A State May, Consistent With The Double Jeopardy Clause Of The Fifth Amendment Seek The Death Penalty On Retrial Following A Jury Deadlock At The First Capital-Sentencing Proceeding And Resulting Default Sentence Of Life Imprisonment: Sattazahn V. Pennsylvania, James R. Franks Jan 2003

Franks

Duquesne Law Review

The United States Supreme Court held that the Double Jeopardy Clause of the Fifth Amendment did not prevent Pennsylvania from seeking the death penalty on retrial because neither the jury deadlock in the capital-sentencing phase proceeding, nor the resulting entry of a default sentence of life imprisonment, constituted an acquittal on the merits.

Sattazahn v. Pennsylvania, 537 U.S. 101 (2003).

Graduate Record 2003: Making It, Southwestern Oklahoma State University Jan 2003

Graduate Record 2003: Making It, Southwestern Oklahoma State University

SWOSU Yearbooks

A Chinese proverb says that "the journey of a thousand miles begins with a single step."

For some that step is the beginning of the journey to attaining a college education. The decision to attend college is not an easy one; it is a decision riddled with thoughts of strict budgeting, massive time consumption, and of course dedication. Each person has his or her own reason for taking this step, but most would agree that the advantages of getting a degree tremendously outweigh any burden that the journey might place upon them. The journey begins as first-time students enter Freshmen …

The Effectiveness Of The Secondary Weapon Of The West Virginia State Police, Jesse Andrew Davis Jan 2003

The Effectiveness Of The Secondary Weapon Of The West Virginia State Police, Jesse Andrew Davis

Theses, Dissertations and Capstones

The present study examines the effectiveness of the West Virginia State Troopers’ secondary weapon, Oleoresin Capsicum (OC) pepper spray (CAP-STUN®), as a means of alternative use of force for non-cooperative subjects. The WV State Police have adopted OC in an effort to reduce the number and severity of injuries sustained by suspects. This method was adopted as an optional means to effect arrests through non-lethal force. The use of OC can control and restrain individuals while causing the least possible harm to the individuals without increasing danger to troopers or others. Questionnaires were sent to West Virginia State Troopers for …

Analysis Of Impulsive Behaviors Among Prison Inmates Convicted Of Violent Crimes, Inmates Convicted Of Non-Violent Crimes And Undergraduate College Students, Lonnie Kishpaugh Sr.

Theses, Dissertations and Capstones

Sudden explosive episodes of rage and human aggression by individuals occur daily in our society. While impulsive aggressive behavior is included in several established psychological disorders, the etiology of such behavior has been widely debated.

This study tested the hypotheses that prison inmates who have committed violent crimes were no more likely to exhibit impulsive behavior, than like numbers of prison inmates who had committed non-violent crimes, or college students who have no criminal record. Groups of 20 each of the respective populations were randomly administered the Kipnis Impulsiveness Scale in accordance with instructions from the manual.

With an alpha …

Probation across America is in turmoil and its effectiveness is under scrutiny. In this paper, probation will be examined, more specifically the effectiveness of probation and the opinions of probation officers in West Virginia and the techniques they utilize in supervising offenders. Research will be presented from various experts across the country that have examined probation in America. Some of these experts report that probation is failing; however, judges have not given up hope on the effectiveness of probation and are willing to look at alternatives to traditional practices. To determine the efficiency of probation in West Virginia surveys were …

Identity Theft Awareness In North Central West Virginia, Gwendolyn Lea Goodrich Jan 2003

Identity Theft Awareness In North Central West Virginia, Gwendolyn Lea Goodrich

Theses, Dissertations and Capstones

Identity theft occurs when an individual "takes over" the identity of another without that person's consent or when someone uses bits and pieces of information about an individual to represent himself or herself as that person for fraudulent purposes. The simplicity of gathering personal identification through technology enhancements has made identity theft reportedly the fastest growing crime in the U.S. The latest report indicates, through a national survey, that 20 percent of Americans are victims of identity theft. However, the impact of this growing crime has not been assessed in North Central West Virginia, where this study occurred. The theory …

Abusing State Power Or Controlling Risk?: Sex Offender Commitment And Sicherungverwahrung, Nora V. Demleitner Jan 2003

Abusing State Power Or Controlling Risk?: Sex Offender Commitment And Sicherungverwahrung, Nora V. Demleitner

Scholarly Articles

This article addresses a paradigmatic risk-based collateral sanction, the so-called civil confinement. In contrast to many other collateral sanctions, it does not follow automatically but is judicially imposed following a hearing. In Hendricks v. Kansas (1997) the Supreme Court specifically upheld involuntary confinement following a criminal justice sentence for a sexually violent predator. The Kansas statute mandated confinement based on an assessment of dangerousness which had to result from a mental abnormality. Once it characterized the sanction as civil, the Court concluded that procedural protections traditional in the criminal context, such as double jeopardy, do not apply. The narrow majority …

The Classroom And Beyond: The Teacher's Role In Collaboration For Children With Emotional And Behavioral Disorders, Sarah Altman

Graduate Student Independent Studies

While many interventions have been used to help children with emotional and behavioral problems, outcomes for children with emotional and behavioral disturbances continue to be poor. Identifying teachers as essential collateral participants in evidence-based, systems approaches to addressing the needs of children with emotional and behavioral problems, this manual is offered as a guide for members of the education community. Teacher cooperation with empirically supported interventions, interagency collaboration, and programs that accept families as equal partners, have all been clearly supported by research and this collaborative role is discussed in light of relevant literature. Exploring the issues related to emotional …
