Marriage And Domestic Violence In The United States: New Perspectives About Legal Strategies To Combat Domestic Violence, Lynn D. Wardle Jan 2003

Marriage And Domestic Violence In The United States: New Perspectives About Legal Strategies To Combat Domestic Violence, Lynn D. Wardle

St. Thomas Law Review

Domestic violence is a serious problem in the United States. It has been the subject of significant legal responses, yet domestic violence remains a very substantial and widespread social dilemma in America. Most of the legal responses suffer from two significant flaws. First, they are based on a clearly erroneous assumption that marriage is the primary environment of risk. Second, they focus on protection and punishment rather than prevention. In fact, the relationship between marriage and domestic violence is much more complex than some conventional commentary has recognized. Explanations for why married women and their children are less often victims …

The Development Of Instruments For Assessment Of Instructional Practices In Standards-Based Teaching, C. L. Wainwright, L. Flick, P. Morrell

Journal of Mathematics and Science: Collaborative Explorations

We provide a description and rationale for the development of two instruments: 1) a classroom observation protocol; and, 2) a teacher interview protocol—designed to document the impact of reform-based professional development with undergraduate mathematics and science faculty, and its impact on the resultant preparation of teachers. Constructed upon review of the research on teaching and standards documents in mathematics and science, these instruments form the basis for data collection in a three-year longitudinal study of teaching practice among early career teachers as well as undergraduate college faculty. In addition, we suggest further applications of the observation protocol beyond the original …

The Use Of Traditional And Contemporary Instructional Strategies And Materials In The Elementary Mathematics Classroom, J. E. Riley Jan 2003

The Use Of Traditional And Contemporary Instructional Strategies And Materials In The Elementary Mathematics Classroom, J. E. Riley

Journal of Mathematics and Science: Collaborative Explorations

Elementary school teachers were surveyed about the strategies and materials they use to teach elementary school mathematics. A list of twenty strategies and materials derived from the Changes in Content and Emphasis sections of the National Council of Teachers of Mathematics (NCTM) Curriculum and Evaluation Standards for School Mathematics were examined [1]. These strategies represent both contemporary and traditional approaches to the teaching of mathematics. Teachers were asked to respond to each survey item by indicating how often these strategies were used in their classrooms. The findings were compared to the goals of the NCTM Standards to assess how much …

Using The Theory Of Planned Behaviour To Predict Leisure Educators’ Intentions To Use Instructional Technology, Jennifer Y. Mak, Craig M. Ross Jan 2003

Using The Theory Of Planned Behaviour To Predict Leisure Educators’ Intentions To Use Instructional Technology, Jennifer Y. Mak, Craig M. Ross

Management Faculty Research

The Theory of Planned Behaviour (TPB) (Ajzen, 1991b) was applied to the prediction and explanation of the intention to use instructional technology by using a mail questionnaire (n = 406) of leisure educators in the United States and Canada. Based on structural equation modeling, it was found that the key determinants of the TPB, attitude toward instructional technology, subjective norm toward instructional technology, and perceived behavioural control toward instructional technology accounted for 50% of the leisure educators’ intention to use instructional technology. The strongest predictor of intention was attitude toward instructional technology, followed by subjective norm toward instructional technology and …

This comment will argue that when the state seeks to deprive a person of his or her DNA, greater constitutional protections than are currently afforded dragnets must be provided. Part I will discuss the unique properties of DNA, the information contained therein and why it should be constitutionally protected. Part II will briefly trace the history of DNA dragnets, including the practical and procedural uses in worldwide criminal investigations. Part III will explore current law and commentary regarding Fourth Amendment privacy interests in one’s DNA. Part IV will argue that DNA constitutes personal property, and finally, Part V will show …

License To Harass Women: Requiring Hostile Environment Sexual Harassment To Be “Severe Or Pervasive” Discriminates Among “Terms And Conditions Of Employment, Judith J. Johnson Jan 2003

License To Harass Women: Requiring Hostile Environment Sexual Harassment To Be “Severe Or Pervasive” Discriminates Among “Terms And Conditions Of Employment, Judith J. Johnson

Journal Articles

Title VII was intended to remedy discrimination; thus, it is ironic that the courts themselves discriminate among "terms and conditions of employment" by treating hostile environment discrimination less favorably, most commonly in sexual harassment cases. As the Supreme Court said in its first sexual harassment case, hostile environment harassment must be "severe or pervasive" to be actionable. However, many lower courts have used this language to excuse harassment against women. This Article suggests that the problem originates in the Court's continued use of the phrase "severe or pervasive" to describe actionable conduct. This rather dramatic terminology in fact overstates the …

Introduction, Joel K. Goldstein

All Faculty Scholarship

The Richard J. Childress Memorial Lecture has become the highpoint of the academic year at Saint Louis University School of Law. The Lecture, which honors the memory of a long-time dean and member of our faculty,[1] has been delivered each fall beginning in 2000 by a distinguished scholar on an important legal subject. Dean Jeffrey Lewis’s vision of the program was not simply to produce a typical speech on an academic topic, but to commission a preeminent scholar to write a substantial article on a critical issue and to invite responses from other thoughtful scholars and activists. Our Law Journal …

Development And Validation Of Transtheorectical Measure For College Student Spiritual Expression, John A. Ward Jan 2003

Development And Validation Of Transtheorectical Measure For College Student Spiritual Expression, John A. Ward

Open Access Dissertations

The study of the use of religious techniques in counseling and religious/spiritual expression has gained increased attention in research literature over the last 15-20 years. Psychologists are becoming increasingly accepting of the role of religious techniques in counseling and the role of religious/spiritual expression in human development. However, most agree that the research base needs to be more inclusive and expanded. When religion is the focus of investigation in college student populations, most attention is focused on religious beliefs and practices, and changes in beliefs over the course of the college experience.

The transtheoretical model (TTM) is an integrative model …

Latent Transition Ananlysis As A Sensitive Outcome: Analysis For Longitudinal Data, Rosemarie A. Martin

Open Access Dissertations

Three secondary data analysis studies were conducted to provide methodological and theoretical examples of the application of Latent Transition Analysis (LTA) to three studies of smoking cessation among adults. Each study was designed to evaluate an interactive expert system intervention for smoking cessation in three different populations of smokers: (1) Chapter 2 evaluated the expert system intervention versus assessment only in smokers from the state of Rhode Island (N=4,144); (2) Chapter 3 evaluated the expert system intervention versus a non-interactive manual-based intervention in a managed care setting (N=2,882); (3) and Chapter 4 examined the expert system intervention versus assessment only …

Effects Of Solution Elicitation Aids And Need For Cognition On The Generation Of Solutions To Ill-Structured Problems, Adam B. Butler, Lisa L. Scherer, Roni Reiter-Palmon

Psychology Faculty Publications

Numerous techniques have been proposed to assist problem solvers in the solution generation process. We empirically examined the effectiveness of a solution elicitation technique based on the presentation of problem objectives and also examined whether the technique was effective across individual differences in need for cognition (NC). We found that when two conflicting objectives were presented successively, more solutions, more categories of solutions, and more effective solutions were generated than when the same two objectives were presented simultaneously or not at all. However, the results indicated that effective solutions may be more efficiently generated by considering objectives simultaneously. Need for …
