Advocacy And Compassion In The Jewish Tradition, Daniel B. Sinclair
Advocacy And Compassion In The Jewish Tradition, Daniel B. Sinclair
Fordham Urban Law Journal
This essay surveys the Talmudic sources dealing with the issue of advocacy in Jewish law, and highlights the element of compassion that underlies the permissive approach to advocacy in the Talmudic sources. It outlines post-Talmudic developments with a special emphasis on the way in which the medieval authorities synthesized the views of the two Talmuds on the question of advocacy, and how later halakhists pushed this synthesis to its limits in order to pave the way for the emergence of the rabbinical pleader of modern times. This essay concludes with a brief remark on the link between compassion and advocacy …
Emotional Harm In Housing Discrimination Cases: A New Look At A Lingering Problem, Victor M. Goode, Conrad A. Johnson
Emotional Harm In Housing Discrimination Cases: A New Look At A Lingering Problem, Victor M. Goode, Conrad A. Johnson
Fordham Urban Law Journal
This Article explores relevant social science data and examines how it affects the analysis and understanding of evidence of emotional harm. Part I provides an overview of the current state of emotional harm cases. Part II discusses the issue of bias in the process of reviewing discrimination cases from the perspective of critical race theory and recent social science data. In Part III, this Article examines the cycles of ignorance that have contributed to an under-valuation of emotional harm in housing discrimination litigation. Finally, suggestions are made about how to gather relevant psychological and medical information on the effects of …

Just The (Unweildy, Hard To Gether, But Nonetheless Essential) Facts, Ma'am: What We Know And Don't Know About Problem-Solving Courts, Greg Berman, Anne Gulick
Fordham Urban Law Journal
This article asses what is known and what remains to be understood about problem-solving courts. Specifically, the article asserts that drug courts serve a needy population, court mandated treatment programs have higher retention rates, those who participate longer have better outcomes, those in drug courts had lower rates of recidivism, drug use, and that graduated sanctions have statistically significant impact on offenders behavior, sanctions are crucial to the model's effectiveness, post-program studies are sparse, drug courts are less costly than traditional adjudication, but cost savings for jail and prison beds are less clear. The article also addresses questions that remain …
Abusing State Power Or Controlling Risk?: Sex Offender Commitment And Sicherungverwahrung, Nora V. Demleitner
Abusing State Power Or Controlling Risk?: Sex Offender Commitment And Sicherungverwahrung, Nora V. Demleitner
Fordham Urban Law Journal
This article addresses civil commitment of sexually predatory offenders. It first outlines the most common American approaches to controlling sexual offenders, then details the German concept of Sicherungsverwahrung and greater state control, and finally proposes adopting a modified German approach that assures proportionality and public safety without sacrificing individual liberties. The article concludes by arguing that criminal penalties and safety-based detention should both be seen as elements of social control, which requires that safety measures with clearly punitive components be recognized as part of the punishment process.
Identity Crisis: The Obsolescence Of Jasopersaud V. Rho And The Medical Malpractice Expert Exception, Mark D. Shifton
Identity Crisis: The Obsolescence Of Jasopersaud V. Rho And The Medical Malpractice Expert Exception, Mark D. Shifton
Fordham Urban Law Journal
This Comment discusses the provision of the New York Civil Practice Law and Rules ("CPLR") governing the disclosure of medical malpractice expert witnesses, and how medical malpractice litigants strive to protect the identities of their experts. The Comment discusses the initial judicial decisions dealing with the amended CPLR 3101, and how courts initially struggled to apply the medical malpractice expert exception. Special attention is paid to Jasopersaud v. Rho, which attempted to create a workable standard to further the competing goals of CPLR 3101(d)(1)(i) and Thomas v. Alleyne. The Comment further discusses whether the policy goals behind the medical malpractice …

Transformative Criminal Defense Practice: Truth, Love, And Individual Rights- The Innovative Approach Of The Georgia Justice Project, Douglas Ammar, Tosha Downey
Fordham Urban Law Journal
Georgia Justice Project has a unique approach to criminal defense and rehabilitation which is based on a relationship and community-oriented ethic. Focused on only accepting clients who are willing to make a serious commitment to changing their lives, the GJP ensures that the client moves beyond social, emotional and personal challenges that contributed to their legal problems. This article describes the unique factors of the GJP that have contributed to its continued success.
"Forgive Me Victim For I Have Sinned": Why Repentance And The Criminal Justice System Do Not Mix - A Lesson From Jewish Law, Cheryl G. Bader
"Forgive Me Victim For I Have Sinned": Why Repentance And The Criminal Justice System Do Not Mix - A Lesson From Jewish Law, Cheryl G. Bader
Fordham Urban Law Journal
This essay will critique the Georgia Justice Project's encouragement of confessions in the context of the secular American justice system via comparison with the treatment of confessions under ancient Jewish law. Specifically, this essay posits that the absolute prohibition on the use of confessions in a legal system firmly rooted in religious values recognizes the danger inherent in combining the act of speaking of one's sins for religious penance with the use of such confessions in the criminal adjudication process. The Jewish legal system avoids these inherent dangers by completely devaluing the accused's confession. The GJP, in contrast, merges the …
Clarifying The Federal Fair Housing Act’S Exemption For Reasonable Occupancy Restrictions, Tim Iglesias
Clarifying The Federal Fair Housing Act’S Exemption For Reasonable Occupancy Restrictions, Tim Iglesias
Fordham Urban Law Journal
The 1988 Fair Housing Act Amendments (FHAA) for “reasonable” governmental occupancy standards contains a deceptively simple “exemption” that has been the subject of interpretation by numerous courts. This article argues that this “exemption” has been misinterpreted by these courts, particularly by the Sixth Circuit in Affordable Housing Advocates v. City of Richmond Heights. The article describes how this misinterpretation undercuts the protection from housing discrimination that the FHAA provides for families, especially families of color. The article details the FHAA’s familial status provision and “reasonable” standard exemption, and goes on to “analyze relevant case law and the legislative history to …
Squeezing Daubert Out Of The Picture, Richard D. Friedman
Squeezing Daubert Out Of The Picture, Richard D. Friedman

In this essay, I will offer some thoughts on how we might reframe the issues governing the admissibility of expert evidence. My principal focus is not on any particular type of expert evidence but on broader questions: the extent to which we ought to rely on rulings of admissibility, the standards that should govern admissibility rulings, and the role of the trial and appellate courts in making those rulings. To some extent, I will concentrate on the context of criminal cases, but for the most part my conclusions apply in both civil and criminal litigation. Here are my conclusions: First, …
Minimizing The Jury Over-Valuation Concern (Visions Of Rationality In Evidence Law Symposium), Richard D. Friedman
Minimizing The Jury Over-Valuation Concern (Visions Of Rationality In Evidence Law Symposium), Richard D. Friedman
Articles
A great deal of the rhetoric of evidence discourse concerns the supposed cognitive inadequacies of the jury. In various contexts we are told that although an item of evidence is probative, it must be excluded because the jury will give it too much weight. I believe this approach has played far too great a role in evidentiary law, and that it is an interesting project to see whether we can construct a satisfactory body of law without relying at all on the cognitive inadequacy argument. I think that, at least to a large extent, we can. In some settings, where …

An Effective Drug Policy To Protect America's Youth And Communities, Asa Hutchinson
An Effective Drug Policy To Protect America's Youth And Communities, Asa Hutchinson
Fordham Urban Law Journal
Drug abuse and addiction, and the government's response to these problems, are frequently and appropriately a topic for public debate. Law enforcement has made significant advances in both reducing the number of people using illegal drugs and in the fight against traffickers. Legalization of illegal drugs would not elinate the black market or eliminate drug-related violence. The facts on the issue make a strong case for a national policy geared toward effective drug abuse education and prevention, and treatment for people dependent on illegal drugs. Our nation should also continue to conduct research to determine the most effective means of …
The Failure Of Local And Federal Prosecutors To Curb Police Brutality, Asit S. Panwala
The Failure Of Local And Federal Prosecutors To Curb Police Brutality, Asit S. Panwala
Fordham Urban Law Journal
Although police departments across the country have attempted to ameliorate the hostility between police officers and the cumminity, through careful screening of applicants, minority recruitment, and community policing, police brutality remains a problem within our urban cities. This Essay will first argue that police brutality is largely ignored. Second, it will examine the obstacles facing local and federal prosecutors in obtaining convictions. Then it will compare the advantages and disadvantages of delegating primary responsibility for these cases to the state versus the federal level. Finally, it will argue that, although there are obstacles and advantages for both local and federal …
Using Low-Threshold Applications And Software Templates To Improve Efficiency In An Introductory Statistics Course, Jason K. Mcdonald
Using Low-Threshold Applications And Software Templates To Improve Efficiency In An Introductory Statistics Course, Jason K. Mcdonald
Faculty Publications
This study was an exploratory study in improving efficiency in university courses by using low-cost methods of design and development that can be easily managed by university faculty. To explore this issue, we developed a lesson for the Statistics department at Brigham Young University using low-threshold applications (uses of technology that are low-cost and easy to learn) and software templates. We evaluated the lesson as a possible method to decrease the number of hours instructors were required to spend teaching in class. We discovered that students responded positively to the lesson, and that the methods of lesson design and development …

Semantic Role Parsing: Adding Semantic Structure To Unstructured Text, Sameer Pradhan, K. Hacioglu, W. Ward, James H. Martin, D. Jurafsky
Psychological Science Faculty Research & Creative Works
There is an ever-growing need to add structure in the form of semantic markup to the huge amounts of unstructured text data now available. We present the technique of shallow semantic parsing, the process of assigning a simple WHO did WHAT to WHOM, etc., structure to sentences in text, as a useful tool in achieving this goal. We formulate the semantic parsing problem as a classification problem using support vector machines. Using a hand-labeled training set and a set of features drawn from earlier work together with some feature enhancements, we demonstrate a system that performs better than all other …

Chronic use of tobacco-containing products, particularly cigarettes, remains one of the most avoidable causes of death and illness in the United States and claims the lives of more than 430,000 individuals each year (U.S. Department of Health and Human Services [DHHS], 1999). The number of tobacco-related deaths alone exceeds that of deaths due to AIDS, murders, other drugs, alcohol, car crashes, fires, and suicides combined (Centers for Disease Control and Prevention [CDC], 2002). Illnesses associated with tobacco use include, but are not limited to, laryngeal cancer, oral cancer, esophageal cancer, obstructive pulmonary disease, cardiovascular disease, intrauterine growth retardation, and low …

Web-Based Research: Methodological Variables' Effects On Dropout And Sample Characteristicsweb-Based Research: Methodological Variables' Effects On Dropout And Sample Characteristics, Kevin M. O'Neil, Steven D. Penrod, Brian H. Bornstein
Department of Psychology: Faculty Publications
Previous research has made a beginning in addressing the importance of methodological differences in Web-based research. The present paper presents four studies investigating whether sample type, financial incentives, time when personal information is requested, table design, and method of obtaining informed consent influence dropout and sample characteristics (both demographics and measured attitudes). Undergraduates were less likely to drop out than nonstudents, and nonstudents offered a financial incentive were less likely to drop out than those offered no incentive. Complex tables, tables that were too wide, requests for personal information on the first page, and the imposing of additional informed consent …
Family Factors That Differentiate Sexually Abused And Nonabused Adolescent Psychiatric Inpatients, Dawn H.S. Reinemann, Kevin D. Stark, Susan M. Swearer Napolitano
Family Factors That Differentiate Sexually Abused And Nonabused Adolescent Psychiatric Inpatients, Dawn H.S. Reinemann, Kevin D. Stark, Susan M. Swearer Napolitano
Department of Psychology: Faculty Publications
Sexual abuse research has traditionally focused on adult, retrospective accounts of potential correlates of abuse and their impact on functioning. However, only a few studies have examined sexually abused adolescents’ perceptions of their families, and results have proven inconclusive. This study examined whether family factors would differentiate sexually abused and nonabused adolescent psychiatric inpatients. Fifty-seven psychiatric inpatients, ages 11 to 17, who either had experienced sexual abuse or had no history of sexual victimization completed a diagnostic interview and were assessed on a variety of family indices. Results indicated that after controlling for level of depression, sexually abused adolescents could …

Standards For Science Teacher Preparation, National Science Teachers Association
Standards For Science Teacher Preparation, National Science Teachers Association
Department of Teaching, Learning, and Teacher Education: Faculty Publications
Any project intending to write education standards for national dissemination and implementation is immediately confronted with the fact that education is a state function, and that the fifty states, plus Puerto Rico, each have their own ideas about what should be taught to their children. Education, unlike many professions, is a highly political act: parents and guardians are concerned about what their children are taught; and various stakeholders have their own ideas about what constitutes a good education. Whether or not they are directly engaged in setting standards, they want to know why a particular set of standards has been …

The Functions Of Justice And Anti-Justice In The Peace-Building Process, Paul Williams, Michael Scharff
The Functions Of Justice And Anti-Justice In The Peace-Building Process, Paul Williams, Michael Scharff
Scholarly Articles in Law Reviews & Journals
Recently, there has been increasing use of the tool of justice/accountability in the peace-building process. Yet, the norms of justice, while increasingly invoked, is seldom defined in the context of peace-building. To understand the role that justice has played and has the potential of playing in the peace-building process, it is important first to define the norm as well as articulate its functions. This article therefore serves as an introduction to The Case Western Reserve Journal of International Law’s “Role of Justice in Building Peace” Symposium Issue by providing a detailed definitional description of the justice norm. In addition, it …
