Rogue Science, Maxwell Gregg Bloche Jan 2003

Rogue Science, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

This review essay considers the tension between the evidence-driven vision of science's mission and the fears of malicious use and terrible consequences that have come to the fore since the terrorist attacks of September 11, 2001. These fears have led some to call for government restrictions on the substance of scientific research and communication. In general, this approach is likely to do far more harm than good. But scientists need to take the problem of social consequences more seriously than they have so far. The author argues in this essay that in some circumstances, when rogue use of science can …

Vectoral Federalism, Scott Dodson Jan 2003

Vectoral Federalism, Scott Dodson

Faculty Publications

In this Article, I offer a new framework for understanding federalism. “Vectoral federalism” engages directional metaphors—horizontal and vertical—to group various federalism doctrines together into two principal groups.Horizontal federalism concerns the battle between the federal and the state governments for the power to regulate individuals. Vertical federalism concerns the federal government’s power to regulate states and the states’ concomitant power to resist this regulation. Viewing federalism doctrines as having vertical or horizontal vectors (or both) identifies their common justifications and characteristics, which can assist in understanding and in applying the principles of federalism. The directional synthesis also illuminates and helps to …

Studies On Potential Of Companion Crops In Managing The Diamondback Moth, Plutella Xylostella (L.) (Lepidoptera: Plutellidae) In Cabbage/Kale Cropping Systems In Kenya, Jacqueline Makatiani

All Master’s Theses

The diamondback moth (DBM), Plutella xylostella (L.) (Lepidoptera: Plutellidae) is a major pest and threat to brassica production in many parts of Africa. The adverse ecological and environmental effects as well as the cost of chemical pesticides that are commonly used in its control, besides the increasing resistance to chemicals makes it necessary to explore alternative control methods. Integrated Pest Management (IPM), being the emerging pest control paradigm, offers a number of options out of which biocontrol, companion cropping among others, have great potentials. This study investigated the potential of utilising companion vegetable crops as trap or repellent crops in …

Gender, Human Rights, And Peace Agreements, Christine M. Chinkin Jan 2003

Gender, Human Rights, And Peace Agreements, Christine M. Chinkin

Articles

I would first like to thank the organizers for the very great honor of being asked to present the annual Schwartz Lecture in 2002. It is especially apposite to discuss issues of international peace agreements in Ohio, not far from Dayton which is famous as the location of the process that brought an end to the war in Bosnia-Herzegovina. However this lecture is going to examine issues that were not explored at Dayton, that is, some relationships between gender, peace agreements, and international human rights. In addition, because the function of peace agreements in today's world has become the broader …

Mitigating The Negative Effects Of Stress In Space Flight: A Transactional Approach, Haydee Maria Cuevas Jan 2003

Mitigating The Negative Effects Of Stress In Space Flight: A Transactional Approach, Haydee Maria Cuevas

Publications

The primary goal of this theoretical paper is to highlight how a transactional approach to investigating stressor effects during space flight can lead to a greater understanding of the complex processes by which humans adapt psychologically and physically to the adverse conditions encountered in this extreme environment.Transactional approaches conceptualize stress as occurring in the nature of the "transaction" (Le., interaction) between the individual and the stimulus environment, emphasizing the role of cognitive appraisal (Le., perceived ability to cope with the situation). Interventions that positively influence this cognitive appraisal process may, therefore, lessen the experience of stress and optimize human performance …

Measuring Anger In A Prison Population Using The Anger Disorders Scale And The Personality Assessment Inventory, Michael R. Wydo Jan 2003

Measuring Anger In A Prison Population Using The Anger Disorders Scale And The Personality Assessment Inventory, Michael R. Wydo

PCOM Psychology Dissertations

In comparison with other emotions, such as anxiety and depression, the research literature on anger-related problems is lacking. Anger, and anger-related behaviors pose a critical problem to clinicians and researchers. The inability to identify and treat individuals with a propensity toward aggressive behavior is related to the insufficient empirical evidence defining anger as a diagnosable disorder. An ongoing argument has existed as to the causes and related concepts of anger and aggression. The present study validates a new assessment measure for anger and explores the correlation between prisoners' offense records and specific type of anger expression. The Anger Disorder Scale …

The following study investigates the Devereux Early Childhood Assessment Program (DECA). The DECA Program is designed to build resiliency in preschool children by increasing factors that have been found to be related to resiliency: initiative, self-control, and attachment. The study evaluated the short-term effectiveness of the DECA Program. Two Head Start Centers participated in the study. Pretest DECA rating scales were completed by the classroom teachers. For the next three months the experimental classrooms used …

Culture From Chaos: The Formation Of Social Norms From The Dynamic Self-Organization Of Individuals' Attitudes And Behavior, Jerry G. Cullum Jan 2003

Culture From Chaos: The Formation Of Social Norms From The Dynamic Self-Organization Of Individuals' Attitudes And Behavior, Jerry G. Cullum

Dissertations and Theses @ UNI

Top-down models of culture provide a useful although limited understanding of cultural content, formation, and change. Previous theorizing using bottom-up models help to explain why cultures exist and explain some of their content. Dynamic social impact theory (DSIT; Latane, 1996) expands on previous bottom-up models by proposing a concise mechanism for cultural content transmission and the dynamic outcome of this process. Furthermore, the catastrophe theory of attitudes (Latane & Nowak, 1994) suggests that the level of involvement of an issue will modify attitude change and therefore modify DSIT's predictions. The present study expanded on previous research to offer a more …

Affirming Brahimi: East Timor Makes The Case For A Model Criminal Code, Megan A. Fairlie Jan 2003

Affirming Brahimi: East Timor Makes The Case For A Model Criminal Code, Megan A. Fairlie

Faculty Publications

In August of 2000, the Report of the Panel on United Nations Peace Operations (the “Brahimi Report”) considered the issue of transitional civil administration as an element of United Nations field operations. The Brahimi Report recommended the creation of an interim legal code as part of a U.N. justice package so that any future UN transitional administrations would be able to address the issue of “applicable law” in the early stages of its mission. Using the experience of the United National Transitional Administration in East Timor (UNTAET) as a case study, this article establishes how and why a complete model …

Accountants Make Miserable Policemen: Rethinking The Federal Securities Laws, Jerry W. Markham Jan 2003

Accountants Make Miserable Policemen: Rethinking The Federal Securities Laws, Jerry W. Markham

Faculty Publications

This Article describes the background of the federal securities laws and the assumptions about full disclosure that where made to justify the intrusive legislation. It also considers the problems encountered by the SEC in the nearly seven decades that have passed since the Stock Market Crash of 1929 and then reviews the market meltdown over the last three years and describes how full disclosure regulation failed. Finally, the author focuses on a principal flaw in the system – the misguided effort to turn accountants into policeman.

A Question Of Sanity: Women And In/Sanity In Bessie Head’S A Question Of Power And Sylvia Plath’S The Bell Jar, Amanda Lynn Graeber

Dissertations and Theses @ UNI

The use of female mental illness in fiction has previously been characterized as a subversive act. Theorists such as Juliet Mitchell, Susan Gubar, and Sandra Gilbert have advocated the use of madness as a way of protesting patriarchal systems and language. Female madness in many cases has been viewed not only as a conscious choice, but as an option that is preferable to sanity. In their view, mental illness is an embodiment of a woman's rejection of the patriarchal order. I would suggest that mental illness is actually about powerlessness. The madwoman is placed in a space outside of normal …

Einstein On The Bench?: Exposing What Judges Do Not Know About Science And Using Child Abuse Cases To Improve How Courts Evaluate Scientific Evidence, Joelle A. Moreno Jan 2003

Einstein On The Bench?: Exposing What Judges Do Not Know About Science And Using Child Abuse Cases To Improve How Courts Evaluate Scientific Evidence, Joelle A. Moreno

Faculty Publications

It has been a decade since the Supreme Court made judges the arbiters of scientific validity through Daubert v. Merrell Dow Pharmaceuticals, Inc. Although this decision was intended to improve how courts use science, recent empirical evidence reveals that judges continue to struggle with scientific evidence and that Daubert has failed to yield accurate or consistent decisions. This also means that judges have received little useful guidance from ten years of academic literature expounding on the science-law chasm.

If the academic discourse is not helpful, it may be because non-scientists too often try to tame science by treating it as …
