Criminal Law—Scarlet Letters: Traffic Stops Based On “Special” License Plates Must Follow The Letter Of The Constitution—State V. Henning, Piper Kenney Webb, Bruce H. Hanley

The Minnesota Supreme Court recently addressed whether a Minnesota statute authorizing law enforcement to stop motorists based solely on the presence of special license plates issued primarily to repeat drunken drivers is proper under the United States and Minnesota Constitutions. In State v. Henning, the court held the statute unconstitutional by a 4-3 decision. Finding no persuasive reason to do otherwise, the court struck down the legislature's attempt to eliminate the requirement that law enforcement have “reasonable articulable suspicion” to conduct an investigatory stop of a motor vehicle. Involuntary Treatment Of The Mentally Ill: Autonomy Is Asking The Wrong Question, Dora W. Klein

When determining if involuntary treatment is appropriate, the proper question for courts to ask is not whether autonomy is preferable to involuntary treatment, but whether no treatment at all is preferable to involuntary treatment. When legislatures develop and courts apply statutes governing civil commitment, the interests at stake should be considered not at the abstract level of "freedom" or "autonomy," but rather at the concrete level of the consequences that are likely to result from providing or not providing involuntary treatment. Only by examining the particular interests that are likely to be affected can informed decisions be made about when …

The Duty To “Expect The Unexpected”: Mitigating Extreme Natural Threats To The Global Commons Such As Asteroid Impacts With The Earth, Evan R. Seamone

This Article develops a framework to govern the interactions of nations cooperating to mitigate the threat of unexpected natural disasters that potentially could affect them all. It uses asteroid impact with the Earth as the representative example because this is an "unusual and extreme" disaster that has created difficulty for lawmakers due to its many unanswerable questions. By explaining a number of the legal requirements necessary to mitigate such threats, this Article identifies legal principles that apply equally to natural threats throughout the global commons. This conference is built on two very interesting premises; first, that university outreach can change society and second, that outreach can also change the university. What is the mechanism by which this mutual influence can occur? What does the university offer the community, and what does the community offer the university? Police across the nation have long been accused of using the broad discretion afforded to them in traffic enforcement as a pretext for criminal investigation. Despite this widely held belief, there is little evidence to suggest that courts have put forth any effort, or have even considered remedying or reducing the wide spread abuse of police discretion in traffic stops, with the exception of racial profiling. Comparison Of Education Level, Intelligence Quotient, And Higher Education Courses Of Individuals Who Commit Violent Crimes And Those Individuals Who Commit Nonviolent Crimes In Arkansas, W. Andranette Anderson-Blackwell

The purpose of this study was to examine and compare education levels, intelligence quotients, and college courses taken or are being taken by criminal offenders who commit violent versus nonviolent crimes. One hundred males and 100 females from the states' correctional facilities were used as the sample. The sample was stratified according to four characteristics: type of crime committed (violent or nonviolent), ethnicity, age, and gender. The null hypothesis tested in this study was that there is no statistically significant difference, at the 0.05 level, in the educational levels or intelligence quotients of criminal offenders as to age, ethnicity, gender, …
