The Battered Women Syndrome In Florida: Junk Science Or Admissible, Jay B. Rosman
The Battered Women Syndrome In Florida: Junk Science Or Admissible, Jay B. Rosman
St. Thomas Law Review
In this paper I will examine the admissibility of the battered woman syndrome in Florida as scientific evidence. At the outset I recognize many differing audiences title the syndrome in different ways. My focus is not on the correctness of its title but upon its admissibility in courts in Florida. My overall perspective is based on standards set forth by the Frye' and Dauber? cases. In order to understand the syndrome, it will be necessary to first look at the concept of domestic violence. It will also be important to consider what the term battered woman syndrome means. After discussing …
Tracking The Circulatory Of Confession Jurisprudence After Massiah & (And) Miranda: Can A Superficial Application Of Property Law Make Sense Out Of Nonsense?, Rory Bahadur
St. Thomas Law Review
After Miranda v. Arizona and Massiah v. United States, there were arguably three doctrinally separate methodologies for determining the admissibility of confessions in criminal proceedings. The interaction of these three doctrines has generated a complex, contradictory, somewhat inexplicable, and chaotic jurisprudence. This paper re-examines the post- Miranda interaction of the three doctrines, and argues that basic property law provides a conceptual framework for reconciling what appears to be an otherwise arbitrary and unpalatable collection of Supreme Court decisions. Section one briefly examines the totality of the circumstances test and the Miranda and Massiah decisions themselves, not from the standpoint of …

Factor Structure Of The Coaching Behavior Questionnaire And Its Relationship To Athlete Variables, Jean M. Williams, Gerald J. Jerome, Laura J. Kenow, Tracie Rogers, Tessa A. Sartain, Greg Darland
Faculty Publications
Little research exists to identify optimal coaching behaviors and factors that influence the effectiveness of particular behaviors. The present study tested 484 athletes in order to determine sub-scales on the Coaching Behavior Questionnaire (CBQ). The CBQ measures athletes’ perceptions of coaching behaviors and evaluates their effectiveness in helping athletes play better and maintain optimal mental states and focus. A confirmatory factor analysis (CFA) supported the two-factor model (negative activation, supportiveness/emotional composure) derived from an exploratory factor analysis (EFA). Correlational analyses indicated that athletes with higher anxiety and lower self-confidence and compatibility with the coach were more likely to negatively evaluate …
Categories And Similarities: A Note On Circularity, L. David Ritchie
Categories And Similarities: A Note On Circularity, L. David Ritchie
Communication Faculty Publications and Presentations
Theories of metaphor comprehension that rely on category assignment based on common characteristics (Keysar & Glucksberg, 1992), a comparison between characteristics or relationships of source and target (Chiappe & Kennedy, 2001), or a mapping of characteristics or relationships from source to target (Gentner & Bowdle, 2001) are inherently circular, since these comparisons, mappings, or categories usually make sense only after the underlying metaphor has already been understood. This inherent circularity is avoided by approaches such as conceptual metaphor theory (Lakoff & Johnson, 1980) and conceptual blending theory (Fauconnier & Turner, 1998) that seek to explain metaphors in terms of underlying …

Cookies And The Commone Law: Are Internet Advertisers Trespassing On Our Computers?, Michael R. Siebecker
Cookies And The Commone Law: Are Internet Advertisers Trespassing On Our Computers?, Michael R. Siebecker
Sturm College of Law: Faculty Scholarship
Are Internet advertisers trespassing on our computers? The question arises due to the increasing reliance upon cookie technology by Internet advertising firms as the primary means to match online ads with the specific interests and characteristics of individual Internet users.
It seems that whenever we visit a Web site, we are barraged with an increasing number of blinking banner advertisements hocking products and services of every imaginable sort. More than sixty billion advertisements per month are carefully selected for us and sent to our computers by a single Internet advertising firm, DoubleClick, Inc. In order to increase the effectiveness of …

The Initial Controversy - Introduction, Robert Leeson
The Initial Controversy - Introduction, Robert Leeson
Business Book Chapters
During the middle third of the twentieth century, the ideas of John Maynard Keynes and those who described themselves as “Keynesians” acquired a profound influence over both the economics profession and the macroeconomic policy process. After the publication of Milton Friedman’s (1956) Studies in the Quantity Theory of Money, Keynesians were obliged to compete with “monetarists” for policy and intellectual influence. These two volumes examine aspects of this counter-revolution by focusing on Friedman’s claim that he was merely formalising the macroeconomic ideas of the first generation Chicago School, at whose “feet” he “sat” in 1932-3 and 1934-5 (Friedman chapter …

Engaging The Debate: Reform Vs. More Of The Same, Kevin B. Zeese
Engaging The Debate: Reform Vs. More Of The Same, Kevin B. Zeese
Fordham Urban Law Journal
This Essay dispels common myths put forward by drug war advocates and describes more effective alternatives available than present policy contemplates. We all want to prevent adolescent drug abuse, protect the health and safety of the community, deny drug profits to terrorists and other criminals, and develop a drug policy that works and is based on our common humanity, as well as on research and reality, rather than myth and rhetoric. The essential paradigm shift that needs to occur is to move away from a policy dominated by law enforcement . . . and toward a policy based on public …
You Have A Right To Remain Silent, Michael Avery
You Have A Right To Remain Silent, Michael Avery
Fordham Urban Law Journal
The Supreme Court will decide in the October 2002 term whether there is a cause of action under 42 U.S.C. Section 1983 based on a coercive police interrogation of a suspect in custody who has not been given Miranda warnings. The Supreme Court cannot decide that there is no cause of action under section 1983 for damages caused by coercive interrogation practices without turning its back on a large body of its own jurisprudence and on the deeply rooted cultural and political expectations of American citizens who trust that they have a meaningfu lconstitutionally protected right to remain silent when …

Arrested Adults Awaiting Arraignment: Mental Health, Substance Abuse, And Criminal Justice Characteristics And Needs, Nahama Broner, Stacy S. Lamon, Damon W. Mayrl, Martin G. Karopkin
Fordham Urban Law Journal
This Study is one of the first to look at the mentally ill during the pre-arraignment process. The pre-arraignment process is an excellent place to identify individuals with mental health and substance abuse problems, to examine those problems, to consider legal interventions, such as diversion or routing to specialized courts, for instance, drug and mental health courts, and to plan for community mental health, substance abuse, health, and social service interventions. Following a brief review of the literature on rates of substance abuse and mental health problems for ciminal justice populations, the process from arrest to arraignment in Kings County …
Therapeutic Jurisprudence And Problem Solving Courts, Bruce J. Winick
Therapeutic Jurisprudence And Problem Solving Courts, Bruce J. Winick
Fordham Urban Law Journal
This article offers a number of suggestions concerning how judges should act in problem solving court contexts to spark the motivation of the individual to achieve rehabilitation and increase compliance with treatment. The proposals are derived from psychological literature in other contexts but further analysis and empirical research is needed. The article finds that therapeutic jurisprudence can contribute to the functioning of problem solving courts which can refine therapeutic jurisprudence approaches.
