A Tripartite Threat To Medical Records Privacy: Technology, Hipaa's Privacy Rule And The Usa Patriot , Nathan J. Wills
Journal of Law and Health
Proceeding from the proposition that privacy is a fundamental right, this essay notes the importance of maintaining medical records privacy in light of the increased use of technology. It describes the Privacy Rule promulgated under HIPAA, which was intended to strengthen medical records privacy, but notes the restriction of privacy rights following September 11, 2001 ("9/11"). In light of circumscribed privacy rights, the Privacy Rules becomes much more important in protecting medical records privacy. Unfortunately, the Rule falls short of this goal by potentially running afoul of the First and Fourth Amendments. It also fails to provide adequate medical records …
A Healer Or An Executioner - The Proper Role Of A Psychiatrist In A Criminal Justice System, Gregory Dolin
A Healer Or An Executioner - The Proper Role Of A Psychiatrist In A Criminal Justice System, Gregory Dolin
Journal of Law and Health
This article argues that despite the benefits of ridding the criminal justice system of some uncertainty and ignorance with respect to mental health issues, the very close involvement of psychiatrists in the criminal justice system as practiced in the United States is not only illogical and bad policy, but also unethical from the viewpoint of medical ethics. Part II of this article will lay the groundwork for the argument by discussing the history of the insanity defense, and of science's involvement with criminal justice; while Part III, will look into the association of science and the administration of justice in …
Death By Any Other Name: The Federal Government's Inconsistent Treatment Of Drugs Used In Lethal Injections And Physician-Assisted Suicide, Colin Miller
Journal of Law and Health
While the FDA is under no legal obligation to regulate the drugs used in executions, these recent developments certainly create a moral imperative requiring review. This paper will argue that the federal government cannot consistently refrain from regulating lethal injection drugs while arguing for prosecution of those prescribing drugs to be used by patients in assisted suicide. Part II will look at the opinions in Chaney and the factors behind the FDA's decision not to regulate the drugs used in executions. Part III will look at Oregon's Death with Dignity Act and its authorization by the Supreme Court. Parts IV-VI …

Prohibiting Procreation: A Step In The Right Direction To Protect The Children Of Deadbeat Dads; An Analysis Of The Court Decision In State V. Oakley, Andrea C. Kryszak
Journal of Law and Health
This note will entail an in-depth analysis of the Wisconsin Supreme Court's majority opinion and the dissent. This note will also provide support for the majority opinion by evaluating how the court's decision will help protect the children of individuals like Oakley, who intentionally refuse to support them. While some may claim that the probation condition to prohibit Oakley from procreating was a drastic measure, it was the appropriate measure for the court to take. This sentence will serve as a deterrent to Oakley and other fathers who intentionally refuse to support their children. The probation condition will prevent any …

The Advertising Agency's Role In Marketing Communication Demand Creation, Barbara Pellow, Patricia Sorce, Franziska Frey, Lauren Oslon

Early adopters of digital color printing have consistently been told that they need to educate the advertising agency market to drive digital color print volume. Experience has yielded mixed results for digital color printers who have taken this approach. There have been several hypotheses suggested why agency education has had limited value, including: the price/value equation for digital color printing, limited availability of accurate data for targeted marketing campaigns, and relative lack of use of return on investment metrics for one-toone marketing. As part of the industry analysis effort for the digital color market, the Printing Industry Center at RIT …

Digital Integration And The Lean Manufacturing Practices Of U.S. Printing Firms, Frank Cost, Brett Daly
Books
The printing industry is in the midst of a transformation that can best be understood with reference to the metaphor of the “perfect storm.” Four forces—digitization, standardization, the rise of the Internet, and globalization leading to increased competition—have combined to create the storm. The storm is destroying many companies in its path. Other companies are learning how to ride through it and harness its awesome power to their best advantage. Technology can play a critical role in reducing the costs of business and manufacturing processes. But the acquisition of new technology in the absence of a disciplined approach to process …

A Case-Based Reasoning System For Classifying Malay Traditional Herbs / Ismaily Johari, Johari Ismaily
Student Works (2000-2009)
The purpose of this project is to develop a system using case-based reasoning to classify the various types of Malay Traditional herbs. The task of classifying Malay Traditional herbs had always been done by botanist. Malay Traditional herbs practitioner, herbalists and people interested on the herbs. The classification were usually done by identifying the physical attributes of the herbs, based on the features of its leaf, root, flower, fruit and stem. Each of them owns its own unique physical features making the process of classifying essential to determine the type of the herbs. This project focuses on the methods of …
Musculoskeletal Rehabilitation For Breast Cancer Post-Reconstruction Surgeries, Kristin Arialis
Musculoskeletal Rehabilitation For Breast Cancer Post-Reconstruction Surgeries, Kristin Arialis
Honors Capstones
I have proposed a set of musculoskeletal rehabilitation protocols for the different types of post-reconstruction surgeries for breast cancer patients. Breast cancer is the leading cause of cancer deaths among women ages 40-59. Most breast cancer disease patients require a mastectomy procedure in which the entire breast tissue is removed. In addition, many women opt to have the missing breast reconstructed, using tissue from another part of their body to supplement the breast tissue taken out during the mastectomy. Since muscle tissue is removed from one part ofthe body and transposed to another part ofthe body, it is important to …

Cutting Through The Confusion Of The Loss-Of-Chance Doctrine Under Ohio Law: A New Cause Of Action Or A New Standard Of Causation, George J. Zilich
Cutting Through The Confusion Of The Loss-Of-Chance Doctrine Under Ohio Law: A New Cause Of Action Or A New Standard Of Causation, George J. Zilich
Cleveland State Law Review
The central argument advanced in this Note is that a loss of chance should be recognized as an independent injury. This approach best serves the policy of the new loss of chance doctrine, and it avoids the very significant doctrinal problems that arise if the alternative approach is taken, which is to treat the compensability of lost chances as merely a relaxation of traditional tort law causation requirements. The primary focus of this Note is on the loss of a less-than-even chance of recovery or survival, wherein a victim will be entitled to damages resulting from the negligent reduction of …

The Feminist And The Socialist: Adele And Alphonse Esquiros, Naomi J. Andrews
The Feminist And The Socialist: Adele And Alphonse Esquiros, Naomi J. Andrews
History
Among the many strands of political and intellectual dissidence during the July Monarchy, socialism and feminism must be counted as two of the most ephemeral and, paradoxically, the most enduring. Romantic socialism of the 1830s and 1840s saw a profusion of fantastical aspirations crushed by the failure of the revolution of 1848, and the brief flowering of feminism during the period was cut short by the social and political repression of the Second Empire. Their influence is still felt, though these original incarnations were short lived. For the duration of the July Monarchy and the Second Republic, however, both socialism …

RNA silencing in plants likely exists as a defense mechanism against molecular parasites such as RNA viruses, retrotransposons, and transgenes. As a result, many plant viruses have adapted mechanisms to evade and suppress gene silencing. Tombusviruses express a 19 kDa protein (p19), which has been shown to suppress RNA silencing in vivo and bind silencing-generated and synthetic small interferingRNAs (siRNAs) in vitro. Here we report the 2.5 A° crystal structure of p19 from the Carnation Italian ringspot virus (CIRV) bound to a 21 nt siRNA and demonstrate in biochemical and in vivo assays that CIRV p19 protein acts as molecular …

Structures of the DNA sequences d(CCGGCGCCGG) and d(CCAGTACbr5UGG) are presented here as four-way Holliday junctions in their compact stacked-X forms, with antiparallel alignment of the DNA strands. Thus, the ACC-trinucleotide motif, previously identified as important for stabilizing the junction, is now extended to PuCPy, where Pu is either an adenine or guanine, and Py is either a cytosine, 5-methylcytosine, or 5-bromouracil but not thymine nucleotide. We see that both sequence and base substituents affect the geometry of the junction in terms of the interduplex angle as well as the previously defined conformational variables, Jroll (the rotation of the stacked duplexes …

It is now established that the hypothalamus is essential in coordinating endocrine, autonomic, and behavioral responses to changes in energy availability. However, the interaction of key peptides, neuropeptides, and neurotransmitters systems within the hypothalamus has yet to be delineated. Recently, we investigated the mechanisms through which serotonergic (5-hydroxytryptamine, 5-HT) systems recruit leptin-responsive hypothalamic pathways, such as the melanocortin systems, to affect energy balance. Through a combination of functional neuroanatomy, feeding, and electrophysiology studies in rodents, we found that 5-HT drugs require functional melanocortin pathways to exert their effects on food intake. Specifically, we observed that anorectic 5-HT drugs activate pro-opiomelanocortin …

Hypothalamic proopiomelanocortin (POMC) neurons are critical for controlling homeostatic functions in the mammal. We used a transgenic mouse model in which the POMC neurons were labeled with enhanced green fluorescent protein to perform visualized, whole-cell patch recordings from prepubertal female hypothalamic slices. The mouse POMC-enhanced green fluorescent protein neurons expressed the same endogenous conductances (a transient outward K current and a hyperpolarization-activated, cation current) that have been described for guinea pig POMC neurons. In addition, the selective -opioid receptor agonist DAMGO induced an outward current (maximum of 12.8 1.2 pA), which reversed at K equilibrium potential (EK), in the majority …

C75, a recently derived compound that potently suppresses feeding and induces weight loss, has been proposed to act mainly by inhibiting fatty acid synthase (FAS) in central neurons that control feeding. For example, normal, fasting- associated, hypothalamic increases in neuropeptide Y (NPY)/Agouti-related protein (AGRP) expression and decreases in proopiomelanocortin (POMC)/cocaine and amphetamine regulated transcript (CART) expression were reported to be blocked by C75. Using loose-patch extracellular recording in acute slices, we tested the effect of C75 on anorexigenic POMC neurons and orexigenic NPY neurons of the hypothalamic arcuate nucleus, which were identified by promoter-driven GFP expression, as well as on …

The neurotoxin lead (Pb2+) is a continuing health and environmental problem. However, its neurotoxic mechanism remains unclear. Since calcium (Ca2+) is vital in cellular processes and with Pb2+ reported to interfere with Ca2+-mediated processes, the hypothesis that Pb2+ subverts Ca2+ homeostasis by entering cells through Ca2+ transport pathways and displacing intracellular Ca2+ ([Ca2+] i) was investigated. A multi-technique approach tested this hypothesis. Using cultured Aplysia bag cell neurons, changes in transmembrane Ca2+ flux after Pb2+ exposure were directly measured with the Ca2+-selective self-referencing electrode. Cumulative concentrations of extracellular Pb2+ produced a corresponding and significant (P < 0.05) increase in Ca 2+ efflux, independent of time exposure. Ca2+ channel blockers Co2+, La3+, and verapamil inhibited Pb2+-induced flux. The sarco/endoplasmic reticulum Ca 2+-ATPase pump inhibitors, thapsigargin and cyclopiazonic acid, both elicited a Ca2+ efflux reflecting inhibition of ER pumps and [Ca2+]i release. Furthermore, Pb2+ evoked a moderate and sustained elevation in thapsigargin-stimulated Ca 2+ efflux. For morphological evidence that Pb2+ can mobilize [Ca 2+]i, potassium pyroantimonate (KPA) cytochemistry of bag cells were analyzed. 2% KPA resulted in widespread electron-dense precipitates. 10 mM EGTA + KPA or 200 μM Pb2+ + KPA both produced marked reductions of precipitates in neurons. X-ray microanalysis confirmed antimony (Sb) in precipitates but could not separate the overlapping Ca2+-Sb spectral peaks. However, reduced precipitates in EGTA-incubated cells indicate presence of Ca2+ in intracellular precipitates observed. No apparent pathological changes were correlated to Pb2+ exposure. The effects of Pb2+ on [Ca2+]i using the fluorescent Ca2+ indicator, chlortetracycline (CTC), was examined. Control neurons incubated in 10 μM CTC demonstrated extensive yellow-green fluorescence while reduced fluorescence intensities were seen in cells exposed to 200 μM Pb2+. Multi-sized punctate fluorescence were observed along the perimeter and sometimes, throughout the soma. No neuronal autofluorescence nor neuritic fluorescence in control and Pb2+-exposed cells were detected. Average fluorescence intensities between control and Pb2+-exposed neurons were statistically significant (P < 0.0005). Collectively, these results are consistent with the hypothesis that Pb 2+ perturbs Ca2+ homeostasis via mobilization of [Ca 2+]i. Pb2+ operates through Ca2+ transport pathways as shown by changes in transmembrane Ca 2+ flux, in KPA precipitate reactions, and in CTC fluorescence.
