Appraisal Processes In Emotion, Phoebe C. Ellsworth, Klaus R. Scherer Jan 2003

Appraisal Processes In Emotion, Phoebe C. Ellsworth, Klaus R. Scherer

Book Chapters

Usually, people's emotions arise from their perceptions of their circumstances-immediate, imagined, or remembered. This idea has been implicit in many philosophical treatments of emotions (e.g., in Aristotle, Spinoza, and even Descartes and James; see Ellsworth 1994a; Gardiner, Clark-Metcalf, & Beebe-Centa, 1980; Scherer, 2000) and explicit in some (e.g., Hume and Hobbes), and it is the central emphasis of current appraisal theories of emotion. Thinking and feeling are inextricably interrelated most of the time: Certain ways of interpreting one's environment are inherently emotional, few thoughts are entirely free of feelings, and emotions influence thinking. Reason and passion are not independent domains, …

The Dormant Commerce Clause And The Hormones Problem, Donald H. Regan Jan 2003

The Dormant Commerce Clause And The Hormones Problem, Donald H. Regan

Book Chapters

It is obvious that no anti-discrimination regime can stop at forbidding explicit discrimination of the relevant sort. If only explicit discrimination is forbidden, lawmakers who want to discriminate can hide their discriminatory intentions behind facially neutral classifications that are nonetheless chosen because they differentially burden the protected class. So, we must be prepared to invalidate some facially neutral laws that have "discriminatory effect" or, as American lawyers often call it, "disparate impact." On the other hand, we cannot possibly invalidate all laws which have a disparate impact on a protected class; many perfectly reasonable laws adopted for completely innocent purposes …

Reaching Through The Genome, Rebecca S. Eisenberg Jan 2003

Reaching Through The Genome, Rebecca S. Eisenberg

Book Chapters

The past two decades have been a period of rapid evolution in the science of biotechnology and therefore in patent strategies, if not in patent law itself. Patent law takes a long time to catch up with science, and commentators take a long time to catch up with the law, but patent lawyers don’t have that luxury. They have to keep ahead of the game, figuring out claiming strategies that allow their clients to capture the value of future discoveries. I want to discuss some of these strategies today.

Un/Braiding Stories About Law, Sexuality And Morality, Margaret E. Montoya Jan 2003

Un/Braiding Stories About Law, Sexuality And Morality, Margaret E. Montoya

Faculty Scholarship

Traditional doctrine insists that we tame sexual desire by pretending that goodness and Godliness is defined by celibacy and abstinence, but the Church is simply wrong to insist that we accept a theology that negates and silences and suppresses a central part of our lives. To the extent that we believe in a life after death, many of us have won a chance at Heaven not by denying and suppressing our sexuality but by struggling to develop our capacity to experience joy through sexual desire and to honor the responsibility of not generating misery for ourselves and others through that …

The Predicament Of The Immigrant Victim/Defendant: "Vawa Diversion" And Other Considerations In Support Of Battered Women, Zelda B. Harris Jan 2003

The Predicament Of The Immigrant Victim/Defendant: "Vawa Diversion" And Other Considerations In Support Of Battered Women, Zelda B. Harris

UC Law SF Journal on Gender and Justice

While the struggle to combat domestic violence has made many gains over the last thirty years, some low-income women of color have been left behind. Mandatory misdemeanor domestic violence prosecution policies are periodically used against the victims of domestic violence. Particularly in the case of immigrant victim/defendants, arrest, prosecution, or conviction for a domestic violence misdemeanor at the command of rigid mandatory arrest and prosecution laws can result in significant unintended consequences, including increasing a batterer's power and control over the victim. This article examines those consequences in the context of southern Arizona. Discretionary prosecution policies, referral to immigration and …

Battered By The System: How Advocates Against Domestic Violence Have Improved Victims' Access To Child Support And Tanf, Naomi Stern Jan 2003

Battered By The System: How Advocates Against Domestic Violence Have Improved Victims' Access To Child Support And Tanf, Naomi Stern

UC Law SF Journal on Gender and Justice

For low-income women and their children who are survivors of domestic violence, the political and legal landscape at the federal level worsened with the enactment of the 1996 Welfare Act. Among many other changes, the Act increased penalties for mothers who fail to cooperate with their respective states in states' efforts to obtain child support from their children's father. As a result, many victims of domestic violence who seek child support and who are leaving their abusers often must choose between poverty and increased violence at their abusers' hands. The voices of state and local advocates against domestic violence are …

Embryonic Stem Cell Research Controversy: Focus On The Private Sector And International Sphere, Sylvia Kim Jan 2003

Embryonic Stem Cell Research Controversy: Focus On The Private Sector And International Sphere, Sylvia Kim

UC Law SF Journal on Gender and Justice

Despite its tremendous potential for curing various maladies, embryonic stem cell research has not received full funding support from the federal government due-to intense ethical debate surrounding the status of embryos. While the United States has been busy grappling with ethical issues, the private sector and the rest of the world have been making significant progress without stringent government oversight. This Note demonstrates the likely consequences of current federal and state regulations in the U.S. regarding stem cell research and the need for adequate safeguards. Because withholding government funds from stem cell research does not eliminate moral and ethical objections, …

Serious Mental Illness And The Family: How Can Mental Health Professionals Help?, Cynthia Pattillo Jan 2003

Serious Mental Illness And The Family: How Can Mental Health Professionals Help?, Cynthia Pattillo

Perspectives In Learning

When a loved one is diagnosed with serious mental illness (Schizophrenia, Bipolar Disorder, Schizoaffective Disorder, or Major Depression) family members are faced with new challenges. The family must provide support, act as an advocate with treatment providers, tolerate unpredictable and unusual behaviors, and, in some cases, involve the legal system to achieve inpatient hospitalization or mandate treatment. The family must also grieve for the losses caused by the illness: loss of goals and dreams, loss of abilities, loss of health. Unfortunately, the family must also cope with the stigma of mental illness. Despite evidence to the contrary, our society continues …

Occurrence Of Ovotestes And Plasma Vitellogenin In Feral Male Fathead Minnows From Lagoons Of Municipal Wastewater Treatment Facilities In Central Iowa, Robert B. Bringolf, Robert C. Summerfelt Jan 2003

Occurrence Of Ovotestes And Plasma Vitellogenin In Feral Male Fathead Minnows From Lagoons Of Municipal Wastewater Treatment Facilities In Central Iowa, Robert B. Bringolf, Robert C. Summerfelt

Journal of the Iowa Academy of Science: JIAS

Since the early 1990s, endocrine disrupting compounds have been recognized as an important environmental threat. Male fish exposed to effluent from large, metropolitan municipal wastewater treatment facilities (WWTFs) have developed reproductive abnormalities including ovotestes and elevated levels of plasma vitellogenin (Vtg), a plasma protein typically produced by egg-laying females. In the summer of 2000, gonads and plasma Vtg concentrations were examined in feral male fathead minnows (Pimephales promelas) collected from lagoons of 11 small, rural municipal WWTFs and a reference site (a national wildlife refuge) in Iowa. Fathead minnows were captured in traps from five of the 33 lagoons (three …

Salt Tolerance Of Sunflower And Lettuce In Cultivated And Uncultivated Grass Soil, Steven H. Emerman, Emily M. Kinsinger Jan 2003

Salt Tolerance Of Sunflower And Lettuce In Cultivated And Uncultivated Grass Soil, Steven H. Emerman, Emily M. Kinsinger

Journal of the Iowa Academy of Science: JIAS

We tested two hypotheses: 1) whether a vegetable crop will show greater growth under a given salinity treatment in an uncultivated grass soil than a cultivated soil and 2), if so, whether the greater growth is due to the occasional presence of relatively fresh water in macropores or the interaction between salinity and hypoxia in a soil without significant macropores. A previous study suggested uptake from. macropores was significant only for crops with high root water potential (Emerman and Dawson 1997). Hence, in this study, 21 miniature crops were grown in a greenhouse, and the ratio of root dry weight …

Estimating Estuarine Pollutant Loading From Atmospheric Deposition Using Casco Bay, Maine As A Case Study, Casco Bay Air Deposition Study Team, Catherine Richardson, Douglas Saball, Andy Johnson, David Wright, Diane Gould, Alan Vanarsdale, Jeri Weiss, Beverly Bayley Smith, Ellen Doering

Publications

This paper provides a simple method for estimating the annual rate of direct atmospheric deposition of pollutants to an estuary when little or no local monitoring data is available. The approach we describe uses relevant regional data as well as literature values. The Casco Bay Estuary, located in the southwestern Maine, is used as a case study. The paper also includes the results of a field air deposition monitoring program conducted in Casco Bay (1998 - 2000) and favorably compares the estimates developed for rate of deposition of nitrogen, mercury and PAHs to the field monitoring results. The estimation approach …
