Hotel rate is essential to every traveler, every hotelier, every key person in travel planning for their company, and even the tourism planner for the city. The graduate students from RIT's hotel management program had conducted serial surveys on hotel rates in 100 major cities in US from 1989-1999. This study employed the data that RIT students collected as a foundation. First, four cities were chosen in every region (East, Midwest, West and South). I readily acknowledge that the UMA is a bold and noble project, and it is certainly the result of substantial effort and compromise. Indeed, I largely concur with the sentiment of Philip Harter that "[tihe UMA is the product of heroic effort that brought together many interests and perspectives to thrash out a workable framework for mediation." The National Conference of Commissioners on Uniform State Laws and House of Delegates of the American Bar Association recently approved the Uniform Mediation Act ("UMA") with an eye toward unifying the law of mediation confidentiality in the United States. Soon, numerous states and other organizations will consider modifying statutes, court rules, or professional standards to conform to the UMA. One of the important aspects of mediation confidentiality is how it applies when enforcing a mediated agreement.' A survey of optical properties of sputtered materials in the spectral range of 145 nm to 800 nm has been performed. The optical constants n and k have been measured using ellipsometric techniques. Four combination materials have been created with the properties suitable for application in Attenuated Phase Shift Mask (APSM) manufacturing. The four combination materials have also been characterized, with the results presented.

Signaling through G protein-coupled receptors (GPCRs) mediates numerous airway smooth muscle (ASM) functions including contraction, growth, and "synthetic" functions that orchestrate airway inflammation and promote remodeling of airway architecture. In this review we provide a comprehensive overview of the GPCRs that have been identified in ASM cells, and discuss the extent to which signaling via these GPCRs has been characterized and linked to distinct ASM functions. In addition, we examine the role of GPCR signaling and its regulation in asthma and asthma treatment, and suggest an integrative model whereby an imbalance of GPCR-derived signals in ASM cells contributes to the …

In Blindness, Nobel Prize laureate Jos6 Saramago chronicles the quarantining of the first victims of a plague of blindness.1 We meet many people who become blind in Saramago's novel, including an opthamologist, a one-eyed man with an eye patch, and a man born blind. Saramago reminds us that we are all blind in one way or another, and that there are many things about ourselves and our society that we can't or won't see. The quarantine itself turns out to be isolating, inhumane, and degrading; the interred blind being portrayed by themselves and others as pigs, dogs, and "lame crabs." …

Ten years ago, in White v. Samsung Electronics America, the Ninth Circuit held that a robot violated Vanna White's publicity rights. Since the White decision, the tendency to equate evocation with infringement in trademark and right of publicity cases has only grown. In contrast to this expansionist trend in trademark and right of publicity law, however, courts in recent copyright cases have arguably backed off from a strong right to evoke. This Article identifies these trends and suggests some reasons for concern over an exclusive right to evoke. The author argues that if we wish to preserve a rich commons …

The explosion of peer-to-peer file sharing has forced a reexamination of the essential structure of copyright law in the United States. In a digital, interconnected world, the dispersion of copying and distribution activities makes it more difficult for copyright holders to identify users who derive value from their works. And at least theoretically, the inability to capture such value could ultimately jeopardize the incentive to produce and distribute creative expression.

This Article describes how intellectual property (IP) law regulates six types of vertical restraints: restrictions on the field or location of use; restrictions on sharing; control over the frequency of use; restrictions on repair and modification; packaging requirements; and impediments to a buyer's decision to exit its relationship with a seller. There are three reasons to focus on IP oversight of vertical restraints separately from antitrust oversight. First, IP law covers a broader range of vertical restraints. Second, economic analysis of the antitrust-IP conflict focuses mainly on the potential of vertical restraints to exclude downstream competitors. IP doctrines that regulate …

Copyright law often provides the background rules against which bargaining over rights in works of information takes place. By granting creators of works of authorship certain exclusive rights and providing protection against infringement of those rights, copyright law effectively gives authors bargaining chips to use in negotiations with those who would exploit their works in some way. Generally, however, copyright law does not explicitly address imbalances in bargaining power that affect the division of the surplus between the parties to a copyright license. Rainfall-runoff impacted by anthropogenic activities transports significant quantities of particulate, aqueous and complexed constituents. These diffuse, unsteady and stochastic event-based loadings are unique challenges for water quality and quantity control. The design, water quality and quantity functions of a partial exfiltration reactor (PER) utilizing Fe-coated-sand and porous pavement (CPP) is examined specifically across three representative rainfall-runoff events. Total concentrations and mass for metals (Zn, Pb, Cu and Cd), suspended solids, and Chemical oxygen demand were reduced significantly. Rainfall-runoff volume and peak flow were reduced and time to peak was extended. Influent dm/dp ratios based on particle analyses suggest that the …

Settlements of federal civil actions may, but need not, be subject to later judicial enforcement. As recognized by the U.S. Supreme Court in Kokkonen v. Guardian Life Insurance Co., one significant limitation on enforcement proceedings is subject matter jurisdiciton because federal district courts are courts of limited jurisdiction. Under Kokkonen, enforcement jurisdiction may be independent, but usually is ancillary because state law claims typically are involved where there is no diversity of citizenship. Ancillary enforcement powers may be exercised by district courts either where claims were initially presented for adjudication and disputes arising from later settlements are factually interdependent, or …

Most of the research in the field of molecular imprinting has been focused on the development of new functional monomers, in order to improve the molecular recognition properties afforded by these materials. The role of the crosslinking monomer has often been overlooked, since it is considered an inert component that only provides a scaffold to support the binding sites. However, the crosslinking monomer represents a high percent (80-90%) of the composition of molecularly imprinted polymers (MIPs), which can have a large influence on the MIPs properties. Ethics In Public Relations: Gauging Ethical Decision-Making Patterns Of Public Relations Practitioners, Paul Stuart Lieber

This study employed the Defining Issues Test (DIT) and a quantitative version of the five-factor TARES Test to gather data on the ethical decision-making patterns of public relations practitioners. The former is an instrument based on Kohlberg’s (1969) moral development theory, the latter self-enforced, ethical consideration statements derived from the research of Baker and Martinson (2001). Results show that levels of moral development in public relations differ based on job segment, and that age, education, gender and rank significantly affect levels of ethical consideration. This dissertation examines media coverage of two events in the Civil Rights Movement-the lynching of Emmett Till in 1955 and the Montgomery bus boycott in 1955-56. The study focuses on three publications aimed primarily at white audiences (Life, Look and the New York Times) and two aimed primarily at black audiences (the Birmingham World and Jet). The dissertation seeks to answer several questions. How did mainstream news organizations cover black Americans in the decades prior to the 1950s? The focus of this dissertation is on one of the many relationships that exist between the bureaucracy and government: decision-making by elected representatives and the political influence of government employees on their decision-making. Specifically, it is with bureaucrats and the degree to which they may utilize political influence to create a disproportionate influence over government policy and decision-making in the United States House of Representatives. I argue that the inherent qualities of bureaucrats suggest that they are significant and influential constituency for representatives. IRS24 is a strain of Deinococcus radiodurans carrying mutations in two loci, uvrA and irrE, rendering it sensitive to the lethal effects of UV and ionizing radiation. These sensitivities can be reversed by introducing the wild type irrE allele back into IRS24 via natural transformation. The irrE allele was localized to a 970bp region of D. radiodurans R1 Chromosome I containing one putative open reading frame, DR0167, and 179bp of upstream sequence. Subsequent sequence analysis of the irrE allele in IRS24 revealed a transition mutation at codon 111 of DR0167 (IrrE) resulting in an arginine to cysteine amino acid substitution. …

The purpose of this study is to examine whether the different type of ownership will affect the degree of objectivity of newspaper coverage of 2000 presidential election. It is predicted by Shoemaker’s news content theory that publicly-owned newspaper is more objective than privately-owned newspaper. The findings of this study support this theory. A content analysis of 238 news stories and eight editorials from publicly-owned the Boston Globe and privately-owned the Boston Herald showed that not only does the ownership affect the objectivity of the coverage of these two newspapers on 2000 presidential election, the endorsements also affect the degree of …

Calpastatin activity at 24 h postmortem is inversely proportional to postmortem tenderization and accounts for a greater proportion of the variation in beef tenderness. Tenderness was determined by measurement of 24 h postmortem longissimus muscle calpastatin activity (CA) and Warner-Bratzler shear force after 7 and 14 d of steak aging. The quantitative inheritance of tenderness in Brahman steers was investigated phenotypically by Multiple Trait Derivative-Free Restricted Maximum Likelihood (MTDFREML) procedures and genotypically by using restriction fragment length polymorphisms (RFLP), a microsatellite marker, and DNA sequence analyses. The purpose of this study is to examine the function of the bard in situation comedy theme songs. This study calls upon Fiske and Hartley's concept of television as a cultural bard, a singer and teller of stories that create and conserve community. The bard reaffirms the culture's identity while delivering social and political messages relevant to the culture at specific times throughout history. Numerical calculations of the aqueous humor dynamics in the anterior chamber of both the rabbit and the human eye are presented to delineate the basic flow and transport mechanisms. The calculations are based on a geometrical model of the eye, which represents the Trabecular mesh (TM) as a multi-layered porous zone of specified pore sizes and void fraction. Buoyancy is observed to be the dominant driving mechanism for the convective motion in both orientations (horizontal and vertical) of the eye. Based on the literacy need in the state of Louisiana, this project was interested in whether the Ready to Learn: Between the Lions literacy workshop could equip parents to enhance and develop their child’s literacy skills and to enhance family literacy interactions.
