Internet Sex Crimes Against Minors: The Response Of Law Enforcement., Janis Wolak, Kimberly J. Mitchell, David Finkelhor

Crimes Against Children Research Center

The Internet1 and computers have come to play a growing role in sex crimes that are committed against children and youth.2 Since the mid-1990s these developing technologies have posed challenges for law enforcement requiring them to confront situations not anticipated in criminal statutes, master technical advances, develop new investigative techniques, and handle criminal cases that often span multiple jurisdictions. To assist, legislators have acted on a number of fronts creating new statutes that encompass Internet offenses, stiffening penalties, and creating a national clearinghouse for reports of Internet-related crimes against children and the CyberTipline® operated by the National Center for Missing …

Hydrogen As A Fuel For Dod, Timothy Coffey, Dennis R. Hardy, Gottfried E. Besenbruch, Kenneth R. Schultz, Lloyd C. Brown, Jill P. Dahlburg

Defense Horizons

Energy issues have been at the center of the national security debate for some time, and the current situation in the Persian Gulf underscores the strategic importance of sound energy policy. Activities or developments—geopolitical, environmental, technological, or regulatory—that materially change the energy security equation are, naturally, of great interest to the Department of Defense (DOD). The announcement by President George Bush in his State of the Union address that he intends to accelerate research and development (R&D) for hydrogen-powered vehicles toward the objective of total U.S. energy independence has great potential impact on DOD. This paper examines a number of …

Strong Mid-Depth Currents And A Deep Cyclonic Gyre In The Gulf Of Mexico, Wilton Sturges, Eric Chassignet, Tal Ezer Nov 2003

Strong Mid-Depth Currents And A Deep Cyclonic Gyre In The Gulf Of Mexico, Wilton Sturges, Eric Chassignet, Tal Ezer

CCPO Publications

The main purpose of this work was to explore the possibility that the deep flow (~2000m) around the edges of the Gulf circulates in a cyclonic, or counter-clockwise direction. The existence of such flow was proposed on theoretical grounds but had not been previously documented. Our results are quite clear that such flow is reliably observed.

In Memory Of Joan Fitzpatrick: A Former Student's Perspective, Elizabeth J. Kane Nov 2003

In Memory Of Joan Fitzpatrick: A Former Student's Perspective, Elizabeth J. Kane

Washington Law Review

When I first met Joan Fitzpatrick, it was immediately apparent that she possessed a seemingly limitless understanding of law, politics, and history. She combined this knowledge with a passion for teaching and promoting global human rights. As a scholar, Joan was brilliant; as a person, she was compassionate, dignified, and honest. Throughout the five years that I was lucky enough to have known her, her dedication to students, education, and above all action, was in my eyes heroic. In 1998, as an undergraduate research assistant at the University of Washington School of Law, Joan allowed me to take her graduate …

Abrogation Or Regulation? How Anderson V. Evans Discards The Makah's Treaty Whaling Right In The Name Of Conservation Necessity, Zachary Tomlinson Nov 2003

Abrogation Or Regulation? How Anderson V. Evans Discards The Makah's Treaty Whaling Right In The Name Of Conservation Necessity, Zachary Tomlinson

Washington Law Review

From 1787 to 1871, the federal government and various Indian tribes entered into hundreds of treaties. Under well-established U.S. Supreme Court precedent, the U.S. Congress has plenary authority to abrogate or modify any of these treaties. The U.S. Supreme Court is reluctant to find congressional intent to do so, however, and requires that this intent be clear and plain. States have no such power to qualify treaties, but the Court has allowed states to regulate treaty rights when doing so is necessary for species conservation. While the U.S. Supreme Court has kept these two lines of cases distinct, the U.S. …

Contributory Or Comparative: Which Is The Optimal Negligence Rule?, Christopher J. Robinette, Paul G. Sherland Nov 2003

Contributory Or Comparative: Which Is The Optimal Negligence Rule?, Christopher J. Robinette, Paul G. Sherland

Northern Illinois University Law Review

In this article, the authors examine whether contributory or some form of comparative negligence is the superior rule based on the goals of tort law. The authors conclude pure comparative negligence is the preferable rule. From a compensation perspective, pure comparative negligence compensates the most tort victims. From a corrective justice perspective, pure comparative negligence, unlike the other rules, requires tortfeasors to correct their wrongs in all cases. Finally, the authors use statistical analyses to determine if any of the rules has a stronger deterrent effect than the others. Based on claims data for automobile accidents in the various jurisdictions, …

Gambling With Terrorism And U.S. Military Readiness: Time To Ban Video Gambling Devices On U.S. Military Bases And Facilities?, John Warren Kindt Nov 2003

Gambling With Terrorism And U.S. Military Readiness: Time To Ban Video Gambling Devices On U.S. Military Bases And Facilities?, John Warren Kindt

Northern Illinois University Law Review

This article examines the effect that video gambling devices (VGDs) on US military bases have on military readiness in the 21st century's "Age of Terrorism. " The harmful effects of gambling on military personnel outweigh any potential benefits. However, this conclusion is not clear from the information upon which military analysts and researchers rely. Upon examining the harmful effects that gambling has on military readiness, issues arise regarding the potential biases of the informational sources that study the impact of gambling. A review of these informational sources reveals that many sources have close associations with the gambling industry including the …

In Defense Of Federalism: The Need For A Federal Institutional Defender Of State Interests, Kory A. Atkinson Nov 2003

In Defense Of Federalism: The Need For A Federal Institutional Defender Of State Interests, Kory A. Atkinson

Northern Illinois University Law Review

In Ring v. Arizona, 536 U.S. 584 (2002), the United States Supreme Court struck down the state of Arizona's death penalty procedure as violative of the Sixth Amendment's right to trial by jury. The Ring case is noteworthy because the Supreme Court upheld the identical procedure under the same constitutional provision twelve years earlier in Walton v. Arizona, 497 U.S. 639 (1990). The Ring case raises a serious constitutional issue because the high Court reaffirmed its decision upholding Arizona's death penalty procedure twice during those twelve years. The issue is this: what recourse does the state of Arizona have against …

Killing The Fatted Calf: Managed Care Liability In A Post-Pegram World, Karene M. Boos, Eric J. Boos

Northern Illinois University Law Review

Over one hundred million Americans receive their health care benefits under some kind of managed care plan. At the heart of every managed care plan is an emphasis on cost containment. The courts traditionally protected the proprietary economic interests of managed care by holding that claims against managed care organizations and plan directors were preempted under the Employee Retirement Income Security Act (ERISA). This was done as a means of facilitating a better health care delivery system for Americans and in spite of the number of patients who suffered poor health consequences as a result of decisions by managed care …

A Study Of The Factors Related To The Successful Merger Of Information Technology Departments Within Local Government, Angela Patton

Student Work

This study focuses on the merger process of Information Technology (IT) departments within local government. The research that exists indicates that local government mergers, in general, have a high rate of failure. In addition, the political, managerial, cultural, and behavioral aspects that impact these mergers are ignored.

The importance of computers to the departments/agencies housed within local government has made the IT departments a critical part of the local government structure. This study looks at the problems faced by the merging IT departments within local government in order to gain a better understanding of this process and to increase the …

What Are We Learning From Experience With Markets For Environmental Services In Costa Rica? A Review And Critique Of The Literature, November 2003, Manrique Rojas, Bruce Aylward Nov 2003

What Are We Learning From Experience With Markets For Environmental Services In Costa Rica? A Review And Critique Of The Literature, November 2003, Manrique Rojas, Bruce Aylward

Monteverde Institute: Economy and Resource Management

The use of markets and payments for environmental services is a topic gaining increasing attention amongst policy-makers and environment and development practitioners around the globe. Simply put, the term ‘environmental services’ can be taken to refer to the overall concept of natural systems providing a continuous flow of valuable goods and services to society. This is in contrast to similar services provided by man-made physical infrastructure and technological capital (i.e. water treatment, artificial fertilization, genetic modification) for which these environmental services are a substitute. The use of market mechanisms as a means of incorporating the economic value of these environmental …
