Mandatory Fingerprinting Of Public School Teachers: Fascilitating Background Checks Or Infringing On Individuals' Constitutional Rights?, Christina Buschmann

William & Mary Bill of Rights Journal

With the continuing growth of governmental intrusions into the private lives of its citizens, critics increasingly have taken aim at state actions which unnecessarily burden an individual's right to be let alone. One group in particular - public school teachers - often endure tedious examinations of their private affairs as a condition of employment. This Note examines the current state of privacy concerns, specifically in the realm of public school teachers, and argues that a compromise must be struck that better balances the public's need to protect children from dangerous teachers with the individual teacher's right to privacy. The Note …

Snake-Oil Security Claims The Systematic Misrepresentation Of Product Security In The E-Commerce Arena, John R. Michener, Steven D. Mohan, James B. Astrachan, David R. Hale

Michigan Telecommunications & Technology Law Review

The modern commercial systems and software industry in the United States have grown up in a snake-oil salesman's paradise. The largest sector of this industry by far is composed of standard commercial systems that are marketed to provide specified functionality (e.g. Internet web server, firewall, router, etc.) Such products are generally provided with a blanket disclaimer stating that the purchaser must evaluate the suitability of the product for use, and that the user assumes all liability for product behavior. In general, users cannot evaluate and cannot be expected to evaluate the security claims of a product. The ability to analyze …

Section 309(C) Of The Clean Water Act: Using The Model Penal Code To Clarify Mental State In Water Pollution Crimes, Andrew C. Hanson

Pace Environmental Law Review

Courts and commentators have struggled with interpreting the mental state requirement in modern regulatory criminal statutes, and the public welfare offense doctrine has been the focus of that confusion. The Supreme Court has relatively recently defined public welfare offenses as those, which a reasonable person would know are subject to strict public regulation, could threaten public health and safety, and relate to activities that are both "dangerous" and "uncommon." Despite a relatively clear definition, practitioners and judges are left to determine which mental state word applies to each element of the regulatory offense and whether the offense falls within the …

The Allocation Of Civil Liability For Damage To The Marine Environment In The New Canadian Law Of Merchant Shipping, Or The Polluter Pays How Much?, Hugh M. Kindred Apr 2003

The Allocation Of Civil Liability For Damage To The Marine Environment In The New Canadian Law Of Merchant Shipping, Or The Polluter Pays How Much?, Hugh M. Kindred

Dalhousie Law Journal

Infrequent but catastrophic incidents of pollution by ships have attracted worldwide attention to the regulation of the merchant shipping industry for the protection of the marine environment. Under the detailed legal regime that has been established, ships and their owners are held strictly liable for the pollution of the oceans that they cause. Less well known but equally well established are other principles of maritime law that allow shipowners to limit their liability for the expense and damage their polluting ships incur. Canada has recently undertaken a major reform of its shipping laws and, in the process, it has revamped …

A Safety Analysis Of Roundabouts In The Las Vegas Valley Clark County, Nevada, Michael J. Janssen

UNLV Theses, Dissertations, Professional Papers, and Capstones

This professional paper reviews current research on the safety of modern roundabouts and studies the recent, widespread use of them in the Las Vegas valley of Southern Nevada. A roundabout is a form of intersection control (as opposed to a traffic signal or stop sign) that is common in Europe and Australia. Only recently have they been used significantly in the United States. A safety analysis of roundabouts in the Las Vegas Valley was conducted. The study reviewed accident data and hard copy accident reports, obtained average daily traffic counts, and compared these operational aspects of the roundabouts with intersections …

A Study Of Community College Funding, Patricia Charlton

UNLV Theses, Dissertations, Professional Papers, and Capstones

Community Colleges are an important segment of the postsecondary education system in the United States. As a direct result of growing financial constraints, couples with increased demands for access, sources of institutional funding has gained increased importance This research seeks to understand the relationships between governance structure and funding. A 50-state study using secondary data was used to examine variations in funding support for community colleges across the fifty states. The research found a significant relationship between funding levels of operating dollars per full-time equivalent and the existence of a local governing board. This analysis illustrated that having a local …
