The New Leviathan, Dennis Patterson May 2003

The New Leviathan, Dennis Patterson

Michigan Law Review

Reputation in any field is an elusive phenomenon: part notoriety, part honor, part fame, part critical assessment. Even in legal scholarship it has an uneven, unpredictable quality. It is hard to imagine a book by a law professor that has had more immediate impact on world leaders than Philip Bobbitt's The Shield of Achilles. Much of the national-security strategy devised by the U.S. administration after the September 11 attacks expresses ideas Bobbitt conceived long before; and from a different point on the political spectrum is the Archbishop of Canterbury, whose televised nationwide address in January explicitly took the book as …

Consuming Government, Richard Schragger May 2003

Consuming Government, Richard Schragger

Michigan Law Review

In his ambitious new book, William Fischel, a Professor of Economics at Dartmouth College, gives us a new political animal: "The Homevoter." The homevoter is simply a homeowner who votes (p. ix). According to Fischel, she is the key to understanding the political economy of American local government. By implication, she is the key to understanding state and national government as well. Homeowners warrant special attention because "residents who own their own homes have a stake in the outcome of local politics that make them especially attentive to the public policies of local government" (p. ix). That is because local …

Disease And Cure?, L. A. Powe Jr. May 2003

Disease And Cure?, L. A. Powe Jr.

Michigan Law Review

Sunstein uses Franklin's remark to make two related points. First, citizens bear the burden of maintaining the American republic as a healthy, vibrant place; being a citizen is decidedly different from being a consumer. The former has duties, the latter wants (pp. 113-23). Second, and this is the gist of the slender book, the republic is jeopardized by the possibilities of the Internet. Sunstein assumes the correctness of MIT technology specialist Nicholas Negroponte's conclusion that in the not-too-distant future we will be able to create a "Daily Me" on the Internet that will provide the personalized information (including news) that …

The Arrangements Of Race, Frank H. Wu May 2003

The Arrangements Of Race, Frank H. Wu

Michigan Law Review

In his debut novel, Stephen Carter takes pains to explain that although he and his protagonist, Talcott Garland (who goes by "Misha"), share superficial aspects of their identities, they should not be confused as twins. Carter and Misha may both be middle-aged professors at prestigious East Coast universities who grew up as members of the African-American elite that summered on Martha's Vineyard as segregation was officially ending; and they may both be passionate about chess. Beyond that, however, they are dissimilar. Carter drives no faster than the speed limit and otherwise leads a life that appears to be boring beyond …

Validation Of A Radiometric Normalization Procedure For Satellite-Derived Imagery Within A Change Detection Framework, Karin E. Callahan May 2003

Validation Of A Radiometric Normalization Procedure For Satellite-Derived Imagery Within A Change Detection Framework, Karin E. Callahan

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Detecting changes in land cover through time using remotely sensed imagery is a powerful application that has seen increased use as imagery has become more widely available and inexpensive. Before a time series of remotely sensed imagery can be used for change detection, images must first be standardized for effects outside of real surface change. This thesis established a validation protocol to evaluate the effectiveness of an automated technique for normalizing temporally separate but spatially coincident imagery. Using the concept of pseudo-invariant features between master-slave image pairs, spatially coincident dark and bright points are identified from images and a regression …

Understanding Utah's Native Plant Market: Coordinating Public And Private Interest, Virginia Harding Hooper May 2003

Understanding Utah's Native Plant Market: Coordinating Public And Private Interest, Virginia Harding Hooper

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Changes in Lone Peak Conservation Nursery customer profiles cause state nursery leaders to question what their products are being used for and how trends in native plant use are changing the market for Utah native plants. The Utah native plant market is changing as interest in native plants is expanding to meet new conservation objectives, oftentimes in urban settings. This newer demand for native plants appears to be motivated by current changes in urban conservation behavior, continued population growth in the arid West, scarcity of water resources, the increasing appreciation for indigenous plant aesthetics, and concern for bio-diversity. A survey …

Amenity Migration And Social Change: Expanding The Concept Of Community Attachment And Its Relationship To Dimensions Of Well-Being In The Rural West, Joan M. Brehm May 2003

Amenity Migration And Social Change: Expanding The Concept Of Community Attachment And Its Relationship To Dimensions Of Well-Being In The Rural West, Joan M. Brehm

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Most sociological analyses of community attachment have focused on the strength of attachment, with little concern for the qualities or attributes of a place to which people become attached. In cases where dimensions of attachment are the focus of analysis, the literature is rather narrowly focused on social dimensions, referring most often to connections with family, friends, and other social networks and largely ignoring the realm of natural environment factors. Two primary premises motivated this study. First, sociological understandings of community attachment would benefit from an expanded analytic framework that incorporates more complex arrays of both social and natural environment …

Sir Nicholas Throckmorton: A Diplomatic Advisor To Queen Elizabeth, Kenneth M. Kisner May 2003

Sir Nicholas Throckmorton: A Diplomatic Advisor To Queen Elizabeth, Kenneth M. Kisner

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

This study concentrates on Sir Nicholas Throckmorton, a resident ambassador sent to France in the first years of Elizabeth's reign. He had never held a high level government position before this time, but was remembered for his ability to give advice on matters of foreign policy. Typically historians have approached the subject of the Queen's policy from a top down perspective. This thesis attempts to redress this view by looking at how diplomacy was conducted through the eyes of a diplomat.

The culture of diplomacy created statesmen and foreign policy advisors out of the diplomats in Elizabeth's reign. Ambassadors and …

Using Geographic Information Systems And Remote Sensing To Analyze Fire Likelihood Areas At The Regional Scale In The Western United States, Russell W. Reading May 2003

Using Geographic Information Systems And Remote Sensing To Analyze Fire Likelihood Areas At The Regional Scale In The Western United States, Russell W. Reading

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Geographic Information Systems (GIS) are increasingly used to examine fire activity. This study uses GIS to determine fire likelihood probabilities at an intermediate scale ( I-kilometer) on a daily basis given readily available data. Layers used for the analysis included slope, aspect, elevation, fuel type, proximity to existing fires, maximum temperature, minimum temperature, relative humidity, average vapor pressure deficit, precipitation, 1-hour fuel moisture, and 10-hour fuel moisture.

There were three objectives of this study: 1. Establish a correlation between burn perimeters and readily available topographic and environmental data, and map the spatial distribution of these as fire likelihood areas; 2. …

Nature Writing And Healing: Recovering The Wild Soul, Denice H. Turner May 2003

Nature Writing And Healing: Recovering The Wild Soul, Denice H. Turner

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

In this study, I explored how nature writing could be seen as healing text. I described some common problems associated with the construction of trauma and grief narratives and examined how nature writers dealt with them. The study began with my frustration at being unable to write a healing narrative for myself and progressed as I integrated research that informed my own writing.

The literature I read included a variety of perspectives, from Jungian and traditional psychotherapy to current writing theory. I used the theory to comment on the nature writing texts as I discovered them. Using the words and …

Staking Out The Territory : The University Of Western Australia, The Diploma In Education And Teacher Training 1914-1956, Kaye Tully, Clive Whitehead May 2003

Staking Out The Territory : The University Of Western Australia, The Diploma In Education And Teacher Training 1914-1956, Kaye Tully, Clive Whitehead

Australian Journal of Teacher Education

The Diploma in Education has been a licence to teach in Western Australia since 1929. As an award made outside the State's education system, the history of the decision-making behind its institution has been overlooked. This article surveys some of the more important decisions made by The University of Western Australia as it staked out its territory in teacher education and training in the first half of the 20th Century. It suggests that the main motivation for such involvement by the University was to protect the quality of its matriculants, many of whom came from independent schools.

Complex Unfamiliar Entries In The Airport Context, Bill Brunger May 2003

Complex Unfamiliar Entries In The Airport Context, Bill Brunger

Student Scholarship

Airport managers tend to view airport efficiency through the lens of their own experience based on measurements of travelers' interactions with the airline after the traveler has entered the airport process. They ignore the times when the traveler is not empirically measurable, for example, the period between arrival at the airport and checks-in with the airline, and therefore miss important insight into how travelers cope with uncertainty and anxiety of the airport experience. In this paper, the author, an Airline Executive, suggests that ethnographic studies based on the techniques of rich observation, note-taking, coding, and inductive analysis will be a …

On Querying Geospatial And Georeferenced Metadata Resources In Gportal, Zehua Liu, Ee Peng Lim, Wee-Keong Ng, Dion Hoe-Lian Goh

Research Collection School Of Computing and Information Systems

G-Portal is a web portal system providing a range of digital library services to access geospatial and georeferenced resources on the Web. Among them are the storage and query subsystems that provide a central repository of metadata resources organized under different projects. In GPortal, all metadata resources are represented in XML (Extensible Markup Language) and they are compliant to some resource schemas de.ned by their creators. The resource schemas are extended versions of a basic resource schema making it easy to accommodate all kinds of metadata resources while maintaining the portability of resource data. To support queries over the geospatial …

Simulated Selves, Erika Gentry May 2003

Simulated Selves, Erika Gentry

Theses

In an increasingly virtual world, new identities that exist only in cyberspace are being created. Historically rooted, role-playing has been popular long before Shakespeare, and starting in the early 1990s, has moved into the computer. Now more than ever, it serves as a form of entertainment, escape and self-exploration to hundreds of thousands of people worldwide. In interactive, text-based computer games that are designed to represent fantasy worlds, players become authors not only of text but of themselves, constructing new selves through social interaction. On a MUD (Multi User Domain) game, places and selves are completely constructed through text. Thus, …

The Unique Jurisprudence Of Letters Of Credit: Its Origin And Sources, Gao Xiang, Ross P. Buckley May 2003

The Unique Jurisprudence Of Letters Of Credit: Its Origin And Sources, Gao Xiang, Ross P. Buckley

San Diego International Law Journal

This Article seeks to illumine the legal nature of the letter of credit instrument, and catalogue the various sources of law and rules that can govern it; and, by doing so, render a service to those who must quickly come to grips with letter of credit law. The Article is in two parts. The first part examines the legal nature of the letter of credit by looking at its definition, operation, and history and by comparing it with negotiable instruments and contracts. The second part considers the rules, customs, and regulations governing letters of credit and introduces the two fundamental …

The Applicability, Apprpriateness, And Enforcement Of The "Background Levels" Standard For Contaminated Sediment Cleanup Under California State Water Resources Control Board Resolution 92-49, Benjamin Benumof May 2003

The Applicability, Apprpriateness, And Enforcement Of The "Background Levels" Standard For Contaminated Sediment Cleanup Under California State Water Resources Control Board Resolution 92-49, Benjamin Benumof

San Diego Law Review

This Comment discusses the problem of contaminated sediments in ports and waterways and the scientific, technological, legal, and regulatory barriers to fixing the problem. The author begins by addressing whether California State Water Resources Control Board Resolution 92-49 is applicable to establishing cleanup levels for contaminated marine bay bottom sediments. Next, the author assumes that Resolution 92-49 is applicable and examines the boundaries of its enforcement and limitations of it application. The author then explores what standards Regional Boards might use for cleanup level decisions of bay bottom sediments if Resolution 92-49 was not applicable. The author then addresses whether …

Sequence Stratigraphy And Depositional Facies Of Lower Ordovician Cyclic Carbonate Rocks, Southern Missouri, U.S.A., Robert Brandon Overstreet, Francisca Oboh-Ikuenobe, Jay M. Gregg

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

Lower Ordovician cyclic carbonate strata of southern Missouri were deposited in a warm, shallow, epeiric sea on a fully aggraded carbonate platform. Sedimentological characteristics distinguish the Jefferson City and Cotter dolomites from the underlying Gasconade and Roubidoux formations. Mixed carbonate-siliciclastic sedimentation characterizes the Roubidoux Formation, with sandstones accounting for up to 60% of sedimentation. The Gasconade, Jefferson City, and Cotter dolomites exhibit an increased occurrence of chalcedonic chert nodules in very similar shape and texture to the gypsum and anhydrite nodules common on modern sabkha supratidal flats. Casts of halite and ghosts of gypsum laths also exist in the Jefferson …

Judicial Checks And Balances, Rafael La Porta, Florencio Lopez-De-Silanes, Cristian Pop-Eleches, Andrei Shleifer May 2003

Judicial Checks And Balances, Rafael La Porta, Florencio Lopez-De-Silanes, Cristian Pop-Eleches, Andrei Shleifer

Dartmouth Scholarship

In the Anglo-American constitutional tradition, judicial checks and balances are often seen as crucial guarantees of freedom. Hayek distinguishes two ways in which the judiciary provides such checks and balances: judicial independence and constitutional review. We create a new database of constitutional rules in 71 countries that reflect these provisions. We find strong support for the proposition that both judicial independence and constitutional review are associated with greater freedom. Consistent with theory, judicial independence accounts for some of the positive effect of common-law legal origin on measures of economic freedom. The results point to significant benefits of the Anglo-American system …

Conceptual And Application Issues In The Implementation Of Object-Oriented Gis, Janette Elizabeth Bennett May 2003

Conceptual And Application Issues In The Implementation Of Object-Oriented Gis, Janette Elizabeth Bennett

Graduate Theses, Dissertations, and Problem Reports (ETD)

The adoption of object-oriented technology for spatial data modeling is becoming a significant trend in GIS. This research explores the concepts of Object-Oriented GIS (OOGIS) and illustrates its versatility in two case studies. OOGIS provides a feature-based, intuitive representation of real world features. The study emphasizes the fundamental concepts of inheritance, polymorphism, and encapsulation in OOGIS and explores schema design, long transactions, and versioning. Further, the study discusses the advantages of OOGIS in the management and analysis of geospatial data. The case studies demonstrate both the conceptual basis of OOGIS and specific functionality including behavior, methods, versioning, long transactions and …

Macroinvertebrate Community Structure And Related Environmental Variables In Two Forks Of The Virgin River, Utah, Terence P. Boyle, Matthew J. Strand Apr 2003

Macroinvertebrate Community Structure And Related Environmental Variables In Two Forks Of The Virgin River, Utah, Terence P. Boyle, Matthew J. Strand

Western North American Naturalist

Using multivariate analysis techniques, we analyzed variation in the structure of the benthic macroinvertebrate community in the North Fork and East Fork of the Virgin River in and above Zion National Park in concert with a number of naturally occurring and anthropogenic environmental variables. Correspondence analysis revealed that the community structure in the 2 streams was markedly different despite occurring in areas similar in topography, elevation, and terrestrial vegetation cover. Subsequent analyses of the 2 streams separately using canonical correspondence analysis to test for strength of association of environmental variables with variations in benthic macroinvertebrate community structure revealed that communities …
