Other Side Of Fifty: The Crones Among Us, Bonnie Marie Benson Jan 2003

Other Side Of Fifty: The Crones Among Us, Bonnie Marie Benson

Electronic Theses and Dissertations 2000 - 2009

The playwright can be both a public intellectual and an agent for social change. In this creative dissertation, consisting of a series of essays and a full-length play, I demonstrate an alternative view of aging women to combat the pejorative images now current. Drawing on dramatic portrayals from the past 100 years and current information on aging in the United States, I explore the dominant viewpoint on aging women. Combining the structures of spiritual quest and rite of passage with an appreciation for the ritual that celebrates such events, I have written a play, The Crones Among Us, from a …

Age Differences In Binding Actors And Their Actions In Memory: Implications For Eyewitness Memory, Eileen Curtayne Jan 2003

Age Differences In Binding Actors And Their Actions In Memory: Implications For Eyewitness Memory, Eileen Curtayne

Electronic Theses and Dissertations 2000 - 2009

Everyday individuals experience problems in accurately remembering who did what in an event. In order to have an accurate memory for an event of this type, an individual needs to remember the person who performed the action, the action itself, and the pairing of these two pieces of information. If these pieces of information are not bound together correctly, the end result is an inaccurate memory for an event. This study examined the ability of young and older adults to bind people and their actions together in memory. Though both age groups were more likely to falsely recognize novel combinations …

Building A Template Of Electoral Strategies For Women Who Aspire To The Superintendency In Appointed School Districts Within The Southern United States, Marianne Russo Swain

Electronic Theses and Dissertations 2000 - 2009

Based on an observation that women have been more successful in ascending to the level of school superintendent within southern school districts that use electoral procedures, this study examined unique electoral strategies women superintendents use that maybe transferable to women who aspire to the superintendency within districts in which appointment is the only means of ascension. The researcher interviewed five superintendents in districts within the southern United States. The data were analyzed using three conceptual frameworks: (a) Murphy's governance theory, (b) Ferguson's bureaucratic theory, and (c) Lather's emancipatory theory. The data were also evaluated in terms of elected and appointed …

Concept Of Time In "2001: A Space Odyssey", Rishi S. Ramnath Jan 2003

Concept Of Time In "2001: A Space Odyssey", Rishi S. Ramnath

Electronic Theses and Dissertations 2000 - 2009

The concept of time in Stanley Kubrick's 1968 film 2001: A Space Odyssey is examined from social, biological, psychological, and spiritual perspectives. In Arthur C. Clarke's novel, his version of the film, he treats the nature of time as a cyclical process. He eventually explains that the notion of physical time is non-existent or an impermanent illusion. While Clarke's novel interprets time, the film projects and manipulates the nature of space and time, which spectators may experience as reality. Time's direction can be viewed or experienced as a cycle from an Eastern philosophical perspective. However, a Western interpretation requires a …

Dynamics Of Self-System Coherence: Relations Of Entropy And Global Properties, Katharine K. Mcmillan Jan 2003

Dynamics Of Self-System Coherence: Relations Of Entropy And Global Properties, Katharine K. Mcmillan

Electronic Theses and Dissertations 2000 - 2009

Dynamical systems research has found evidence that global properties of self-system, i.e., self-esteem (SE), self-stability (SS), and self-certainty (SC), emerge from coherence of self-relevant information. Self-certainty may play a role in self-esteem and self-stability. Traits were deconstructed into levels from extremely to not at all. Ss indicated frequencies of trait levels, completed Rosenberg SE, SS; and self-evaluations of traits, roles, certainty, and importance. Entropy H identifies meaningful distributions of deconstructed traits. H may be useful alternative to variance from the mean in identifying individuals for whom a trait is meaningful despite the high variability of endorsements. Low H indicated order. …

This study investigated the effect of the disability labels learning disabilities (LD) and emotional handicaps (EH) on general education and special education teachers' willingness to refer students to gifted programs. Referral differences between general education and special education teachers were also examined. Two hundred forty-seven teachers (195 general education teachers and 52 special education teachers) from one south Florida school district participated in this study. Participants were randomly assigned to one of three conditions (no label, LD, EH) and asked to read a vignette describing a gifted student. All vignettes were identical except for one statement added to the LD …

Trust, Guilt, And Securities Regulation, Peter H. Huang Jan 2003

Trust, Guilt, And Securities Regulation, Peter H. Huang

Publications

This Article analyzes the importance of trust in securities investing and how guilt about breaching such trust has implications for securities regulation. Both U.S. federal securities laws and the regulations of the National Association of Securities Dealers impose high standards of professional conduct upon securities professionals. But exactly what are and should be the legal responsibilities of securities professionals remain the subject of much debate. In particular, courts disagree over when broker-dealers are fiduciaries of their clients. A legal consequence of a fiduciary relationship is a duty of fair dealing. This Article is the first to analyze the emotional, moral, …

Victim Wrongs: The Case For A General Criminal Defense Based On Wrongful Victim Behavior In An Era Of Victims' Rights, Aya Gruber Jan 2003

Victim Wrongs: The Case For A General Criminal Defense Based On Wrongful Victim Behavior In An Era Of Victims' Rights, Aya Gruber

Publications

Criminal law scholarship is rife with analysis of the victims' rights movement. Many articles identify with the outrage of victims harmed by deviant criminal elements. Other scholarly pieces criticize the movement's denuding of defendants' constitutional trial rights. The point upon which proponents and opponents of the movement tend to agree, however, is that the victim should never be blamed for the crime. The helpless, harmed, innocent victim is someone with whom we can all identify and someone to whom we can all express sympathy. Victim blaming, by all accounts, is an act of legal heresy to feminists, victim advocates, and …

Transactional Mediation: Using Mediators In Deals, Scott Peppet

Publications

This article addresses whether third-party mediators could be helpful in deal-making, just as they are in resolving disputes. It makes a theoretical case for such use of mediators and presents preliminary evidence that transactional mediation already is taking place.

Homicide On Holiday: Prosecutorial Discretion, Popular Culture, And The Boundaries Of The Criminal Law, Carolyn B. Ramsey Jan 2003

Homicide On Holiday: Prosecutorial Discretion, Popular Culture, And The Boundaries Of The Criminal Law, Carolyn B. Ramsey

Publications

This article discusses prosecutors' discretion to press criminal charges against individuals who cause death during recreational activities. Based on newspaper sources, published opinions, and unpublished materials from cases that resulted in plea bargains, Homicide on Holiday continues the author's exploration of the relationship between the American public, criminal prosecutors, and the nature of the prosecutors' public role. It shows that, despite popular culture's glorification of risk and a nationwide trend in tort law toward sheltering sports co-participants from civil negligence liability, an exhilarating trip down a ski slope is increasingly likely to land a skier in jail if he collides …

Symposium: Client Counseling And Moral Responsibility, Thomas L. Shaffer, Deborah L. Rhode, Paul R. Tremblay, Robert F. Cochran

Journal Articles

One of the most important challenges to lawyers and clients is addressing issues that are not controlled by law. Will the client take steps (legal steps) that will harm other people? Will the officers of a corporation consider the effects of its actions on workers, on consumers, on the community, on the environment? In a divorce, will the client take actions that will harm a child or spouse? What role should the lawyer play regarding these questions? The way lawyers address such issues may do more to determine whether their practice is socially useful or socially harmful than any rule …

Promoting Children's Interest Through A Responsible Research Agenda, Margaret F. Brinig Jan 2003

Promoting Children's Interest Through A Responsible Research Agenda, Margaret F. Brinig

Journal Articles

I deeply wish to see more good empirical work in family law. If our system had all of the money in the world, I would wish to spend it to guarantee happy, healthy children. But since resources are scarce, and children's issues must compete with other interests that range from national security to care for the elderly, I would suggest spending a relatively modest amount to determine what programs would likely prove successful.

Usually public policy follows from the wishes of adults. In family law, this occurs although virtually all the legislation dealing with families and children begins with a …

Evangelical Critical Discourse And The Modern World: The Sources And Implications Of The Work Of Craig Gay, Stephen L. Anderson Jan 2003

Evangelical Critical Discourse And The Modern World: The Sources And Implications Of The Work Of Craig Gay, Stephen L. Anderson

Theses and Dissertations (Comprehensive)

Amid the voices that energize debate in the postmodern public square, voices from conservative Protestantism have traditionally been quite muted and indistinct—missing from much public debate. But in the past few years there has been a burgeoning of Evangelical writing on the subject of interaction between the conditions of postmodernity and religious life. This renaissance has been largely unstudied, though its repercussions have been substantial. Most importantly, this resurgence has produced a ground-level rethinking of issues pertaining to the continuance of effective religious life, and indeed, of authentic personhood within the context of late modernity. One Christian social critic who …

Dysthymia And Major Depression : Distinct Conditions Or Different Stages Along A One-Dimensional Continuum?, Patrick Pössel Jan 2003

Dysthymia And Major Depression : Distinct Conditions Or Different Stages Along A One-Dimensional Continuum?, Patrick Pössel

Faculty and Staff Scholarship

Until recently researchers have discussed whether dysthymia and major depression represent distinct conditions or rather different stages along a one-dimensional continuum. This study addresses this question by examining the belief systems of normal, dysthymic, and depressed participants. We explored participants‘ beliefs and differentiated between positive and negative as well as between core and peripheral beliefs. Normal participants showed fewer negative beliefs and negative peripheral beliefs than the dysthymic group, whereas normal participants had more positive beliefs and positive core beliefs as well as fewer negative core beliefs than the depressed group. The hypothesized one-dimensional continuum could not be demonstrated for …

Pope John Paul Ii And The Dignity Of The Human Being, John J. Coughlin Jan 2003

Pope John Paul Ii And The Dignity Of The Human Being, John J. Coughlin

Journal Articles

Since his election in 1978 as the Successor to the Apostle Peter, His Holiness Pope John Paul II has remained one of the principal protagonists on the global stage for the dignity and value of every human being. Although the popular press and media sometimes have been slow to recognize this message, an online search of the Holy Father's copious encyclicals, addresses, and homilies reveals that he has advocated human dignity literally hundreds of times during the course of his twenty-five year pontificate. In fact, long before his election as Pope, Karol Wojtyla was developing his understanding of the dignity …
