Representation Of Web Data In A Web Warehouse, Sourav S. Bhowmick, Sanjay Madria, Wee Keong Ng

Computer Science Faculty Research & Creative Works

We believe that, to manage Web data effectively, there is a need to build a data warehouse of Web data, i.e. a Web warehouse. in this paper, we focus on how to represent and store relevant hyperlinked Web documents effectively in a Web warehouse called WHOWEDA (WareHouse of WEb DAta) for further querying and manipulation. We present a simple and general model for representing metadata, structure and content of Web documents and hyperlinks in WHOWEDA. We discuss node and link objects which are used to represent Web documents and hyperlinks respectively in WHOWEDA. These objects are first class objects in …

Reciprocal Effects Of Crime And Incarceration In New York City Neighborhoods, Jeffery Fagan, Valerie West, Jan Holland Jan 2003

Reciprocal Effects Of Crime And Incarceration In New York City Neighborhoods, Jeffery Fagan, Valerie West, Jan Holland

Faculty Scholarship

The concentration of incarceration in social groups and areas has emerged in the past decade as a topic of research and policy interest. This interest was fueled by several factors: persistent continued growth of incarceration through the 1990s, even as crime rates fell nationally for over seven years; persistent racial disparities in incarceration; assessments of the collateral consequences of incarceration that potentially aggravate the causal dynamics that lead to elevated crime rates; rapid growth in the number of returning prisoners to their communities; an influx that may strain social control in neighborhoods where social and economic disadvantages have already created …

Re-Imagining Justice, Robin West Jan 2003

Re-Imagining Justice, Robin West

Georgetown Law Faculty Publications and Other Works

What do we mean by legal justice, as opposed to distributive, or social, or political justice; what is the justice, that is, we hope law promotes? What is the justice that lawyers and judges, peculiarly, are professionally committed to pursue? What is the virtue around which, arguably, this profession, and the individuals within it, have defined their public lives?

Justice -- and more particularly legal justice -- is a badly under-theorized topic in jurisprudence; perhaps surprisingly, there is little written on it. The paucity of writing of course has a history. It can be traced to the turn of the …

The Original Meaning Of The Necessary And Proper Clause, Randy E. Barnett Jan 2003

The Original Meaning Of The Necessary And Proper Clause, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

In this Article, I present the evidence of the original public meaning of the Necessary and Proper Clause." These findings will, of course, be of interest to originalists. But, they should also be of interest to the many constitutional scholars who consider original meaning to be one among several legitimate modes of constitutional analysis, or who consider original meaning the starting point of a process by which this meaning is translated into contemporary terms. By either account, it is important to find the correct original meaning, even if it is not dispositive of today's cases and controversies. I will show …

Drm And Privacy, Julie E. Cohen Jan 2003

Drm And Privacy, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

Interrogating the relationship between copyright enforcement and privacy raises deeper questions about the nature of privacy and what counts, or ought to count, as privacy invasion in the age of networked digital technologies. This Article begins, in Part II, by identifying the privacy interests that individuals enjoy in their intellectual activities and exploring the different ways in which certain implementations of DRM technologies may threaten those interests. Part III considers the appropriate scope of legal protection for privacy in the context of DRM, and argues that both the common law of privacy and an expanded conception of consumer protection law …

Security And Freedom: Are The Governments' Efforts To Deal With Terrorism Violative Of Our Freedoms?, David Cole Jan 2003

Security And Freedom: Are The Governments' Efforts To Deal With Terrorism Violative Of Our Freedoms?, David Cole

Georgetown Law Faculty Publications and Other Works

One of the most common things that is said about September 11th is that it changed everything. In some respects, that is true. In the most important respects it would be more accurate to say it has changed everything for some, far more than it has for others. One instance of that can be seen in a pole that National Public Radio did one year after September 11th. They asked people to what extent their life had changed. They asked them whether they had to give up any important rights or freedoms in the war on terrorism. Only seven percent …

The Joy Of Teaching Legislation, Chai R. Feldblum Jan 2003

The Joy Of Teaching Legislation, Chai R. Feldblum

Georgetown Law Faculty Publications and Other Works

I am going to talk about teaching legislation, a class I have taught several times at Georgetown University Law Center, as well as teaching a federal legislation clinic, which I founded ten years ago at the law school. Bill Eskridge has done a wonderful job laying out the different ways one can teach a course in legislation; you will see that my approach focuses on teaching the skills that, as Bill also correctly noted, all young lawyers will need when they start practicing.

Law In The Heart Of Darkness: Atrocity & Duress, Rosa Ehrenreich Brooks Jan 2003

Law In The Heart Of Darkness: Atrocity & Duress, Rosa Ehrenreich Brooks

Georgetown Law Faculty Publications and Other Works

Our faith in the law is rarely tested, since in America, at least, few of us ordinary people ever find ourselves at the extremes, confronting violence and terror. But the extremes have a way of creeping up on us, and the unimaginable can quickly and imperceptibly begin to seem routine. Millions of ordinary Europeans discovered this in the middle of the last century, and thousands of ordinary Americans discovered it in Vietnam. Some Americans are discovering it again today in the mountains and deserts of Afghanistan and Iraq. Experientially, there is often no sharp dividing line between "ordinary" life and …

Rogue Science, Maxwell Gregg Bloche Jan 2003

Rogue Science, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

This review essay considers the tension between the evidence-driven vision of science's mission and the fears of malicious use and terrible consequences that have come to the fore since the terrorist attacks of September 11, 2001. These fears have led some to call for government restrictions on the substance of scientific research and communication. In general, this approach is likely to do far more harm than good. But scientists need to take the problem of social consequences more seriously than they have so far. The author argues in this essay that in some circumstances, when rogue use of science can …

Rhetoric And Realities Of Gentrification: Reply To Powell And Spencer, J. Peter Byrne Jan 2003

Rhetoric And Realities Of Gentrification: Reply To Powell And Spencer, J. Peter Byrne

Georgetown Law Faculty Publications and Other Works

Gentrification represents one of the most encouraging trends in city life since the 1960s. That may be a sad commentary on the fate of American cities or on our urban policies, but it is nevertheless true. The return of affluent people to urban living offers the possibility of reversing declining populations and municipal revenues, permitting enhanced spending on basic services, and increasing employment and educational opportunities. It also brings greater ethnic and economic diversity, which can contribute to a more humane social and cultural life. The great drawback to gentrification is that increased demand for housing increases rents, at least …

Law And Force After Iraq: A Transitional Moment, Jane E. Stromseth Jan 2003

Law And Force After Iraq: A Transitional Moment, Jane E. Stromseth

Georgetown Law Faculty Publications and Other Works

What impact will the Iraq war of 2003 have on international law governing the use of force and on the future of the United Nations Security Council? Some commentators have proclaimed that the military intervention led by the United States amounted to the "death" of the UN Charter and the end of "the grand attempt to subject the use of force to the rule of law." The Security Council's failure to reach agreement--in the face of French-U.S. antagonisms--spells the end, they argue, of an effective Council role in addressing major threats to peace and security. My own view is that …

Who Is Excellent?, Mari J. Matsuda Jan 2003

Who Is Excellent?, Mari J. Matsuda

Georgetown Law Faculty Publications and Other Works

Who will save the life of that silent teenager--the one over there edging toward the condom table, the one across town wondering whether to take Daddy's gun to school, the girl who is too embarrassed to tell anyone her boyfriend hit her, the child picking up a rock in the Gaza Strip? Affirmative action is about who will save these lives. In all of our institutions, the academy among them, we must make decisions of admission. Who will enter these doors and wield power here? Who will ascend to the position of decision maker? Who will walk off with the …

Shareholder Value And Auditor Independence, William W. Bratton Jan 2003

Shareholder Value And Auditor Independence, William W. Bratton

Georgetown Law Faculty Publications and Other Works

This Article questions the practice of framing problems concerning auditors' professional responsibility inside a principal-agent paradigm. If professional independence is to be achieved, auditors cannot be enmeshed in agency relationships with the shareholders of their audit clients. As agents, the auditors by definition become subject to the principal's control and cannot act independently. For the same reason, auditors' duties should be neither articulated in the framework of corporate law fiduciary duty, nor conceived relationally at all. These assertions follow from an inquiry into the operative notion of the shareholder-beneficiary. The Article unpacks the notion of the shareholder and tells a …

Foreword: Revisiting Gilson And Kraakman’S Efficiency Story, Donald C. Langevoort Jan 2003

Foreword: Revisiting Gilson And Kraakman’S Efficiency Story, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

Gilson and Kraakman's ‘Mechanisms of Market Efficiency’ is part of the canon of modem corporate law scholarship, one of a handful of articles that has profoundly influenced the way we think about the field. It is also enigmatic, warranting a fresh look by those who think they know what it says from some long-ago reading or second-hand references by other authors.

Erasure And Recognition: The Census, Race And The National Imagination, Naomi Mezey Jan 2003

Erasure And Recognition: The Census, Race And The National Imagination, Naomi Mezey

Georgetown Law Faculty Publications and Other Works

This Article is concerned with the constitutive power of the census with respect to race. It is an examination of the U.S. Census as an aspect of what Angela Harris calls race law, "law pertaining to the formation, recognition, and maintenance of racial groups, as well as the law regulating the relationships among these groups." While others have noted and explored the epistemological and constitutive functions of the census race categories, my aim is to unpack this insight in the context of two specific examples of categorical change and contest: the addition of a Chinese racial category in 1870 and …

The Difference In Criminal Defense And The Difference It Makes, Abbe Smith Jan 2003

The Difference In Criminal Defense And The Difference It Makes, Abbe Smith

Georgetown Law Faculty Publications and Other Works

My own view of criminal defense lawyering owes much to Monroe Freedman. I agree with his "traditionalist view”, of criminal defense ethics as a lawyering paradigm in which zealous advocacy and the maintenance of client confidence and trust are paramount. Simply put, zeal and confidentiality trump most other rules, principles, or values. When there is tension between these "fundamental principles” and other ethical rules, criminal defense lawyers must uphold the principles, even in the face of public or professional outcry. Although a defender must act within the bounds of the law, he or she should engage in advocacy that is …

Non-Judicial Review, Mark V. Tushnet Jan 2003

Non-Judicial Review, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

Professor Mark Tushnet challenges the view that democratic constitutionalism requires courts to dominate constitutional review. He provides three diverse examples of non-judicial institutions involved in constitutional review and examines the institutional incentives to get the analysis" right." Through these examples, Professor Tushnet argues that non-judicial actors may perform constitutional review that is accurate, effective, and capable of gaining public acceptance. Professor Tushnet recommends that scholars conduct further research into non-judicial review to determine whether ultimately more or less judicial review is necessary in constitutional democracies.
