Do World Trade Organization Dispute Settlement Reports Affect The Obligations Of Non-Parties? -- Response To Mcnelis, Donald H. Regan Jan 2003

Do World Trade Organization Dispute Settlement Reports Affect The Obligations Of Non-Parties? -- Response To Mcnelis, Donald H. Regan

Articles

In the June 2003 issue of this Journal, Natalie McNelis argued that when a World Trade Organization (WTO) dispute is settled by a Dispute Settlement Body (DSB) report, even Members who are not parties to the dispute have an obligation to conform their behaviour to legal principles laid down in the report. 1 Although I am generally sympathetic to McNeis's conclusion-and although I think she does a great service by directing our attention to the question of how Members, as opposed to later tribunals, should respond to DSB reports-I think her argument cannot stand as she presents it. After explaining …

Equal Protection And Disparate Impact: Round Three, Richard A. Primus Jan 2003

Equal Protection And Disparate Impact: Round Three, Richard A. Primus

Articles

Prior inquiries into the relationship between equal protection and disparate impact have focused on whether equal protection entails a disparate impact standard and whether laws prohibiting disparate impacts can qualify as legislation enforcing equal rotection. In this Article, Professor Primus focuses on a third question: whether equal protection affirmatively forbids the use of statutory disparate impact standards. Like affirmative action, a statute restricting racially disparate impacts is a race-conscious mechanism designed to reallocate opportunities from some racial groups to others. Accordingly, the same individualist view of equal protection that has constrained the operation of affirmative action might also raise questions …

Feminist Tigers And Patriarchal Lions: Rhetorical Strategies And Instrument Effects In The Struggle For Definition And Control Over Development In Nepal, Coralynn V. Davis Jan 2003

Feminist Tigers And Patriarchal Lions: Rhetorical Strategies And Instrument Effects In The Struggle For Definition And Control Over Development In Nepal, Coralynn V. Davis

Faculty Journal Articles

This article offers an analysis of a struggle for control of a women’s development project in Nepal. The story of this struggle is worth telling, for it is rife with the gender politics and neo-colonial context that underscore much of what goes on in contemporary Nepal. In particular, my analysis helps to unravel some of the powerful discourses, threads of interest, and yet unintended effects inevitable under a regime of development aid. The analysis demonstrates that the employment of already available discursive figures of the imperialist feminist and the patriarchal third world man are central to the rhetorical strategies taken …

Toward A Unified Theory Of Cognition: A Kantian Analysis, Clayton Daniel Austin Jan 2003

Toward A Unified Theory Of Cognition: A Kantian Analysis, Clayton Daniel Austin

UNF Graduate Theses and Dissertations

The goal of this paper is to provide classroom teachers a more unified theory of cognition. The current cognitive theories of information processing, schema theory, and constructivism exhibit limitations and a lack of cohesion that make their implications for teachers unclear. This paper will be presented in five sections. 1) The first describes problems with current cognitive theories and the need for a unified theory of cognition 2) The second provides a review of the literature of current cognitive theories. 3) The third section consists of research in the history of cognitive theory both in philosophy and psychology. 4) The …

The Effect Of Esl Instruction On Student Achievement, Amy Jeanne Nelson Jan 2003

The Effect Of Esl Instruction On Student Achievement, Amy Jeanne Nelson

Masters Theses

Not all Limited English Proficient (LEP) students receive English as a Second Language (ESL) instruction in public schools across the nation. In the state of Michigan, ESL instruction for LEP students is not mandated. Therefore, districts can choose whether to service these students at all, and/or the degree to which they do so. Some districts provide bilingual education classes; some districts have ESL classes; while yet other districts have neither. Students are serviced by paraprofessionals for a limited amount of time during the school day, or simply not serviced at all and left to “sink or swim”. Research abounds on …

Effects Of Classwide Peer Tutoring (Cwpt) On Social Interactions Of Children With And Without English Proficiency, Yaoying Xu Jan 2003

Effects Of Classwide Peer Tutoring (Cwpt) On Social Interactions Of Children With And Without English Proficiency, Yaoying Xu

UNLV Retrospective Theses & Dissertations

Learning and Education occur in social contexts. The quality of children's peer relationships is an important indication of children's current and later social adjustment. Children with peer problems tend to experience higher levels of loneliness and other undesirable affective consequences, including social dissatisfaction and worrying about peer relations. Because of the limited language proficiency and cultural and ethnic differences among children with LEP, some of their social behaviors are considered inappropriate by their non-LEP teachers and peers. On the other hand, children with LEP may feel that they do not fit in a group or class activity. As a result, …

Graphic Organizers, Activity, And The Positioning Of Language And Learners: An Ethnographic Case Study, John Allan Unger Jan 2003

Graphic Organizers, Activity, And The Positioning Of Language And Learners: An Ethnographic Case Study, John Allan Unger

UNLV Retrospective Theses & Dissertations

There were two main purposes for this research and one parallel purpose. One main purpose was to investigate how learners of English in an EFL/ESL context, who were also teachers of English and/or learning to be teachers of English, perceived and responded to different types of graphic organizers and associated activities. These graphic organizers and activities were presented at a university in Northern Thailand through an advanced reading comprehension course for preservice and inservice teachers taught by the primary researcher. The second main purpose was to explore, synthesize, and apply theories of mediated activity and research methods originating from or …

"The German Arizonians": Ethnic Identity And Society Formation On A Southwestern Frontier, 1853--World War I, Gerhard Grytz Jan 2003

"The German Arizonians": Ethnic Identity And Society Formation On A Southwestern Frontier, 1853--World War I, Gerhard Grytz

UNLV Retrospective Theses & Dissertations

This study discusses the experiences and the acculturation process of German immigrants in Arizona from the Gadsden Purchase of 1853 to World War I. German immigrants with distinct regional identities, Bavarians, Badeners, Wuerttembergers, Rhinelanders, and Prussians, made the transition to a regional New World identity and became Arizonans. Even though their history is ultimately the story of acculturation to a dominant society, it is the process that is important. Based on the analysis of census schedules, letters, newspaper reports, interviews, and other archival materials, this study tries to uncover the forces and mechanisms that determined the processes that formed American …

Language In Las Vegas: Esl Training Programs In Las Vegas Casino Hotels, Craig Hamilton Hermann

UNLV Retrospective Theses & Dissertations

The study was focused on ESL training for employees within the Casino hotel industry in Las Vegas, Nevada. The overall purpose of the study was to explore the degree to which ESL training programs were being implemented within and/or in use by the casino hotel industry in Las Vegas. While the a review of the literature had suggested that ESL efforts were being employed by the industry, little was known as to overall parameters of the efforts being undertaken with respect to the size, content, and modes of delivery. Therefore, the research questions underlying the study were as follows: (1) …

Decapitation And Disgorgement: The Female Body's Text In Early Modern English Literature, Melanie Ann Hanson Jan 2003

Decapitation And Disgorgement: The Female Body's Text In Early Modern English Literature, Melanie Ann Hanson

UNLV Retrospective Theses & Dissertations

My dissertation focuses on language and forms of expression for women in early modern English literature. In particular, William Shakespeare's character Lavinia from Titus Andronicus, Elizabeth Cary's character Mariam in The Tragedy of Mariam, and Isabella Whitney's narrative voice in her poem "The Manner of Her Will" are examined. French feminist Helene Cixous provides the theoretical framework for this project. Exploring manifestations of Cixous's crucial terms "decapitation" and "disgorgement" is the objective of the three core chapters. Privileging the female body's text and discussing the variety of means used to "speak" it is of central concern. The connection between silencing …

The Impact Of Full-Day And Half-Day Kindergarten On The Language Arts Achievement Scores Of First-Grade Students, Stefanie M Kujaczynski Jan 2003

The Impact Of Full-Day And Half-Day Kindergarten On The Language Arts Achievement Scores Of First-Grade Students, Stefanie M Kujaczynski

UNLV Retrospective Theses & Dissertations

Full-day kindergarten programming is an increasing trend in early childhood education settings. Many school districts are beginning to offer such programs based on the needs and opinions of teachers and parents. These districts are making substantial financial commitments to this programming prompted by the belief that full-day kindergarten will produce greater academic gains for children, more specifically at-risk children; This study investigated the impact of full-day and half-day kindergarten program enrollment on the language arts achievement scores of 237 first grade children considered to be at risk for academic failure. Gender differences and program enrollment differences were the primary categories …

Distributed Importance-Based Fuzzy Logic Controllers For Flexible Link Manipulators, Zhixia Shi Jan 2003

Distributed Importance-Based Fuzzy Logic Controllers For Flexible Link Manipulators, Zhixia Shi

UNLV Retrospective Theses & Dissertations

This research studies the design and tuning of the distributed importance-based fuzzy logic controllers (FLCs) for two dynamic systems: a single-link flexible manipulator and a two-link rigid-flexible manipulator. The importance analysis algorithm is introduced in the structure design of a FLC. The fuzzy rules for the former system are written based on observing the system behaviors. The fuzzy rules for the latter are selected to mimic the performance of the comparable linear controllers. A Modified Nelder and Mead Simplex Algorithm is used to tune the parameters of the membership functions in the distributed importance-based FLC. The tuned distributed importance-based FLC …

The Role Of Ontology In Information Management, Renato De Freitas Marteleto Jan 2003

The Role Of Ontology In Information Management, Renato De Freitas Marteleto

UNLV Retrospective Theses & Dissertations

The question posed in this thesis is how the use of ontologies by information systems affects their development and their performance. Several aspects about ontologies are presented, namely design and implementation issues, representational languages, and tools for ontology manipulation. The effects of the combination of ontologies and information systems are then investigated. An ontology-based tool to identify email message features is presented, and its implementation and execution details are discussed. The use of ontologies by information systems provides a better understanding about their requirements, reduces their development time, and supports knowledge management during execution time.

The Zone Of Proximal Development In An Online Esl Composition Course, Jennifer Ann Paver Jan 2003

The Zone Of Proximal Development In An Online Esl Composition Course, Jennifer Ann Paver

UNLV Retrospective Theses & Dissertations

This qualitative study investigated the Zone of Proximal Development (ZPD) in an online ESL composition course. The study analyzed the correspondence between three Koreans and one Russian participant with their instructor that occurred through the WebCT computer-mediated communication (CMC) software tools of asynchronous e-mail and discussion boards and synchronous chat. The results indicated that, (1) personal background issues, (2) personal views of the instructor, and (3) motivation, attitude, and personal awareness of tool utilization impacted the participants' use of the CMC tools and this in turn impacted the ZPD. The implications of the study are discussed in terms of the …

Differences In Television Use Between Adopted And Non-Adopted College-Aged Adults, Christopher Edward Yunker Jan 2003

Differences In Television Use Between Adopted And Non-Adopted College-Aged Adults, Christopher Edward Yunker

UNLV Retrospective Theses & Dissertations

This thesis is an original study that examines the media usage between adoptive and non-adoptive college-aged adults United States. The beginning of this thesis will focus primarily on television's ability to get a message across to a huge audience in the shortest amount of time. It will state the hypotheses and examine the research questions being sought. Simultaneously, it will examine the effect the media has on our youth. Hypothetically, adopted children have been more susceptible to the messages delivered. It will be the intent to analyze and discuss this susceptibility further in this thesis; The survey asked the subjects …

Strategic Training In The Use Of Causal Diagrams: Facilitation Of Superior Mental Models, Anne Seyer Poliquin Jan 2003

Strategic Training In The Use Of Causal Diagrams: Facilitation Of Superior Mental Models, Anne Seyer Poliquin

UNLV Retrospective Theses & Dissertations

This study focused on the influence of strategic learning on the construction of causal diagrams and their role in text learning. A causal diagram is an instructional adjunct designed to enhance text comprehension by providing a visual representation integrating elements of cause and effect. The Integrated Model of Text and Picture Comprehension (IMTPC) (Schnotz & Bannert, 1999) suggests that diagrams improve learning because they facilitate the construction of mental models via simultaneous comprehension of visual and text elements. However, there is no information on how to achieve this benefit consistently. Scevak, Moore, and Kirby (1993) have demonstrated that this benefit …

Emerging Identities: New Subjects Within Gay Adoption, Megan O Hartzell Jan 2003

Emerging Identities: New Subjects Within Gay Adoption, Megan O Hartzell

UNLV Retrospective Theses & Dissertations

This thesis explores the identity construction and subject positions of gay male foster and adoptive parents. Using late twentieth and early twenty-first century cultural texts, I apply a Foucaultian perspective to analyze how controversies over gay adoptions articulate shifts in contemporary American discourses of homosexuality and the family. Identities available to homosexuals have shifted since the nineteenth century; this thesis looks at the emergence of a new contested identity for homosexuals as adoptive parents at the turn of the twenty-first century by employing Foucaultian methodological techniques of archaeology. This work contributes to the sociological literature on gender, law, and the …

Vocabulary Acquisition And The Generation Effect, Barbara Anne Badgett Jan 2003

Vocabulary Acquisition And The Generation Effect, Barbara Anne Badgett

UNLV Retrospective Theses & Dissertations

This study investigated two methods of inducing the Generation Effect and how its principles might be incorporated in vocabulary acquisition. Subjects attempted to learn 22 unfamiliar vocabulary words under one of three conditions. (1) definition-only control subjects repeatedly wrote each word and definition; (2) sentence generation subjects wrote each word and definition and then wrote a meaningful sentence using that word; and (3) definition generation subjects read the words embedded in context sentences and extrapolated and wrote the word meanings. Subjects were tested following a distracter task, 48-hours later, and again 21-days later. Significant main effects were found for encoding …

The Design, Implementation, And Effectiveness Of A Farsi Word Stemmer, Russell Beckley Jan 2003

The Design, Implementation, And Effectiveness Of A Farsi Word Stemmer, Russell Beckley

UNLV Retrospective Theses & Dissertations

A stemmer for the Farsi language has been designed, implemented, and evaluated. The stemmer uses Farsi morphology to remove affixes, producing effective stems. The implementation is written in C, using strings of unicode-encoded characters to represent Farsi words. It is meant to enhance the Farsi information retrieval system currently being developed at the Information Science Research Institute at the University of Nevada at Las Vegas. The effectiveness of the Farsi stemmer and stopword list on recall/precision was tested.

A Controlled Evaluation Of A Comprehensive Mental Skills Program For Ncaa And Youth Club Swimmers, Kevin Matthew Lancer Jan 2003

A Controlled Evaluation Of A Comprehensive Mental Skills Program For Ncaa And Youth Club Swimmers, Kevin Matthew Lancer

UNLV Retrospective Theses & Dissertations

Previous studies have established that mental skills training is an effective intervention for improving performance in athletes. Relaxation, imagery, and mental preparation interventions have demonstrated efficacy in the improvement of athletic performance. However, relaxation combined with imagery is more effective than either one alone. Similarly, past studies have indicated mental preparation interventions may be more effective in the improvement of athletic performance when combined with other interventions. In team sports such as swimming, optimum performance has been found to improve cohesion. However, whether cohesion leads to improvements in sports performance is undetermined. In this study, a multiple baseline across team …

"In That New World Which Is The Old": New World/Old World Inversion In Aldous Huxley's "Brave New World", Oliver Quimby Melton Jan 2003

"In That New World Which Is The Old": New World/Old World Inversion In Aldous Huxley's "Brave New World", Oliver Quimby Melton

UNLV Retrospective Theses & Dissertations

"'In That New World Which Is The Old': New World/Old World Inversion In Aldous Huxley's Brave New World" examines the inversion of the concepts Old World, specifically associated with England, and New World, specifically associated with America, in the novel Brave New World. After examining and denotatively defining the terms Old World and New World, this thesis argues that the New World/Old World inversion in Huxley's dystopian novel exists because of Anglo-American cultural and political events of the 1920s and early 1930s, namely, the United States' rise as a military, political, and cultural superpower following World War I and Great …
