Taking The Lawyer's Craft Into Virtual Space: Computer-Mediated Interviewing, Counseling, And Negotiating, Robert M. Bastress, Joseph D. Harbaugh

Law Faculty Scholarship

Bellow's and Moulton's The Lawyering Process emphasized the need for law students and lawyers to draw on other disciplines for effective skills development, to make self-analysis of their professional skills and principles a career-long practice, and to remain ever vigilant of emerging ethical issues. This article attempts to honor those lessons by applying them to lawyers' use of computer mediated communication (CMC) in interacting with clients and in negotiating for clients. The article examines the social science research on CMC, applies that research to the lawyer's context, and makes some tentative assessments about the skills involved in lawyers' use of …

Ravers At The Bush: Generation Ecstasy Goes To The Theatre, William C. Boles

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Determining that seminal moment when a new theatrical movement comes to life has been one of the points of debate surrounding the challenging new plays and their talented, twenty something authors that have appeared on the British stage since the mid-1990s. Plays and authors like: Mojo (1995) by Jez Butterworth; Blasted (1995) by Sarah Kane; Closer (1997) by Patrick Marber; The Beauty Queen of Leenane (1996) by Martin McDonagh; Butterfly Kiss (1994) by Phyllis Nagy; Love and Understanding (1997) by Joe Penhall; Essex Girls (1994) by Rebecca Prichard; Shopping and Fucking (1996) by Mark Ravenhill; and Ashes and …

What Part English, What Part Spanish?, Frank Bramlett Oct 2003

What Part English, What Part Spanish?, Frank Bramlett

English Faculty Publications

Back in July, I was sitting in my office at school, working on a syllabus for a new sophomore- level class on language and society. I was exploring the U.S. Census Bureau website to get a sense of the most current information we have about language communities in the United States. I had the radio on, too, and while I was browsing census data about Nebraska, I heard an advertisement on one of the FM stations. The ad was primarily an English-language ad, but it also had a few Spanish words. It turned out to be a job advertisement for …

Can The Cosmopolitan Speak: The Question Of Indian Novelists’ Authenticity, John C. Hawley Oct 2003

Can The Cosmopolitan Speak: The Question Of Indian Novelists’ Authenticity, John C. Hawley

English

The marketing of books is often beyond the control of their authors; nonetheless, dust jackets sometimes offer amusing evidence of the audience that publication houses, if not authors, wish to reach. Thus, in Red Earth and Pouring Rain ( 1995), Vikram Chandra apparently offers readers the sto1y of "an eighteenth-century wan-ior poet (now reincarnated as a typewriting monkey) and an Indian student home from college in America ... [and] ranging from bloody battles in colonial India to college anomie in California, from Hindu gods to MTV." By way of context, consider Lee Siegel's academic novel, Love in a Dead Language …

What Is Wrong With The Homogeneous Unit Principle?: The Hup In The 21st Century Church, Skip Bell

Journal of the American Society for Church Growth

If you find the homogeneous unit principle to be controversial, credit Donald McGavran, who launched the church growth movement with his important work, Understanding Church Growth, first published in 1970. McGavran describes this principle: “Men like to become Christians without crossing racial, linguistic, or class barriers.” What exactly did McGavran and other key church growth researchers mean by this principle?

When The Church Was A Family: Revisioning Christian Community In Light Of Ancient Social Values, Joe Hellerman Oct 2003

When The Church Was A Family: Revisioning Christian Community In Light Of Ancient Social Values, Joe Hellerman

Journal of the American Society for Church Growth

Some might attribute the relational crises characterizing our churches solely to individual sin and selfishness. Sin and selfishness, however, have been around since Adam. Why the radical increase in relational breakdown in our society and in our churches today? Something bigger is in the works, and it has to do with the unique orientation of modern Western culture, especially contemporary American society. Ours is a culture which insists to its own destruction that the dreams, goals, and personal fulfillment of the individual deserve a higher priority than the well-being of any group (natural family or church body) or relationship (friendship …

African American And European American Therapists’ Experiences Of Addressing Race In Cross-Racial Psychotherapy Dyads, Sarah Knox, Alan W. Burkard, Adanna Jinaki Johnson, Lisa A. Suzuki, Joseph G. Ponterotto

College of Education Faculty Research and Publications

Using Consensual Qualitative Research, 12 licensed psychologists’ overall experiences addressing race in psychotherapy were investigated, as were their experiences addressing race in a specific cross-racial therapy dyad. Results indicated that only African American psychologists reported routinely addressing race with clients of color or when race was part of a client’s presenting concern. European American psychologists indicated that they would address race if clients raised the topic, and some reported that they did not normally address race with racially different clients. When discussing a specific cross-racial dyad, African American therapists more often than European American therapists addressed race because they perceived …

The Impact Of Simulated Digital Data Radio Communication Induced Interference On Voice Radio Communication Intelligibility, Daniela Kratchounova Oct 2003

The Impact Of Simulated Digital Data Radio Communication Induced Interference On Voice Radio Communication Intelligibility, Daniela Kratchounova

Journal of Human Performance in Extreme Environments

Testing to date indicates there is a significant potential for adverse interference from the digital system to the analog system, especially for General Aviation (GA) aircraft. This type of interference can be described as short, random bursts of noise capable of completely obliterating parts of the voice communication. The subsequent degrading effects on voice radio communication could jeopardize flight safety. To address this issue, the goal of the present study was to examine the degree to which such noise impacts voice radio communication intelligibility. Intelligibility was assessed employing a classic, well-established psycho-acoustic method, which uses human beings, rather than electronic …

"You Can't Always Get What You Want": The Territorial Scope Of An Independent Quebec, Peter Radan Oct 2003

"You Can't Always Get What You Want": The Territorial Scope Of An Independent Quebec, Peter Radan

Osgoode Hall Law Journal

In Reference Re Secession of Quebec, the Court identified Quebec's borders as a critical issue in any secession negotiation. Canadian constitutional law requires changes to existing borders, particularly if the Aboriginal communities of Ungava maintain their opposition to becoming part of an independent Quebec, for three reasons. First, an independent Quebec has no right to territory gained in 1898 and 1912 because those territories were granted on the condition that Quebec remain in the federation. Second, the existence of constitutionally entrenched fiduciary obligations owed by the Crown to Quebec's Aboriginal peoples gives the latter a veto over a constitutional amendment …
