Unmanaged Care: Towards Moral Fairness In Health Care Coverage, Sharona Hoffman Jul 2003

Unmanaged Care: Towards Moral Fairness In Health Care Coverage, Sharona Hoffman

Indiana Law Journal

Health insurers are generally guided by the principle of "actuarial fairness," according to which they distinguish among various risks on the basis of costrelated factors. Thus, insurers often limit or deny coverage for vision care, hearing aids, mental health care, and even AIDS treatment based on actuarial justifications. Furthermore, approximately forty-two million Americans have no health insurance at all, because most of these individuals cannot afford the cost of insurance. This Article argues that Americans have come to demand more than actuarial fairness from health insurers and are increasingly concerned about what I call "moral fairness." This is evidenced by …

Factless Jurisprudence, Darren Lenard Hutchinson Jul 2003

Factless Jurisprudence, Darren Lenard Hutchinson

UF Law Faculty Publications

Professor Terry Smith has written a very important work on the inadequacy of juridical approaches to antidiscrimination law in the context of Title VII litigation. Smith argues that the anti-retaliation provisions of Title VII can serve more broadly as a mechanism for protecting workers of color from prohibited racial discrimination. Smith contends that contemporary equality jurisprudence, however, impedes the protective scope of the anti-retaliation provision because courts fail to appreciate the broader context of racial antagonism in which persons of color live. Particularly, courts often misinterpret lawful racial protest in the workplace as disruptive and appropriately regulated to the detriment …

Chlorine Inactivation Of Adenovirus Type 40 And Feline Calicivirus, Jeanette A. Thurston-Enriquez, Charles N. Haas, Joseph Jacangelo, Charles P. Gerba Jul 2003

Chlorine Inactivation Of Adenovirus Type 40 And Feline Calicivirus, Jeanette A. Thurston-Enriquez, Charles N. Haas, Joseph Jacangelo, Charles P. Gerba

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Ct values, the concentration of free chlorine multiplied by time of contact with virus, were determined for free-chlorine inactivation experiments carried out with chloroform-extracted (dispersed) and non-chloroformextracted (aggregated) feline calicivirus (FCV), adenovirus type 40 (AD40), and polio virus type 1 (PV-1). Experiments were carried out with high and low pH and temperature conditions. Ct values were calculated directly from bench-scale free-chlorine inactivation experiments and from application of the efficiency factor Hom model. For each experimental condition, Ct values were higher at pH 8 than at pH 6, higher at 5°C than at 15°C, and higher for dispersed AD40 (dAD40) than …

Multilateral Environmental Agreements & World Trade, Melanie Nakagawa Jul 2003

Multilateral Environmental Agreements & World Trade, Melanie Nakagawa

PEEL Alumni Scholarship

In September 2003, the Fifth Ministerial Conference of the World Trade Organization (“WTO”) will meet in Cancun, Mexico. Cancun may provide an opportunity to reconcile many tensions between trade and the environment, although it seems likely that environmental concerns will remain marginalized. NGOs, governments, and other environmental agencies are eagerly waiting to see what happens at Cancun. At the Fourth WTO Ministerial Conference in Doha, Qatar, governments mandated the WTO to unilaterally clarify the relationship between trade rules and trade measures that enforce MEAs. The Doha mandate, however, established that the outcome of any negotiations “shall not diminish the rights …

Epa’S Administrative Compliance Orders Ruled Unconstitutional, Mary Margaret Mccleroy Jul 2003

Epa’S Administrative Compliance Orders Ruled Unconstitutional, Mary Margaret Mccleroy

PEEL Alumni Scholarship

On June 24, 2003, the Eleventh Circuit Court of Appeals declared the Environmental Protection Agency’s (“EPA”) authority to issue legally binding administrative compliance orders (“ACOs”) unconstitutional. This decision could foreshadow a broader movement to weaken EPA’s ability to enforce the broad range of environmental and public health statutes that it is responsible for implementing. While this decision undermines EPA’s ability to enforce ACOs, it does not leave EPA completely helpless to enforce environmental laws.

Shared Knowledge, Shared Jurisprudence: Learning To Speak Environmental Law Creole (Criollo), Thomas T. Ankersen

UF Law Faculty Publications

The character of the legal and judicial systems in Latin America and the Caribbean is undergoing fundamental change. Traditionally weak judiciaries are emboldened, precedent as a jurisprudential decision-making tool has become increasingly important, the apparatus of administrative law has become more sophisticated and complex, and increasingly sophisticated reporting systems and the "globalization" of shared jurisprudence through contemporary communication media have all contributed to the development of law in the region. These broader systemic developments, though uneven and incomplete, have occurred in tandem with the emergence of environmental law as a unique and discrete body of law.

This Article traces several …

CRVAW Faculty Journal Articles

OBJECTIVE: We assessed the association between psychosocial stress and preinvasive cervical neoplasia development controlling for HR-HPV infection.

METHODS: This case-control study enrolled low-income women receiving family planning services at health department clinics. There were 59 cases with biopsy confirmed HSIL and 163 with low-grade SIL and 160 controls with normal cervical cytology. A modified SLE scale was used to measure stressful events and the perceived impact of the event in the prior 5 years. Unconditional logistic regression was used to assess SIL risk and stressful events scores and by subscales.

RESULTS: After adjusting for age, HR-HPV infection, and lifetime number …

Patterns Of Elite Faunal Utilization In Moundville, Alabama, H. Edwin Jackson, Susan L. Scott Jul 2003

Patterns Of Elite Faunal Utilization In Moundville, Alabama, H. Edwin Jackson, Susan L. Scott

Faculty Publications

In recent years, zooarchaeological research has begun to examine the roles of animals as part of the suite of symbols employed at the ongoing social, ceremonial, and political dynamics of prehistoric cultural systems. In the southeastern United States, studies of late prehistoric Mississippian chiefdoms have documented differences in species composition and meat cuts associated with particular social contexts of consumption-for instance, ceremonial feasting vs. private meals-and also with gross distinctions in social rank-elite vs. commoner. Differences in the latter reflect elite control of procurement as well as cultural rides that assign meanings to certain species, which in so doing regulates …

Archetypal Trials And The Management Of Dissent: Some Insights From Marketing Theory, Pnina Lahav Jul 2003

Archetypal Trials And The Management Of Dissent: Some Insights From Marketing Theory, Pnina Lahav

Faculty Scholarship

Recent marketing theory uses the Jungian concept of the archetype to design strategies for the improvement of product selling. Mark and Pearson propose that archetypes such as the ruler, the hero, the outlaw, and the sage are useful in promoting a product. This article suggests that the concept of archetypes as well as myths such as the Prometheus myth and the myth of the expulsion from Paradise, when combined with the insights offered by Mark and Pearson, may help in understanding the management of trials of dissent as well. The article presents seven motifs that recur in trials of dissent …

Children With Disturbances In Sensory Processing: A Pilot Study Examining The Role Of The Parasympathetic Nervous System., Roseann C. Schaaf, Lucy Jane Miller, Duncan Seawell, Shannon O'Keefe

Department of Occupational Therapy Faculty Papers

This study was a preliminary investigation of parasympathetic nervous system (PNS) functioning in children with disturbances in sensory processing. The specific aims of this study were to (1) provide preliminary data about group differences in parasympathetic functions, as measured by the vagal tone index, between children with disturbances in sensory processing and those without; (2) determine effect size and power needed for future studies; and (3) to lay the foundation for further examination of the relations of parasympathetic functioning and functional behavior in children with disturbances in sensory processing. Participants were 15 children, nine with disturbances in sensory processing and …
