Restorative Justice And The Danger Of "Community", Robert Weisberg Jan 2003

Restorative Justice And The Danger Of "Community", Robert Weisberg

Utah Law Review

Community is another name for the phenomenally complex strand of populism in American history, in all of whose versions community is selectively invoked and law always appropriated to achieve highly contestable social ends to police boundaries or resolve disputes. At one extreme, we have from the 1960s Saul Alinsky-type left-wing "community organizing," which explicitly seeks to create a new sense of community identity in order to achieve highly specific redistributive goals. But, at the other extreme, we have racist enclave-protecting crime aimed at solidifying a sense of community, and somewhere along the continuum we have Not In My Backyard environmental …

Restorative Justice, Punishment, And Atonement, Stephen P. Garvey Jan 2003

Restorative Justice, Punishment, And Atonement, Stephen P. Garvey

Utah Law Review

Restorative justice is an inspiring vision of how we should deal with the consequences of crime. But alas, its hope to eliminate altogether the need to punish an offender for the wrong he has done asks more than human nature will allow. Punishment is the way we right wrongs. So long as offenders commit wrongs that we wish to right, punishment will continue to be a practical necessity. The most for which we can realistically hope is not the elimination of punishment, but its transformation: punishment turned into penance.

Marriage Moments: A New Approach To Strengthening Couples' Relationship Through The Transition To Parenthood, Tamara Gilliland Jan 2003

Marriage Moments: A New Approach To Strengthening Couples' Relationship Through The Transition To Parenthood, Tamara Gilliland

Theses and Dissertations

Strengthening marriages is important to the well-being of individuals, families and communities. The transition to parenthood brings with it particular risks and opportunities for marriage relationships, yet no interventions have been successful in accessing a large number of couples during this critical time prepare and strengthen them for the challenges of becoming parents. The healthcare system has an established education infrastructure (childbirth education) that interacts with a significant number of couples during the transition to parenthood and has become increasingly open to incorporating relationship strengthening efforts into existing programs. The Marriage Moments program was designed to access couples through this …

Social Integration Of Hispanic Adolescents In A Predominately White Public School., Terri L. Eide

The purpose of this study was to identify those factors that affect the social integration of Hispanic adolescents in a predominately white public school. The sample includes seventh through twelfth grade students (N = 954) in two school districts located in small size Midwest cities. Subjects completed a questionnaire about themselves, their family and their educational experiences. Survey items specifically addressed the student’s sense of belonging to the school environment, their perceptions o f peers and school staff, their social involvement in school-sponsored activities, substance use, and experiences of being bullied. "Fifty Years After" Symposium Explores The Legacy Of Christine Jorgensen, Omar Portillo

Center for LGBTQ Studies (CLAGS)

There is a rich history of people who have deliberately constructed their bodies and challenged the binary sex-gender system. On November 22, CLAGS presented a symposium in which scholars, trans. activists, service providers, and artists revisited the life of one of the most famous of them — Christine Jorgensen — and considered her impact on our understanding of gender identities five decades after her "sex change" made headlines. Guest speakers - among them C. Jacob Hale, Hugh McGowan, Joanne Meyerowitz, Mariette Pathy-Allen, Ben Singer, Dean Spade, Chris Straayer, Susan Stryker, and Dinh Tu Tran — traced Jorgensen's life and the …

"Sodoma, Sodoma, Thus Cried The Boys: A Reappraisal Of Gianantoni Bazzi's Life And Work, James Saslow

Center for LGBTQ Studies (CLAGS)

The farther back we go from modern into early modern history, the harder it gets to document those facets of an artist's personal life that might provide an anchor for claims to discern forms of homosexual authorial intention—without the probability of which, gay/lesbian studies might indeed collapse into the baldest claim of its detractors, that it is naught but meaningless psychospeculation.

Lower Class Mobilization And State Welfare Policy In The Era Of Welfare Reform, James M. Avery, Mark Peffley Jan 2003

Lower Class Mobilization And State Welfare Policy In The Era Of Welfare Reform, James M. Avery, Mark Peffley

University of Kentucky Center for Poverty Research Discussion Paper Series

The 1990s played host to the most significant changes in the American welfare system in the last fifty years— in particular, states were granted much wider latitude in deciding who is eligible to receive welfare. Taking advantage of these changes, we examine the linkage between lower class turnout and state adoption of restrictive welfare eligibility requirements after the passage of the historic welfare reform legislation of 1996. We find that in states where lower class turnout was relatively high, lawmakers were much less likely to pass a range of “get tough” welfare rules. Our findings provide novel support for the …

Poverty And Macroeconomic Performance Across Space, Race, And Family Structure, Craig Gundersen, James P. Ziliak Jan 2003

Poverty And Macroeconomic Performance Across Space, Race, And Family Structure, Craig Gundersen, James P. Ziliak

University of Kentucky Center for Poverty Research Discussion Paper Series

Understanding the link between poverty and economic growth is of long-standing interest, but heretofore it has not received much attention within the context of the dramatic changes in recent business-cycle conditions and social policies. In this paper we use state-level panel data from the 1981–2000 waves of the Current Population Survey to examine the impacts of the macroeconomy and welfare reform on family poverty. We estimate models of before-tax and after-tax poverty rates and squared poverty gaps for all families, by family structure, and by race. Our results indicate that a strong macroeconomy at both the state and national levels …
