Real Options In Law: (Possibly, Frivolous) Litigation And Other Applications, Peter H. Huang

This Article advances the thesis that real options are not only ubiquitous in law, but also provide novel insights about legal decision making, doctrines and rules. An introduction provides a brief a primer about financial options, real options, and real options in law. Part I of this Article develops implications of the fact that every lawsuit contains a sequence of real options for the plaintiff to unilaterally abandon that lawsuit. Part II of this Article appraises the limitations of game-theoretic analysis of the abandonment options embedded in litigation and some responses to such limitations. To meet this necessity, NLSC contracted with the University of Nebraska at Omaha (UNO), Center for Public Affairs Research (CPAR) to conduct an economic impact study.

Education Policy Analysis Archives (EPAA)

Lois Weiner (2003) and Lauren Resnick (2003) have advanced substantially different views of the success of the reforms undertaken by Community School District Two (CSD2) in New York city. Weiner's position vis a vis District Two has probably conferred a greater measure of objectivity to her views. Criticisms of scholarly work, even when sharply worded, are neither personal nor unscientific; indeed they are quite common in all the sciences.

International Poverty Law: A Response To Economic Globalization, Timothy K. Kuhner

This paper is directed at poverty lawyers and, more generally, anyone with an interest in the relationship between poverty and globalization. In this paper, I argue that poverty law needs to expand its scope in order to encompass the international dimensions of poverty, and to thereby become responsive to the current nature of poverty. This need is evident, because wealth and poverty have been globalized, domestic issues have become international issues, and international issues have become domestic issues and produced domestic changes. In light of expanding international trade, it is increasingly likely that politicians, courts and tribunals will wrestle with whether punitive damages are appropriate in transnational disputes, and whether countries that traditionally do no allow exemplary relief should recognize and enforce foreign awards of such damages. Furthermore, by seeing how different systems address these problems, we can gain a deeper understanding of the role of punitive damages in our own legal system and be better able to deal with punitive damages issues in the international arena. The state legislature has been debating several approaches to solve the shortage of money for the state budget. They have passed various tax increases as well as made reductions in the level of services provided. What do rural Nebraskans support doing to solve the budget issue for state aid, higher education and public aid? Which goods and services do they favor imposing the sales tax on? Do their opinions differ based on the size of their community or their age?

This report details 3,087 responses to the 2003 Nebraska Rural Poll, the eighth annual effort to understand rural Nebraskans’ perceptions. …

On March 2, 1801, President John Adams appointed forty-two persons to be justices of the peace in the District of Columbia. John Marshall, doubling as Secretary of State as well as Chief Justice, failed to deliver the commissions. Adams's term expired. James Madison, Marshall's successor as Secretary of State, withheld seventeen of the commissions. In 1802, William Marbury and three other appointees to this minor office brought mandamus against Madison in the Supreme Court. Madison was ordered to show cause why the writ should not issue. Congress abolished the June sitting of the Court. Only in 1803 was the case …

The paper offers an overview of the emerging issues raised by the Internet in the legal profession. In particular, the extension of the attorney-client privilege; the application of the ethics principle of confidentiality to email communications; Internet connectivity and the security issues pertaining to it; and, general "cyberlegalethics" concerns raised by using the Internet, such as avoiding the unauthorized practice of law and verifying information found on the Web.

A research team led by the University of Nevada, Las Vegas (UNLV) Research Foundation proposes a project to develop advanced high temperature heat exchangers (HTHX) for hydrogen production and electrical energy conversion from advanced nuclear reactor concepts. This project will also support the development of Generation IV reactors. The research team includes researchers from UNLV, General Atomics (GA), Sandia National Laboratories (SNL), The University of California, Berkeley UCB) and Oak Ridge National Laboratory (ORNL).

The proposed project will be administered by the University of Nevada Las Vegas Research Foundation (UNLVRF). UNLVRF will provide the overall contract administration and is the …
