The Rhetoric Of Colin Powell, Scott Dauenhauer Jan 2003

The Rhetoric Of Colin Powell, Scott Dauenhauer

Open Access Master's Theses

This thesis analyzes the rhetoric of Colin Powell, while further examining his background and the forces impacting his rhetoric. The situation in the Middle East between Israel and Palestine is examined along with Powell's role in attempting to resolve the conflict. This study employs the Neo-Aristotelian method of rhetorical criticism to analyze his address, "Remarks at the 24th Annual National Leadership Conference of the Anti-Defamation League," given on May 6, 2002, along with portions of Powell's other rhetorical works. An interview was conducted Larry Wilkerson, Chief of Staff U. S. Department of State.

Can Federal Agencies Authorize Private Suits Under Section 1983 - A Theoretical Approach, Brian Galle Jan 2003

Can Federal Agencies Authorize Private Suits Under Section 1983 - A Theoretical Approach, Brian Galle

Georgetown Law Faculty Publications and Other Works

This Article offers a few thoughts on the theory of regulatory enforcement under § 1983. Section 1983, I argue, itself authorizes federal agencies to make their regulations privately enforceable. In recent years, the Supreme Court has announced that federal norms are unenforceable in the absence of clear statutory authorization - a "clear statement rule" for private rights of action. Drawing on key tenets of modern statutory interpretation, I claim that the plain text of § 1983 allows many federal regulations to meet this test. Because § 1983 has an important function in coordinating state regulatory efforts with federal law, a …

Imaging And Locating Buried Utilities, Hyung Seok Jeong, Carlos A. Arboleda, Dulcy M. Abraham, Daniel W. Halpin, Leonhard E. Bernold

JTRP Technical Reports

The urban underground has become a spider’s web of utility lines, including phones, electricity, gas, cable TV, fiber optics, traffic signals, street lighting circuits, drainage and sanitary sewers and water mains. Utility damages during construction are very significant and on the rise, resulting in construction delays, design changes, claims, property damages, service breakdowns, disruption of neighboring businesses and even injuries and lost lives. The American Institute of Constructors (AIC) reported that damage to utility lines is the third most significant crisis for contractors. The state-of-the-art and the state-of-the-practice imaging technologies that have potential for being applied in locating underground utilities …

Penumbras, Privacy, And The Death Of Morals-Based Legislation: Comparing U.S. Constitutional Law With The Inherent Right Of Privacy In Islamic Jurisprudence, Seema Saifee

Fordham International Law Journal

In an effort to separate the Islamic regulatory scheme with respect to the criminalization of consensual sexual conduct from the caricature espoused by many Western thinkers, this Note provides a comparative analysis of the criminalization of private consensual sexual conduct in Islamic law and U.S. constitutional jurisprudence on the right of privacy. Part I provides a brief background of Islamic and U.S. criminal regulations on consensual sex and outlines the evolution of constitutional privacy jurisprudence in the U.S. Supreme Court. Part II first examines the evidentiary and procedural requirements pertaining to the criminalization of consensual sexual intercourse in Islamic law, …

Part III will examine the Role of the CCJ as the judicial organ of CARICOM and the …

Renaissance And Reformation: From Private Morals To Public Policy In Alonso De Ercilla’S "La Araucana" And Edmund Spenser’S "The Faerie Oueene", Cyrus Moore Jan 2003

Renaissance And Reformation: From Private Morals To Public Policy In Alonso De Ercilla’S "La Araucana" And Edmund Spenser’S "The Faerie Oueene", Cyrus Moore

Dissertations, Theses, and Capstone Projects

The present study examines the significance for Ercilla and Spenser of humanism, Neoplatonism, Petrarchism, and cortegiania, competing discourses with distinct identities within the competing ideologies of the Reformation and Counter-Reformation. Both authors draw on a shared heritage of the translatio studii and, in particular, on imagery arising from epic poetry's underlying tension between epos and eros. Ercilla's use of this material fuels a renovatio of classical epic based on the poet's participation in the events he describes. Spenser's utilization of these motifs constitutes a transformatio impelled by reformed religion, which raises the stakes from the potential for shame or …

Implicit Prosody In Silent Reading: Relative Clause Attachment In Croatian, Nenad Lovric Jan 2003

Implicit Prosody In Silent Reading: Relative Clause Attachment In Croatian, Nenad Lovric

Dissertations, Theses, and Capstone Projects

When a relative clause (RC) follows two nouns (N1, N2) in a complex noun phrase such as that contained in the example English sentence below, the preferred interpretation has been found to differ across languages.

(1) Someone shot the servant [N1] of the actress [N2] who was on the balcony [RC].

In some languages (e.g., English), readers preferentially interpret the RC as attaching to (i.e., modifying) N2. In other languages (e.g., Spanish), there is a preference for attachment to N1. This cross-linguistic variation is the only known counterevidence to the claim that the human sentence processing routines are universal, and …

Second Natures: Media, Masculinity And The Natural World In Twentieth-Century American Literature And Film., Jeanne E. Hamming Jan 2003

Second Natures: Media, Masculinity And The Natural World In Twentieth-Century American Literature And Film., Jeanne E. Hamming

Graduate Theses, Dissertations, and Problem Reports (ETD)

This multidisciplinary dissertation examines the cultural anxieties associated with masculine identity in relation to both technology and nature in key literary texts and contemporary films of the twentieth-century: Ray Bradbury's “The Veldt” and The Martian Chronicles, Philip K. Dick's Do Androids Dream of Electric Sheep?, James Dickey's Deliverance , Don DeLillo's White Noise, Fight Club, American Psycho, Brazil, 12 Monkeys, and Dark City. Exploring the theoretical intersections of technoculture, ecocriticism, and gender studies, this dissertation analyzes the relationship between masculine identity and nature, as it is mediated by American technoculture. This relationship is marked by a discernible cultural malaise—a sense …

The Durban Conference Against Racism And Everyone's Responsibilities, J.A. Lindgren Alvez Jan 2003

The Durban Conference Against Racism And Everyone's Responsibilities, J.A. Lindgren Alvez

University of San Francisco Law Review

WHEN DELEGATES AND observers to the third United Nations conference against racism left the premises in Durban, South Africa, exhausted and still stunned by the difficulties they had faced, they did not have a hint of what was soon to happen. They knew that only by means of accommodation and last minute procedural maneuvers had they managed to reach a "consensus" on the final documents. This should have been enough to tone down any possible enthusiasm. Nevertheless, for most of them, results had undoubtedly had positive aspects. There were reasons to believe the Conference had been worthwhile.

Refugee Policy And Cultural Identity: In The Voice Of Hmong And Iu Mien Young Adults, Bill Ong Hing

UC Law Journal of Race and Economic Justice

U.S. refugee admission and resettlement policies have helped to shape the cultural identities of refugees in America in unanticipated ways. In this article, the author examines the effects of these policies on the young adult members of two small Laotian refugee groups-the Hmong and the Iu Mien. After reviewing the ad hoc admission and resettlement programs of the federal government, the author reviews a collection of interviews of young college students and discovers a range of attitudes on identity, mainstream culture, religion, and the desire to maintain ethnic culture. The cultural identity being developed by Ju Mien and Hmong young …

Automated Grammatical Tagging Of Language Samples From Children With And Without Language Impairment, Deborah Millet Jan 2003

Automated Grammatical Tagging Of Language Samples From Children With And Without Language Impairment, Deborah Millet

Theses and Dissertations

Grammatical classification ("tagging") of words in language samples is a component of syntactic analysis for both clinical and research purposes. Previous studies have shown that probability-based software can be used to tag samples from adults and typically-developing children with high (about 95%) accuracy. The present study found that similar accuracy can be obtained in tagging samples from school-aged children with and without language impairment if the software uses tri-gram rather than bi-gram probabilities and large corpora are used to obtain probability information to train the tagging software.

The Direction Of Memory For Music For Popular And Novel Songs, Susan Rose Sibma Jan 2003

The Direction Of Memory For Music For Popular And Novel Songs, Susan Rose Sibma

Theses : Honours

Previous research on memory for music has typically measured participants' reaction times (RTs) and accuracy in tests of recall and recognition of songs presented to them. The current study was interested in what occurs during the time that elapses between stimulus onset and the generation of a response. It has been suggested that people sing or hum to themselves as they search for an answer (Rubin, 1977), but a question that has been overlooked to date is in what direction this occurs. As music unfolds in time, it was proposed that in memory for music, 'forward is best'. In the …

Nafta's Investment Chapter: Initial Thoughts About Second-Generation Rights, Charles H. Brower Jan 2003

Nafta's Investment Chapter: Initial Thoughts About Second-Generation Rights, Charles H. Brower

Vanderbilt Journal of Transnational Law

In this Article Professor Brower argues that most observers of NAFTA's investment chapter have missed an important and surprising development: Although the treaty's text shares a philosophical affinity with civil and political rights, its application has revealed an astonishing level of support for economic and social rights (ESCRs) in North America. Professor Brower examines the practical implications of this development both for the presentation of claims in investor-state arbitration and for the better integration of ESCRs into the mainstream of international law.
