Misguided Federalism, Peter J. Henning
Misguided Federalism, Peter J. Henning
Missouri Law Review
Federalism has moved to the forefront of constitutional analysis in recent years as a narrow majority of the Supreme Court has begun to rein in congressional assertions of authority to legislate in areas viewed as beyond the constitutional grant of power to the federal government. One means of curtailing congressional authority is by enforcing limits on the Commerce Clause, perhaps the broadest of Congress’s regulatory powers. In United States v. Lopez, the Court sent a “constitutional wake-up call” making clear that it would no longer acquiesce in every congressional enactment purportedly adopted as an exercise of the commerce power when …

Confronting Transgressions Of Prior Military Regimes Towards A More Pragmatic Approach, Okechukwu Oko
Confronting Transgressions Of Prior Military Regimes Towards A More Pragmatic Approach, Okechukwu Oko
Cardozo Journal of International and Comparative Law
The article argues that post-conflict African nations, particularly Nigeria, face a critical challenge in balancing justice for past regime transgressions with the need to maintain social stability and consolidate democracy. It contends that criminal prosecutions, while symbolically important, may disrupt social equilibrium and fail to address systemic issues stemming from authoritarian rule. Instead, the article advocates for a pragmatic approach, emphasizing the establishment of a Truth Commission as a middle ground between retribution and amnesty to facilitate reconciliation and advance democratic consolidation.
Terrorism, State Responsibility, And The Use Of Military Force, Greg Travalio, John Altenburg
Terrorism, State Responsibility, And The Use Of Military Force, Greg Travalio, John Altenburg
Chicago Journal of International Law
We have been told on countless occasions that we are at war against international terrorism. Casualties, both civilian and military, mount in this war-the most noteworthy terrorist attack produced more casualties than the attack on Pearl Harbor. Our military forces are engaged in a multitude of ways, from direct combat overseas, to advising friendly governments and their militaries, to assisting domestic law enforcement. We are advised that this war, like the Cold War before it, will be a long and difficult struggle. But if we are at war, it is a very different kind of war. Our enemies are not …
A View From The Trenches, Michael A. Newton
A View From The Trenches, Michael A. Newton
Vanderbilt Law School Faculty Publications
As a former armor officer, my roots are literally in the trenches. In sharing my figurative view from the trenches regarding the pursuit of justice, you should know that the pursuit of justice is the very core of our professional ethic among military lawyers. I was also privileged to serve as one of the foot soldiers within the ranks of the Department of State whose diplomatic focus revolved around the pursuit of personal accountability. My "view from the trenches" is therefore centered on a candid discussion of the pragmatic aspects of developing justice systems within the conditions and confines of …

Drug Courts: A Study Of Retention And Suspension In The Kalamazoo County Drug Court Program, James H. Houston
Drug Courts: A Study Of Retention And Suspension In The Kalamazoo County Drug Court Program, James H. Houston
Dissertations
This is a study of the Kalamazoo County Drug Treatment Court Programs. Participants in the court programs are men and women who reside in the county and are charged with drug-related non-violent felonies. These participants, along with judges and administrators of the program, were interviewed for the study. The interviews were held in face-to-face meetings: participants on neutral ground and court functionaries in their offices.
The study sought to determine what factors contributed to the success or failure of drug court participants. It asked to what extent program requirements are perceived by the participants to be coercive, and how this …

Waiving Goodbye: Incarcerating Waived Juveniles In Adult Correctional Facilities Will Not Reduce Crime, Ellie D. Shefi
Waiving Goodbye: Incarcerating Waived Juveniles In Adult Correctional Facilities Will Not Reduce Crime, Ellie D. Shefi
University of Michigan Journal of Law Reform
Incarcerating waived juveniles in adult correctional facilities does not reduce crime or result in increased public safety; incarcerating juveniles with adults is deleterious to both the individual offender and society. This Note argues for a renewed focus on rehabilitative rather than retributive justice, and in so doing, proposes the implementation of a comprehensive continuum of graduated sanctions that includes networks of small, secure, highly structured maximum-security juvenile facilities, wilderness camps, residential and non-residential community-based programs, restitution, and fines. This Note further advocates for the incorporation of extensive education, vocational training and placement, counseling, treatment, supervision, mentoring, transitional, aftercare, and support …

Campbell Law Review
This note will examine the Supreme Court's decision in United States v. Knights. Part II presents factual background and the basis for the district court's decision to suppress evidence seized during the search of Knight's home, as well as the Ninth Circuit's affirming opinion. The note then presents the Supreme Court's analysis and reasoning for reversing the lower court. Part III discusses the jurisprudence leading to the Court's decision and part IV addresses the impact of the Court's decision.
Jurors' Evaluations Of Expert Testimony: Judging The Messenger And The Message, Sanja Kutnjak Ivkovic, Valerie P. Hans
Jurors' Evaluations Of Expert Testimony: Judging The Messenger And The Message, Sanja Kutnjak Ivkovic, Valerie P. Hans
Cornell Law Faculty Publications
Jurors are laypersons with no specific expert knowledge, yet they are routinely placed in situations in which they need to critically evaluate complex expert testimony. This paper examines jurors' reactions to experts who testify in civil trials and the factors jurors identify as important to expert credibility. Based on in-depth qualitative analysis of interviews with 55 jurors in 7 civil trials, we develop a comprehensive model of the key factors jurors incorporate into the process of evaluating expert witnesses and their testimony. Contrary to the frequent criticism that jurors primarily evaluate expert evidence in terms of its subjective characteristics, the …
