Baby Girls From China In New York: A Thrice-Told Tale, Barbara Stark
Baby Girls From China In New York: A Thrice-Told Tale, Barbara Stark
Utah Law Review
This thrice-told tale has shown why the story of the Baby Girls from China in New York requires multiple tellings. First, multiple tellings expose the multiple contexts and perspectives that drive these adoptions, from those of the desperate birth mothers in rural China to those of the hopeful adoptive parents in New York. Second, multiple tellings destabilize and problematize our understandings of law. Laws enacted in China to promote women's equality led, paradoxically, to an increase in abandoned baby girls. Multiple tellings may not answer the question of well-intentioned human rights activists, but they remind us of the brutal prerogatives …

Studies On The Filamentous Gliding Bacteria Vitreoscilla Stercoraria, Laura Frances Biggs
School of Biological and Marine Sciences Theses
Strains of Vitreoscilla stercoraria were isolated from the environment and characterised. Cell width, motility and requirement of each strain for sodium chloride were investigated. Two strains were selected for further study and the effect of monensin and FCCP on growth of the strains was investigated. One strain of Vitreoscilla (LB13) was chosen for further study, cells from strain LB 13 were found to be 1.38 µm ± 0.041 (± 1 SEM, n=10) wide, were motile by gliding and had an optimum requirement for sodium chloride for growth of 43 mM. The organism was grown in batch culture and respiratory membranes …
An Investigation Of The Phototransduction Cascade And Temporal Characteristics Of The Retina Of The Cuttlefish, Sepia Officinalis, Lisa Nelson
School of Biological and Marine Sciences Theses
Cephalopods have extremely well developed visual systems which are of particular interest due to the well known morphological similarity of the cephalopod eye to the vertebrate eye. This similarity ends at the level of the photoreceptors where vertebrates and invertebrates have been found to use different intracellular second messengers. Although the effect of extracellular ion manipulation on the light response has been examined and some very useful biochemical studies carried out, the pathway has not been investigated by the use of pharmacological intervention; a method which has proved to be useful in other preparations. This study examines various properties of …
Introduction: The Utah Restorative Justice Conference, Erik Luna
Introduction: The Utah Restorative Justice Conference, Erik Luna
Utah Law Review
Restorative justice proves to be a fascinating topic and a provocative foil for challenging contemporary crime and punishment in the United States. The Utah Restorative Justice Conference may be the first of its kind in American legal academe, providing a much-needed forum to hash out the arguments for and against restorativism vis-d-vis traditional approaches to the criminal process. As such, the Symposium hopes to inspire further debate on restorative justice, its principles, and its practices. Restorativism certainly has both charms and warts, but given the current state of affairs in criminal courts and correctional facilities across the nation, the potential …
Repairing The Harm: Victims And Restorative Justice, Lawrence W. Sherman, Heather Strang
Repairing The Harm: Victims And Restorative Justice, Lawrence W. Sherman, Heather Strang
Utah Law Review
From a victim perspective, restorative justice has been shown usually to do better than the existing criminal justice system. It has met the burden of proof for benefiting one stakeholder in the process of justice. It might arguably lose that status if it is found that restorative justice also hurts offenders or communities. But in thousands of restorative justice conferences on three continents, no clear evidence has yet emerged that restorative justice has such negative side effects. Given the substantial evidence of unfairness and disrespect in the treatment of victims by criminal justice, restorative justice seems to be in a …
Cold Comfort: Law And Community In Ethan And Joel Coen's Fargo, Jeanne L. Carriere
Cold Comfort: Law And Community In Ethan And Joel Coen's Fargo, Jeanne L. Carriere
Utah Law Review
Comfort is thus offered in Fargo-to some. The Coens subvert that comfort by making clear that the refuge of Brainerd is available only to those who participate in its normative vision. That normative vision grounds community in a uniformity that extends beyond what is required to preserve the community, such as conformity to its fundamental narrative, to neutral but noticeable traits such as appearance and racial heritage. The Coens offer no redemptive vision by which to transform Brainerd's exclusionary nomos. Marge, who combines keen intellect with sustaining humanity, is the most likely redemptive figure; but the woman who can face …

The Creppy Directive: Security Necessity Or Just Plain Creepy? Reexamining The Richmond Newspapers Test In Light Of The Inconsistent Results Reached In Its Application To Deportation Hearings, Brian Watts
Utah Law Review
On September 11, 1978, the fourth trial of John Paul Stevenson began in a Virginia courthouse. Initially, Stevenson was convicted of second-degree murder, but the Virginia Supreme Court reversed the conviction, holding that a bloody shirt, belonging to Stevenson, had improperly been admitted into evidence. After two more mistrials, the case recommenced in front of the same judge that had presided over two of the first three trials In an apparent attempt to prevent jury contamination, the trial judge granted the defendant's motion to close the trial to the press and public. This closure ultimately prompted what one Justice called …
