The Wildlands Project Outside North America, David Johns Jan 2003

The Wildlands Project Outside North America, David Johns

Political Science Faculty Publications and Presentations

The Wildlands Project seeks to create a connected system of protected areas across North America that will ensure the survival of all native species, including top predators and wideranging species, in the context of fully functioning ecosystems. Core protected areas are designated based on the biological needs of key species and the requirements of critical ecological processes. To work they must have, or will be restored to have, those attributes traditionally ascribed to wilderness. Some critics argue that The Wildlands Project model is inapplicable to other parts of the world, especially the developing world. The inapplicability is based on nonbiological …

Congress And The Courts Battle Over The First Amendment: Can The Law Really Protect Children From Pornography On The Internet?, 21 J. Marshall J. Computer & Info. L. 141 (2003), Mitchell P. Goldstein

UIC John Marshall Journal of Information Technology & Privacy Law

Litigation and court action have provided little in the way of providing solutions to anyone dealing with inappropriate content on the Internet. In Miller v. California, 413 U.S. 15 (1973). The court refused to establish a national standard and instead relied on community standards. Because the Internet has no geographic limitations, one cannot determine community standards because the Internet is so far reaching. Goldstein discusses in detail these Congressional enactments: Communications Decency Act of 1996, the Child Online Protection Act, and the Child Pornography Prevention Act of 1996, finding that none of them give children protection from pornography. The challenge …

A Further Darkside To Unsolicited Commercial E-Mail? An Assessment Of Potential Employer Liability For Spam E-Mail, 22 J. Marshall J. Computer & Info. L. 179 (2003), Ben Dahl

UIC John Marshall Journal of Information Technology & Privacy Law

This article looks at employer liability for pornographic spam in the workplace. It begins with an analysis of the risks and unique problems posed by employees’ Internet use while at work. The article makes note of some trouble areas where employers may be held vicariously liable for sexual harassment. It is suggested that employers protect themselves by taking steps to: 1) reduce the prevalence of unsolicited commercial e-mail in the workplace; 2) mute the potential harm of offensive e-mail; and 3) create a paper trail indicating diligence in the fight to protect employees. Employers may reach these goals by the …

Where's The Beef? Dissecting Spam's Purported Harms, 22 J. Marshall J. Computer & Info. L. 13 (2003), Eric Goldman

UIC John Marshall Journal of Information Technology & Privacy Law

This article seeks to identify areas that truly require legislative intervention by examining the harms purportedly caused by spam. Identifying exactly what constitutes spam is an imprecise task since one e-mail may be junk to one and an important e-mail to another. The article attempts to analyze why consumers feel strongly against spam. This reaction is compared to consumers’ comparatively tolerant reaction to other unwanted advertisement in different mediums, such as billboards or magazine advertisements. Several factors are considered, such as the waste of time associated with sorting spam, the loss of consumers’ control over their in-boxes, and the annoyance …

Nf579 Aging Sexuality, Kathy Bosch Jan 2003

Nf579 Aging Sexuality, Kathy Bosch

University of Nebraska-Lincoln Extension: Historical Materials

Contrary to popular belief, the elderly are sexual beings. Each person is created to be a sexual being with normal desires of wanting to be loved and touched. Our culture tends to believe that love and sex belong only to the younger generations but many older adults enjoy being loved, touched and having sexual relations.

A Simulation Application To Analyze The Utilization Of Computer Laboratories, Mehmet E. Bahadir

Graduate Research Papers

Efficiency is a widely used term in industry, education, economics and science to define the wisely use of input to achieve a certain level of output with minimum waste. In terms of material usage, efficiency is working with the optimum number of resources to provide the required service. Computer labs are one of the main facilities of modem universities. Efficient usage of computer labs in terms of utilization is one of the factors that affects the quality and performance of the education. The problem of this study is to investigate the efficiency of selected computer centers at a Midwestern university.

Mongrel Modernism: Hayashi Fumiko's Horoki And Mass Culture, William O. Gardner Jan 2003

Mongrel Modernism: Hayashi Fumiko's Horoki And Mass Culture, William O. Gardner

Japanese Faculty Works

This article examines Hayashi Fumiko's novel "Hōrōki" (Diary of a vagabond) as a personal and historical narrative of Japanese modernity. Arguing for an acknowledgment of "Hōrōki" as a modernist work, it analyzes how Hayashi positions her work with regard to the developing idea of mass culture. Through a consideration of the early mass cultural forms recorded in Hayashi's narrative, it shows how gender and regional identity contribute to the formation of a mass subject who retains the prospect of critical agency.

Malign Neglect Or Benign Respect: Women’S Health Care In A Carceral Setting, Angela M. Moe, Kathleen J. Ferraro Jan 2003

Malign Neglect Or Benign Respect: Women’S Health Care In A Carceral Setting, Angela M. Moe, Kathleen J. Ferraro

Sociology Faculty Publications

A central tenet of feminist criminological scholarship is the examination of women’s experiences with crime and incarceration through their own narratives. Through semi-structured interviews with thirty jailed women, this article examines carceral conditions through the critical lens of the female inmate. Highlighted in this article is the availability and quality of health care in a detention center in Arizona. The findings indicate a contentious duality, exposing both heinous neglect and benign solicitude in the care delivered to jailed women. This duality is situated within the dismal health care system available to indigent women in the region.

Supervision Styles In Probation And Parole: An Analysis Of Activities, Richard P. Seiter, Angela D. Crews

Criminal Justice Faculty Research

Supervision of offenders in the community remains a critical component of the correctional processes in the United States. With almost six million offenders under correctional supervision in the community, there has been relatively little attention and few resources devoted to the style and quality of supervision received by these offenders. As a result of the lack of research regarding the style of probation and parole supervision, there is a need to identify and quantify styles of casework and surveillance supervision. This article describes a research project that identifies the key functions of parole and probation officers, reports self- and peer-rating …

Chicken Little, Three Blind Men And An Elephant, And “Racial Profiling”: A Commentary On The Collection, Analysis, And Interpretation Of Traffic Stop Data, Angela D. Crews Jan 2003

Chicken Little, Three Blind Men And An Elephant, And “Racial Profiling”: A Commentary On The Collection, Analysis, And Interpretation Of Traffic Stop Data, Angela D. Crews

Criminal Justice Faculty Research

This paper discusses the collection, analysis, and interpretation of police traffic stop data. The focus primarily is on the theoretical, statistical, and practical determination of whether law enforcement is engaging in “racial profiling.” One of the most controversial components of research in this area relates to the “baseline” or comparison group. Researchers struggle with determining whether agencies are engaging in “racial profiling” when making traffic stops without some measure of what the world would look like in the absence of “racial profiling.” We know what is, but how can we know what should be? A model is proposed that …

The Effect Of Role Ambiguity On Competitive State Anxiety, Mark R. Beauchamp, Steven R. Bray, Mark A. Eys, Albert V. Carron Jan 2003

The Effect Of Role Ambiguity On Competitive State Anxiety, Mark R. Beauchamp, Steven R. Bray, Mark A. Eys, Albert V. Carron

Kinesiology and Physical Education Faculty Publications

The purpose of this study was to examine the relationship between role ambiguity and precompetition state anxiety (A-state). Consistent with multidimensional anxiety theory (Martens, Vealey, & Burton, 1990), it was hypothesized that role ambiguity would be positively related to cognitive but not to somatic A-state. Based on the conceptual model presented by Beauchamp, Bray, Eys, and Carron (2002), role ambiguity in sport was operationalized as a multidimensional construct (i.e., scope of responsibilities, role behaviors, role evaluation, and role consequences) potentially manifested in each of two contexts, offense and defense. Consistent with hypotheses, ambiguity in terms of the scope of offensive …

Role Ambiguity In Sport Teams, Mark A. Eys, Albert V. Carron, Mark R. Beauchamp, Steven R. Bray

Kinesiology and Physical Education Faculty Publications

The general purpose of the present study was to examine the nature of role ambiguity in sport teams and to explore the construct validity of the operational definition of role ambiguity developed by Beauchamp, Bray, Eys, and Carron (2002). Role ambiguity was operationalized as a multidimensional construct (Scope of Responsibilities, Behavioral Responsibilities, Evaluation of Performance, and Consequences of Not Fulfilling Responsibilities) that occurs in two contexts, offense and defense. Consistent with the a priori hypothesis, perceptions of role ambiguity exhibited some degree of within-group consistency and group-level variability, but most of the variance in role ambiguity was seen at the …
