Putting Health Care Providers At A Loss And Consumers At Risk: Why Hmos Should Be Held Accountable For The Financial Instability Of Their Delegated Networks., Anish P. Michael

This Comment explores why health maintenance organizations (HMOs) such as PacifiCare should be held accountable for the financial instabilities of their delegated networks. Part II discusses the organization of the managed care system and the assessment of Texas laws currently enforcing managed care in the state. Incorporated in this discussion is a look at the risks delegated networks bear when contracting with HMOs to provide payment for individualized care. Part III analyzes the increasing trend of financial instability by presenting the views of the HMOs, the delegated networks, the health care providers, and the consumers enrolled in the health plan. …

The subject I was asked to think about with you today is raised by a very large change in the focus of biomedical research. In raw percentage terms, the animals involved in experimentation are now overwhelmingly rats and mice, and, perhaps because they are rats and mice, they are used in large numbers, numbers in thousands and tens of thousands at some institutions. "Corporate responsibility" is not a peripheral matter. It is at the core of all decision-making on behalf of business corporations under American law. This paper examines the effort to add an exemption for "business" in corporate form to the exemptions from ordinary responsibility that are seen in other areas of activity - e.g., for the military, for lawyers in adversarial litigation, or for investigators in scientific research. Advances in fundamental biomedical research play an important and growing role in the development of new therapeutic and diagnostic products. Although the development of pharmaceutical end products has long been a proprietary enterprise, biomedical research comes from a very different tradition of open science. Within this tradition, long-standing norms call for relatively unfettered access to fundamental knowledge developed by prior researchers. The tradition of open science has eroded considerably over the past quarter century as proprietary claims have reached farther upstream from end products to cover fundamental discoveries that provide the knowledge base for future product development.

Fathers and mothers (N = 75 dual-earner couples) of preschool-aged children completed questionnaires that examined work and family variables as related to paternal involvement in three areas: engagement (i.e., directly interacting with the child), responsibility (i.e., scheduling activities and being accountable for the child's well-being), and accessibility (i.e., being available to the child but not in direct interaction). Fathers' reports of responsibility and accessibility were significantly predicted by structural variables and beliefs; however, fathers' reports of engagement were not predicted by work and family variables. Mothers' reports of work and family variables did not predict their reports of father involvement. …

Privacy Lost: Comparing The Attenuation Of Texas's Article 1, Section 9 And The Fourth Amendment., Kimberly S. Keller

The Fourth Amendment to the United States Constitution requires that all searches and seizures be reasonable. Article I, Section 9 of the Texas Constitution mirrors its federal counterpart, requiring reasonableness in regard to intrusive governmental action. In examining these texts, both the federal and state provisions are comprised of two independent clauses: (1) the Reasonableness Clause, which prohibits unreasonable searches and seizures; and (2) the warrant clause, which provides that warrants may issue only upon a showing of probable cause. From the beginning of the law and economics movement, normative legal economists have focused almost exclusively on evaluating the efficiency of alternative legal rules. The distributional consequences of legal rules, therefore, have largely been ignored. It is tempting to conclude that legal economists are hostile or indifferent to concerns of distributional fairness. In fact, however, the discipline of economics has a great deal to say about distributional policy. The normative branch of economics, known as welfare economics, has always been deeply concerned with distributional issues. The variation of the mannose-binding protein (MBP) gene and the role of lectins during infection in mosquitoes were investigated using genomic DNA approach based on sequencing of the gene and the levels of its expression determined using semi-quantitative Reverse Transcriptase Polymerase Chain Reaction (RT-PCR) approach. Using shotgun cloning ~trategy, sequences were determined from cloned PCR products obtained from genomic DNA of An.gambiae, s.s, An. arabiensis and An. funestus and aligned following amino acid translation. BLAST program revealed that MBP-M 1, MBP-13 and MBP 15 clones showed high homology, with Anopheles protein precusor A 16 (Accession 093118). These results were further …

Malaria is responsible for significant morbidity and mortality, particularly among children in sub-Saharan Africa. In this area, estimates of symptomatic malaria range from one to five episodes per child per year, while deaths attributable to malaria are estimated at between 0.5 to 2.0 million, annually. Annual global clinical cases are estimated at 300-500 million with 90% of the cases in sub-Saharan Africa. Malaria remains intractable throughout most of its range, in part due to the evolution of behaviours maximizing contact of some Anopheles vectors with the human host while minimizing the risk of mosquito mortality. In a defeat for staunch property rights advocates, the Supreme Court ruled this spring that a prohibition on land development in the Tahoe basin did not amount to a de facto taking of land such that the constitutional mandate of just compensation was triggered. The Tahoe decision highlights the struggle in eminent domain jurisprudence over the proper treatment of so-called regulatory takings. The intra-articular injection of high molecular weight hyaluronic acid (HA) has been reported to be an effective treatment for pain of osteoarthritis of the knee. However, the mechanism by which HA exerts its effect is unknown. To explore HA's influence on the growth of U937 human macrophages, cells were incubated for 168 h with three concentrations, 1, 0.1 and 0.01 mg/mL, of Hyalgan®, a high molecular weight HA preparation. At 24-h increments, the cells were examined for proliferation, cell cycle distribution as well as the number of apoptotic and dead cells. The aim of this study was to determine the diagnostic importance of erythrocyte glutathione peroxidase activity (GSH-Px) in lambs with white muscle disease (WMD) and the changes in some serum parameters (glucose, creatinine, total protein, albumin, cholesterol, triglyceride, Ca, inorganic P, Na, K, Cl, AST, ALT, ALP, LDH and CPK) in healthy and white muscle diseased lambs. The research was carried out on 32 lambs of which 22 showed clinical symptoms and 10 were healthy from 280 lambs raised around Esenyurt-İstanbul. The aim of the study was to determine the effects of different silage additives on the ruminal degradability of sorghum silage. Serological And Microbiological Investigation On Turkey Rhinotracheitis Virus (Trtv) Infection Of Chickens And Turkeys, Yavuz Çokal, Ayşi̇n Şen

A total of 426 serum samples were examined from 9 broiler and 7 broiler breeder flocks showing clinical signs of swollen head syndrome (SHS). Turkey rhinotracheitis virus antibodies in 8 broiler flocks were between 31.8 and 75.9% and in broiler breeder flocks between 5.4 and 48.6%, with a commercial ELISA. Typical clinical symptoms were observed for SHS in broilers and broiler breeders. During the study, turkey flocks showing clinical signs were not detected. The antibodies to TRTV were between 5.5 and 80.0% in 7 out of 10 broiler flocks, and between 20.0 and 57.1% in 3 out of 4 fattening …
