This Article sets forth a brief summary of the Commission's work and examines, in more detail, certain, specific recommendations of the Commission, including those that have been implemented and those that have not. Culture And Contempt: The Limitations Of Expressive Criminal Law, Ted Sampsell-Jones

Seattle University Law Review

This Article will attempt to highlight certain important features of the expressive function of criminal law that have been neglected. Bringing these elements into higher relief will add to our understanding of how expressive criminal law works and, in particular, how it can fail to work as intended. This article will look closely at one example of the operation of expressive criminal law. The example comes from the area of criminal drug policy, and will examine how expressive drug laws have functioned in the street subculture of urban minority communities. Part II, describes street ideology and the social meanings of …

Images Of Engineering: An Investigation Of Gender And Attitudes Towards Engineering, Liz Hodgkinson Jan 2003

Images Of Engineering: An Investigation Of Gender And Attitudes Towards Engineering, Liz Hodgkinson

School of Law, Humanities and Social Sciences Theses

The research presented in this thesis used a mixed method approach to investigate the attitudes of sixth-form students in two British cities, towards engineering as a career, with the aim of finding out which factors encourage or discourage young people from becoming engineers, and whether these differ for males and females. The study can be set in the context of the declining popularity of engineering as a career choice for males and the continuing under-representation of females, for whom engineering is a non-traditional career choice. The principal research hypothesis was that negative images of engineering discourage girls and many boys …

Cosmetic Compliance And The Failure Of Negotiated Governance, Kimberly D. Krawiec Jan 2003

Cosmetic Compliance And The Failure Of Negotiated Governance, Kimberly D. Krawiec

Faculty Scholarship

Across a range of legal regimes - including environmental, tort, employment discrimination, corporate, securities, and health care law - United States law reduces or eliminates enterprise liability for those organizations that can demonstrate the existence of "effective" internal compliance structures. Presumably, this legal standard rests on an assumption that internal compliance structures reduce the incidence of prohibited conduct within organizations. This Article demonstrates, however, that little evidence exists to support that assumption. In fact, a growing body of evidence indicates that internal compliance structures do not deter prohibited conduct within firms and may largely serve a window-dressing function that provides …

Radiofrequency Wire & New Technique For The Treatment Of Coronary Chronic Total Occlusion, William Ng, Wai-Hong Chen, Pui-Yin Lee, Chu-Pak Lau Jan 2003

Radiofrequency Wire & New Technique For The Treatment Of Coronary Chronic Total Occlusion, William Ng, Wai-Hong Chen, Pui-Yin Lee, Chu-Pak Lau

Journal of the Hong Kong College of Cardiology

Treatment of coronary CTO remains a technical challenge in contemporary PCI. The major limitation of the procedure is the inability to pass a guidewire across the CTO. A new OCR guidewire system has demonstrated clinical potential for navigating through CTO; in addition, the system is now coupled with RF energy for facilitating guidewire crossing through highly resistant hard total occlusive lesions. This device might offer new horizon for PCI to CTOs which would not have been attempted before.

This literature review was undertaken on behalf of the Australian School Library Association (ASLA). It was conducted over a four-week period in November–December 2002. The main purpose of the review was to report on the nature and extent of the evidence that has linked school libraries to student achievement from 1990 - 2002, to identify the strengths and gaps in existing data as it might relate to an Australian setting, and to suggest some strategies for developing further research in Australia.

Multilateral Management As A Fair Solution To The Spratly Disputes, Wei Cui Jan 2003

Multilateral Management As A Fair Solution To The Spratly Disputes, Wei Cui

All Faculty Publications

The Spratlys are a scattered group of islands in the South China Sea over which China, the Philippines, Vietnam, Malaysia, and Brunei have made conflicting jurisdictional claims. Although there has been significant academic discussion of this dispute, the Author argues that much of it is hampered by a discourse obsessed with the regional balance of power and security-related strategies that are only tenuously related to each nation's specific legal claims in the Spratlys. In this Article, the Author suggests that a more productive approach to the Spratly disputes is one focused on finding a solution that is fair to all …

Managed Profiles: The Value Of Personal Information In Commercial Exchange, Patricia A. Norberg

Open Access Dissertations

The research objective of this dissertation is to empirically test factors that are believed to influence consumer personal information disclosure in marketing, using economic theory and social exchange theory as a foundation. Specifically, this research tests the effects of elicitation type (transactional, relational) and level of trust (low, high) on Actual Disclosure, using a 2 x 2 experimental design delivered via the computer. As well, this research examines the effects of fairness judgment, risk perceptions and benefit perceptions as moderating processes. These processes are examined using both pencil and paper questionnaire and cognitive response. Findings suggest that the effects of …

Writing Across Cultures: Contrastive Rhetoric And A Writing Center Study Of One Student's Journey, Christine M. Fox Jan 2003

Writing Across Cultures: Contrastive Rhetoric And A Writing Center Study Of One Student's Journey, Christine M. Fox

Open Access Dissertations

As student populations in colleges and universities continue to diversify, composition programs do not always meet students' varying needs. English as a Second Language (ESL) students appear to fail mainstream writing courses at higher rates than their traditional counterparts, yet mainstreaming continues to be mandated, often due to budgetary constraints. Many programs offer multicultural writing courses, but these, too, are often ineffective for many students. Meanwhile, as Paul Kei Matsuda shows, there is a decided split between the disciplines of composition and ESL. Since ESL scholars have a much stronger history of working with diverse student populations than composition scholars …

Factors Influencing The Adoption Of Electronic Business In The Purchasing Activities Within A Business Organization Using An Extended Technology Acceptance Model, Kenneth J. Sousa

Open Access Dissertations

The implementation of electronic business systems has gained significant attention within business organizations. These systems have transformed the approach in which industries market, promote and sell their products and services. The adoption of these systems can increase competitive advantage, achieve cost savings and create differentiation within a market. Therefore, in order to fully leverage investments in information technology, it will be important for business organizations to gain a clear understanding of the characteristics and behavior of customers who adopt electronic business technology. Several research studies have used developed technology acceptance models to determine the influences on the adoption of various …

The Rights Of The New Untouchables: A Constitutional Analysis Of Hiv Jurisprudence In India, Jayanth K. Krishnan Jan 2003

The Rights Of The New Untouchables: A Constitutional Analysis Of Hiv Jurisprudence In India, Jayanth K. Krishnan

Articles by Maurer Faculty

It is believed that India will soon have the highest number of HIV/AIDS cases of any country. Some reports project that 37 million people will be infected within the next two decades. Sadly, few studies have examined the legal claims of those who suffer with this disease in this, the world's largest democracy. In this article, I systematically examine how the courts in India have responded to rights-based claims brought by people who have HIV. The conventional wisdom is that the Indian judiciary frequently protects the rights of the poor, the under-represented, and the ill. But my findings reveal that, …

The study population and sample involved higher education faculty teaching in science departments at one public university and three public colleges in the state of West Virginia (N = 153). A Likert-type rating scale survey was used to collect data based on the research questions. Two parts of the survey were adopted from previous studies while the other two were self-constructed. Research questions and hypothesis were analyzed using both descriptive …

A Study Of Selected Songs By Leonard Bernstein Which Reflect His Contribution To The Evolution Of Art Song In America., Yugo Sava Ikach

Graduate Theses, Dissertations, and Problem Reports (ETD)

Within American vocal art music of the twentieth century, there has been an infusion of non-traditional musical traits. Some of these characteristics and idioms find their roots in American popular music and jazz. Although this phenomenon has been met with a certain amount of opposition, its presence is undeniable. The success and acceptance of this blending of styles owes much to the work of Leonard Bernstein. This paper examines a selection of Leonard Bernstein's vocal songs that in some way demonstrate this blending of styles, and notes influence of his opinions via mass media exposure. Bernstein's compositions and opinions have …

Graduate Theses, Dissertations, and Problem Reports (ETD)

This research study was designed to evaluate twelve eighth-grade students participating in the fourth year of a mentoring program to determine what effect the mentoring experience would have on the students' sense of a scientific community, their understanding of scientific knowledge and process skills and attitudes toward science. The mentoring program was developed through a partnership established between the researcher, an eighth-grade science teacher at a junior high school, and an administrator of a local hospital, to provide educational opportunities for students mentored by medical professionals. The research design included qualitative and quantitative methods of analysis. The qualitative instruments were …
