State Self-Employment Policies: A Decade Of Change Final Report, Nancy Arnold Ph.D., University Of Montana Rural Institute
State Self-Employment Policies: A Decade Of Change Final Report, Nancy Arnold Ph.D., University Of Montana Rural Institute
Employment
In 1991-92, the Research and Training Center on Rural Rehabilitation (RTC: Rural) evaluated 45 state Vocational Rehabilitation (VR) agencies’ policies and procedures regarding self-employment for people with disabilities. Based on this analysis, researchers developed and broadly disseminated a model VR self-employment policy (Arnold & Seekins, 1994) and were successful in their efforts to have self-employment included as an employment outcome in the 1998 Reauthorization of the Rehabilitation Act. In 2002, RTC: Rural investigated state policies again to see how they had changed and what trends had developed over the intervening decade. Researchers requested a copy of state self-employment policies and …
One Full Bite At The Apple: Defining Competent Counsel In Texas Capital Post-Conviction Review, Julie B. Richardson-Stewart
One Full Bite At The Apple: Defining Competent Counsel In Texas Capital Post-Conviction Review, Julie B. Richardson-Stewart
Texas Wesleyan Law Review
This Comment argues that the Texas Court of Criminal Appeals was correct in refusing to engraft a constitutional standard of effective assistance of counsel to post-conviction habeas corpus review. In reaching the appropriate decision, however, the court failed to provide any guiding standards of competence for appointed capital habeas attorneys. Specifically, the court did not elaborate on either the type or amount of qualifications, experience, or ability necessary for a finding of attorney "competence." The resulting inadequate definition of "competency" for appointed post-conviction counsel in death penalty cases leaves habeas petitioners without a remedy when statutorily mandated, post-conviction review is …

This article examines the ABA revision to Model Rules 5.5 and 8.5 in light of today's legal world where representing clients in states outside the lawyer's state of licensure is commonplace, particularly in areas of practice that involve federal law, such as environmental law, and clients with far-flung property or business transactions in numerous jurisdictions. The article notes that although the revision to these rules represents the first step in a necessary liberalization of ethical rules and statutes to permit competent lawyers to service client needs efficiently and encourages more uniformity of approach, the rules and UPL statutes still create …

Things Have Changed: Looking At Non-Institutional Mental Disability Law Through The Sanism Filter, Michael L. Perlin
Things Have Changed: Looking At Non-Institutional Mental Disability Law Through The Sanism Filter, Michael L. Perlin
Articles & Chapters
Almost all the literature about the influence of sanism and pretextuality on the development of mental disability law has dealt with questions of institutionalization and the rights of persons who are subject to commitment to in-patient psychiatric hospitals. Problems of mental disability, however, are not solely institutional problems. A significant percentage of the public - the vast majority of whom will never be in peril of institutionalization - exhibit some sort of serious mental illness during their lifetime. A much larger percentage exhibits some sign of mental disability or mental disorder. And this population - like the rest of the …
