The Integrationist Alternative To The Insanity Defense: Reflections On The Exculpatory Scope Of Mental Illness In The Wake Of The Andrea Yates Trial, Christopher Slobogin

On June 20, 2001, Andrea Yates took the lives of her five children by drowning them, one by one, in a bathtub. At her trial on capital murder charges nine months later, she pleaded insanity. Despite very credible evidence that she had long suffered from serious mental disorder, a Texas jury convicted Yates of murder and sentenced her to life in prison. Her tragic and controversial case led many to question whether the so-called "M'Naghten" test for insanity, which forms the basis for the insanity defense in Texas, adequately defines the exculpatory effect of mental disorder. The Laconomics Of Apples And Oranges: A Speculative Analysis Of The Economic Concept Of Commensurability, Jeanne L. Schroeder

The article challenges the commensurability debate, arguing that the opposition between commensurability and incommensurability is not a resolvable conflict but a necessary paradox rooted in human subjectivity and symbolic thought. Drawing on the philosophical traditions of Kant, Hegel, and Lacan, the analysis posits that both quantitative and qualitative aspects are essential in legal and economic decision-making, emphasizing the need to manage rather than resolve this paradox. The speculative approach suggests that rationality involves acknowledging and navigating this duality, rather than adhering to one side of the debate.

Does the field of conflict resolution have any broadly applicable theories that "work" across the different domains of international and domestic conflict? Or, are contexts, participants, and resources so "domain" specific and variable that only "thick descriptions" of particular contexts will do? These are important questions which have been plaguing me in this depressing time for conflict resolution professionals, from September 11, 2001 (9/11), to the war against Iraq. Hugh Harold Calkins III was born in New York City on October 13, 1942. At a young age his family moved to Colorado. His parents were Hugh Harold II and Elizabeth Calkins. After college he joined the Peace Corps with his wife and later attended law school at the University of Colorado. He received the Reginald Heber Smith Fellowship, which enabled him to choose from a list of places to work and he chose to work in Maine. He and his wife first worked at Pine Tree Legal Assistance. Since 1984, the Governmental Accounting Standards Board (GASB) has worked to improve accounting and financial reporting standards for state and local governments. The board is a private, nonprofit organization consisting of seven board members and a full-time staff. Like the Financial Accounting Standards Board (FASB) that sets accounting standards for private companies, GASB is funded by the Financial Accounting Foundation, a nonprofit entity that exercises general oversight over the financial reporting of public entities. In June 1999, GASB approved Statement No. 34: Basic Financial Statements and Management's Discussion and Analysis for State and Local Governments (GASB 34).

I'Ll Take That: Legal And Public Policy Problems Raised By Statutes That Require Punitive Damages Awards To Be Shared With The State, Victor E. Schwartz, Mark A. Behrens, Cary Silverman
Missouri Law Review
This Article will provide a brief review of the purpose and history of punitive damages. It will then examine the various reforms adopted by the states, with a particular focus on "split-recovery" laws that require punitive damages recoveries to be shared with the state or a state-specified fund. This Article explains that such laws may actually fuel, rather than curb, punitive damages awards. The Article also explains that these laws are ethically and constitutionally problematic. This Article concludes that states seeking to reform their punitive damages laws would be better served by (1) adopting a heightened burden of proof and …
