Theory and Hunter's (1985) three dimensions of social life, this study is a quantitative, cross-sectional secondary data analysis designed to examine the relationship between institutional social support and rates of juvenile crime for counties and cities in Virginia for the year 2000. Resting on the contention that an inverse, significant relationship exists between measures of institutional support and rates of juvenile property and violent crime, this study examines types of support provided by the institutions of family, school, and the government. These measures of institutional support include 1) familial support: median income, marriage support; 2) …

An Analysis Of The Relationship Between Exposure To Risk, Gender, And Delinquency: An Exploratory Case Study, Rosanne D. Walters

Theses and Dissertations in Urban Services - Urban Management

This case study explored the interactive relationship between the type and level of risk experienced by males and females entering the Norfolk Juvenile Detention Home in 2000, differences in delinquent behaviors of males and females, and differences in responses to that behavior. The study was an outgrowth of a previous report to the Norfolk Juvenile Detention Home Utilization Task Force suggesting that females experienced a higher level of risk than males and that they were detained for lesser offenses. The study also was motivated by data from the Office on Juvenile Justice and Delinquency Prevention indicating that there had been …

One Strike And You're Out? Constitutional Constraints On Zero Tolerance In Public Education, Eric D. Blumenson, Eva Nilsen Apr 2003

One Strike And You're Out? Constitutional Constraints On Zero Tolerance In Public Education, Eric D. Blumenson, Eva Nilsen

Faculty Scholarship

Various studies reported that juvenile crimes of violence fell in the 1990s by as much as 30%. 10 In high schools specifically, the incidence of threatening behavior in 1996 changed little from two decades earlier, 11 with the chances of being killed in school far less than being struck by lighting. 12 The "juvenile crime bomb" proved illusory (as Delulio himself eventually acknowledged 13), but the severe measures designed to deal with it remain entrenched. Zero tolerance has taken on a life of its own, partly because public misperception remains high, 14 and partly because in our hardheaded times …

Addressing Sexual Misconduct In Community Corrections, Brenda V. Smith, Maureen Buell, Elizabeth Layman, Susan W. Mccampbell Apr 2003

Addressing Sexual Misconduct In Community Corrections, Brenda V. Smith, Maureen Buell, Elizabeth Layman, Susan W. Mccampbell

Scholarly Articles in Law Reviews & Journals

INAPPROPRIATE RELATIONSHIPS BETWEEN OFFENDERS AND EMPLOYEES of community-based corrections organizations have emerged as a serious issue. Among the most dangerous and destructive of these inappropriate relationships is sexual misconduct. The very nature of community corrections, with semi-autonomous employees, the increasing focus on a rehabilitative rather than the punitive model, the increase of offenders assigned to these programs, and actual allegations of sexual misconduct have raised the awareness of administrators of the need for action.

War At Home Spouse Abuse In Military Families, Carrie L. Gray Apr 2003

War At Home Spouse Abuse In Military Families, Carrie L. Gray

Sociology & Criminal Justice Theses & Dissertations

This study examines the patterns, tendencies, and physical severity of spouse abuse in military families. The demographic makeup of military families in many ways parallels that of violent families in the civilian community. Therefore, this study will determine if certain variables will be similarly correlated in cases of wife abuse within military families as they are in civilian families. Although a significant amount of research has been conducted on spouse abuse in the last thirty years, family violence within military families has been virtually ignored. This study utilizes secondary data provided by the Navy Family Advocacy Central Registry located in …

Population Mobility High-Risk Environments And The Diffusion Of Hiv/Stds: A Community Based Study In Southwest China, Hongyun Fu Apr 2003

Population Mobility High-Risk Environments And The Diffusion Of Hiv/Stds: A Community Based Study In Southwest China, Hongyun Fu

Sociology & Criminal Justice Theses & Dissertations

Globally, population migration has been associated with the spread ofHIV/STDs in many countries. A similar trend has been observed in China from the very beginning of the HIV epidemic, but empirical research is very limited. Furthermore, the previous studies mainly focused on the micro impact of migration on individual migrant's risky behaviors. The impact of population mobility on the general population, especially on non-migrant residents, has been ignored. Using data collected from a specially designed community level survey, which was conducted in a province in the Southwest of China, this study examines the macro-level association between temporary migration and the …

Monitoring The Quality And Utilization Of Mental Health Services In Correctional Facilities, Clarence J. Sundram Mar 2003

Monitoring The Quality And Utilization Of Mental Health Services In Correctional Facilities, Clarence J. Sundram

University of the District of Columbia Law Review

Explosive growth in the population of seriously mentally ill inmates in prisons has created new demands for mental health services. Increased public expenditures for such services require increased accountability. This article identifies essential elements of an adequate system of mental health care in a correctional environment. It describes the common areas of vulnerability when the adequacy of correctional mental health services is challenged in court. It proffers several arguments in favor of a proactive program of monitoring the adequacy of mental health services in correctional facilities. Finally, the paper suggests specific areas and methods for monitoring both by internal quality …

Mental Health And Incarceration: What A Bad Combination, Olinda Moyd Mar 2003

Mental Health And Incarceration: What A Bad Combination, Olinda Moyd

University of the District of Columbia Law Review

The District of Columbia has one of the highest per capita incarceration and criminal justice supervision rates in the United States1 and among the highest in the world. The local prison population has risen dramatically over the past decade for a variety of reasons including increased rates of re-incarceration for parole violations and the imposition of longer sentences for drug offenses. Recent acts of Congress have seriously impacted the sentencing laws in the District including determination of where persons sentenced for violating local D.C. laws will serve such sentences. On August 5, 1997, President Clinton signed into law The National …
