Global Changes In Scholarly Communication, Suzanne E. Thorin Jan 2003

Global Changes In Scholarly Communication, Suzanne E. Thorin

Librarian Publications

For more than a decade, the cost of print and electronic journals, particularly in the sciences, has increased rapidly at the same time that the amount of research being reported via published articles has grown exponentially. With academic libraries being less and less able to purchase the journals needed for their communities, the use of the term scholarly communication has evolved to illustrate the breakdown of the process of traditional scholarly publication; that is, as a means to disseminate research results, the present system of scholarly communication can no longer meet the needs of the scholarly community at large.

Teaching A Course On Regulation Of The Police (With A Special Focus On The Sixth Amendment), Christopher Slobogin Jan 2003

Teaching A Course On Regulation Of The Police (With A Special Focus On The Sixth Amendment), Christopher Slobogin

Vanderbilt Law School Faculty Publications

The organizers of this symposium gave us the choice of writing about effective assistance of counsel or about teaching criminal procedure. I've decided to do both. This article discusses teaching the criminal procedure course most often called "Police Practices," for which I write a textbook entitled Regulation of Police Investigation: Legal, Historical, Empirical and Comparative Materials.' Borrowing heavily from the Teacher's Manual for that book, the first part of this article describes my general philosophy for teaching the course. The rest of the article illustrates this philosophy by describing how I teach students about the application of the Sixth Amendment …

Myth Of Ownership / Myth Of Government, Jeffrey Schoenblum Jan 2003

Myth Of Ownership / Myth Of Government, Jeffrey Schoenblum

Vanderbilt Law School Faculty Publications

Indisputably, the lives of all individuals, now and throughout history, have not been commensurate in every respect. No individual has the most of everything at all times - net worth, love, happiness, security, companionship, fame, food, land, grandchildren, or whatever else he or she values.1 Nevertheless, a utopian strain in intellectual thought, emanating as the Enlightenment afterglow,2 continues to place its faith in the public construction of an ersatz equality that has never existed naturally.3 The Myth of Ownership, a recent book by two New York University law/philosophy professors, Liam Murphy and Thomas Nagel, is a striking exemplar of this …

Latinos In Framingham, Massachusetts, Daniel W. Vasquez Jan 2003

Latinos In Framingham, Massachusetts, Daniel W. Vasquez

Gastón Institute Publications

Census 2000 data include changes in the way people were counted. The most significant change is to allow persons to select more than one race, creating a new multiracial category of “two or more races,” but meaning people may not be included in the race with which they most identify. There was, however, no way to choose more than one ethnicity; one must choose either Latino or not. Throughout this profile, numbers reflect Latinos of all races, or non-Latinos by race, with persons of two or more races counted separately. All categorizations are based solely on self-identification. All of this …

A Comparison Of The Quality Of The School Experience For Current High School Students And For Teachers When They Were High School Students, James R. Willison, Sr. Jan 2003

A Comparison Of The Quality Of The School Experience For Current High School Students And For Teachers When They Were High School Students, James R. Willison, Sr.

Theses and Dissertations

This study is designed to compare the quality of school experiences for teachers when they were students with that of current high school students. Teachers and students from one urban, one suburban, and one rural high school in Central Arkansas completed the Concord High School Student Survey (CHSSS), an instrument designed to measure the quality of the school experience. Mean scores on the CHSSS for teachers and students were compared using a two-sample t-test. The data conclude that there is a statistically significant difference between perceived quality of school experiences for current students and the perceived quality of school experiences …

Evaluation Policies And Procedures For Building Administrators In Academically Advanced And Below Basic Schools In Arkansas, Cindy Viala

Theses and Dissertations

This study investigated the written policies and procedures of 10 advanced and 10 below basic school districts in Arkansas with a student population of 1,500 or more, and the opinions of building administrators within those districts concerning the evaluation of building administrators. Building administrators have the responsibility to meet public school accountability mandates from the 'No Child Left Behind' law. Data used includes written policies and procedures from each of the school districts and surveys collected from participating building administrators. Descriptive statistics and the chi-square statistic were used. Conclusions show that some school districts have written policies, but are not …

Tough Love: Nurturing And Coercing Responsibility And Recovery In California Drug Courts, Stacy Lee Burns Jan 2003

Tough Love: Nurturing And Coercing Responsibility And Recovery In California Drug Courts, Stacy Lee Burns

Sociology Faculty Works

This article considers the activities of the participants in California drug treatment courts and their differences from more traditional criminal courts. The article focuses on how drug court judges and defendants interact to construct the defendant as a personally responsible and rehabilitatively changed "recovering" person, or, alternatively, as an essentially "addicted" and deficient self. The research also explores broader links between the ways drug courts operate and the potential complications involved in mixing coerced treatment and "voluntary" participation. The study finds that certain kinds of defendants may be discovered to be unsuitable for participation in the program; that clients negotiate …

Toward A Unified Theory Of Professional Regulation, Andrew M. Perlman Jan 2003

Toward A Unified Theory Of Professional Regulation, Andrew M. Perlman

Suffolk University Law School Faculty Works

The Bar has addressed several issues in recent years that impact the legal profession's structure, including rules relating to multidisciplinary practice, multijurisdictional practice, and client solicitations. Unfortunately, theories of legal ethics have not focused on these rules, but have instead concentrated on regulations that govern how lawyers represent their clients, such as the duty of confidentiality or rules against the presentation of perjured testimony. This article contends that, by applying ethics theories to the structural rules, an additional justification emerges for more progressive regulations. Specifically, the article concludes that traditional theories can supplement existing calls for multidisciplinary practices, more liberal …

Nullification At Work? A Glimpse From The National Center For State Courts Study Of Hung Juries, Paula Hannaford-Agor, Valerie P. Hans Jan 2003

Nullification At Work? A Glimpse From The National Center For State Courts Study Of Hung Juries, Paula Hannaford-Agor, Valerie P. Hans

Faculty Publications

In 1998, the National Institute of Justice awarded a grant to the National Center for State Courts ("NCSC") to examine the frequency and various causes of hung juries. One of the factors that the NCSC project staff investigated was jurors' perceptions of the fairness of the law they were asked to apply in felony trials as well as jury and case characteristics that are often associated with jury nullification. The project also asked judges and other court actors to rate the strength of the evidence in the case. Thus, the project enabled researchers to examine jurors' views, the evidence, and …

The Art Of Legislative Lawyering And The Six Circles Theory Of Advocacy, Chai R. Feldblum Jan 2003

The Art Of Legislative Lawyering And The Six Circles Theory Of Advocacy, Chai R. Feldblum

Georgetown Law Faculty Publications and Other Works

A "legislative lawyer" is a person who exists in Washington, D.C., and in almost every city and state in this country where legislation and administrative regulations are developed. But most people do not know who that person is or what that person does. In fact, most advocacy organizations that should be hiring legislative lawyers have no idea who a legislative lawyer is.

The author coined the term "legislative lawyer" when she created a Federal Legislation Clinic at the Georgetown University Law Center in Washington, D.C. over a decade ago. The author needed to explain to her faculty colleagues what type …

Erasure And Recognition: The Census, Race And The National Imagination, Naomi Mezey Jan 2003

Erasure And Recognition: The Census, Race And The National Imagination, Naomi Mezey

Georgetown Law Faculty Publications and Other Works

This Article is concerned with the constitutive power of the census with respect to race. It is an examination of the U.S. Census as an aspect of what Angela Harris calls race law, "law pertaining to the formation, recognition, and maintenance of racial groups, as well as the law regulating the relationships among these groups." While others have noted and explored the epistemological and constitutive functions of the census race categories, my aim is to unpack this insight in the context of two specific examples of categorical change and contest: the addition of a Chinese racial category in 1870 and …

The Christmas Tree And The Two Churches, Johannes V. Knudsen Jan 2003

The Christmas Tree And The Two Churches, Johannes V. Knudsen

The Bridge

Part of the Danish American heritage is the fact that there were, unfortunately, some believe, two separate Danish American Lutheran Church groups. Because of theological differences (and perhaps personality conflicts, as well) between these two groups, they remained separate entities from their complex beginnings in the latter half of the nineteenth century until mergers took place with a number of other ethnic Lutheran church groups in the early 1960s, culminating in the formation of the Evangelical Lutheran Church in America in 1988. The histories of and differences between the two synods, the American Evangelical Lutheran Church and the United Evangelical …

A Reinterpretation Of Historical Gender Bias And Women's Mental Health, Jacqueline Lindsay Novak Jan 2003

A Reinterpretation Of Historical Gender Bias And Women's Mental Health, Jacqueline Lindsay Novak

Student Work

This epistemological review suggests that gender stereotypes and oppression have occurred throughout history and reflects past and present portrayals of women, particularly, the reflection of stereotypes and oppression cause women to suffer mental health consequences in two ways. First, societal oppression reduces and enforces women to an inferior status, which promotes mental health suffering and consequences. Second, women suffer from biased assessments, diagnoses, and treatment via hierarchical relationships and gender stereotypes from professionals. Presently, women are maintained at this subordinate position due to a lack of people and policies enforcing health standards specifically for women.

Locked In Segregation, Daria Roithmayr Jan 2003

Locked In Segregation, Daria Roithmayr

Publications

In earlier work, I have developed the lock-in model of inequality, which compares persistent racial inequality to persistent market monopoly power. In this article, I explore the implications of applying the lock-in model to the problem of residential segregation. Here, I put forward two central arguments. First, I argue that residential segregation constitutes an example of a locked-in racial monopoly. During the days of Jim Crow, white racial cartels (e.g., homeowners' associations and real estate boards) engaged in anti-competitive conduct to exclude blacks and monopolize access to good neighborhoods. That early neighborhood advantage has now become locked-in via certain self-reinforcing …

Apples, Oranges, And Grapefruit: A Comparative Analysis Of Private Enterprises, Nonprofit Organizations, And Local Government Agencies, James W. Arndt Jan 2003

Apples, Oranges, And Grapefruit: A Comparative Analysis Of Private Enterprises, Nonprofit Organizations, And Local Government Agencies, James W. Arndt

Masters Theses

The debate between the differences and similarities of public and private sector organizations has been waged over the last half of the century. A majority of these scholarly works target the comparison of large corporations and federal government agencies. Through these comparisons, three different approaches emerge. The generic approach argues that organizational sector differences are moot and this approach promotes a generic form of management. The publicness approach argues differences have become blurred to a point of degrees and that all organizations are public to an extent. The core differences approach argues that the differences between organizational sectors are significant. …

Does Television Impact Attendance At Eastern Illinois University Sporting Events, Gregory N. Powers Jan 2003

Does Television Impact Attendance At Eastern Illinois University Sporting Events, Gregory N. Powers

Masters Theses

This study tested the relationship between Eastern Illinois University home football and basketball games on television and attendance at these events. Attendance during a ten-year period for both EIU football and basketball games was recorded and dates of these contests were researched to determine if the games were telecast. After categorizing the figures into eight groups, the four pairs were compared using a T-test. The study found televising EIU home football games had no significant impact on attendance at these contests. However, a significant difference was noted between EIU home basketball games televised and those not aired. Attendance actually increased …
