The Balance Of Forces And The Empire Of Liberty: States' Rights And The Louisiana Purchase, Robert Knowles Jan 2003

The Balance Of Forces And The Empire Of Liberty: States' Rights And The Louisiana Purchase, Robert Knowles

Law Faculty Publications

This Article challenges the conventional wisdom about the Louisiana Treaty and argues that it was unconstitutional. As many students of history know, President Jefferson had serious misgivings about its constitutionality, which scholars have dismissed as driven by an overly strict construction of the Constitution. The Article concludes that Jefferson's concerns were in fact motivated primarily by respect for federalism principles.

This Article identifies and discusses the underlying conflict between two radically different visions of federalism. While Jefferson s Republicans believed that the incorporation of new states in the West would merely expand the Constitutions form of government to more territory, …

Wildlife Knowledge Among Migrants In Southern Sumatra, Indonesia: Implications For Conservation, Philip J. Nyhus, Sumianto Tilson, Ronald Tilson

Faculty Scholarship

The value of traditional ecological knowledge for biodiversity research and conservation is widely recognized. The value of wildlife knowledge provided by recent migrants is less clear. Photographs of 10 mammal species were shown to 622 individuals in communities near Way Kambas National Park in Sumatra, Indonesia, to assess wildlife knowledge among recent migrants and to identify socio-economic variables that can be used to identify more knowledgeable informants. Knowledge scores were categorized by taxonomic family, genus and species. Large, charismatic and abundant animals were identified more frequently than smaller and more secretive animals. Higher knowledge scores were significantly associated with males, …

Dangerous Animals In Captivity: Ex Situ Tiger Conflict And Implication For Private Ownership Of Exotic Animals, Philip J. Nyhus, Ronald L. Tilson, J L. Tomlinson

Faculty Scholarship

The risks associated with tiger attacks on people in the wild are well documented. There may currently be more tigers in captivity than in the wild, but relatively little is known about the risks of injury or death associated with owning and managing captive tigers and other large carnivores. The purpose of this study was to conduct a global assessment of attacks by captive tigers on people, with particular emphasis on cases in the United States. Our analysis of 30 international media sources and additional documents uncovered 59 unique incidents in 1998-2001 in which people were reportedly injured or killed …

Sidestepping The It Artifact, Scrapping The Is Silo, And Laying Claim To 'Systems In Organizations, Steven Alter Jan 2003

Sidestepping The It Artifact, Scrapping The Is Silo, And Laying Claim To 'Systems In Organizations, Steven Alter

Business Analytics and Information Systems

The “IT artifact” and debates about the core of the IS field received a lot of attention in the last several years. This paper is a response to Benbasat and Zmud’s June 2003 MISQ paper “The Identity Crisis within the IS Discipline: Defining and Communicating the Discipline’s Core Properties,” which argues that “the IT artifact and its immediate nomological net”1 constitutes “a natural ensemble of entities, structures, and processes” that “serves to bind together the IS subdisciplines and to communicate the distinctive nature of the IS discipline.” This paper starts by examining the meaning of “IT artifact” and concluding that …

Urban Canada Geese In Georgia: Assessing A Golf Course Survey And A Nuisance Relocation Program, Larkin A. Powell, Michael J. Conroy, Kipling S. Balkcom, Joe Caudell Jan 2003

Urban Canada Geese In Georgia: Assessing A Golf Course Survey And A Nuisance Relocation Program, Larkin A. Powell, Michael J. Conroy, Kipling S. Balkcom, Joe Caudell

School of Natural Resources: Faculty Publications

Nuisance complaints about Canada geese (Branta canadensis), have risen in recent years. In Georgia, managers have responded by relocating some nuisance geese to rural areas. During 1993–1996, we used band recoveries of relocated geese to determine the efficacy of relocation as a management strategy. We also used data from a post-card survey of golf courses to monitor the urban subpopulation of Canada geese in Georgia during 1998–2001. Flocks considered by golf course superintendents to be a nuisance were larger (1998: 48.8 geese, 1999: 71.5, 2000: 73.2, 2001: 67.2) than nonnuisance flocks (1998: 13.1 geese, 1999: 16.7, 2000: 25.8, 2001: 18.1). …

Histories of Western Michigan University

Dear Friends,

The College of Arts and Sciences has played a dynamic role in the growth and development of Western Michigan University. Many of the College's 20 departments and 6 interdisciplinary programs are foundation stones upon which the University was built and were present at the establishment of Western State Normal School in 1903.

The College of Arts and Sciences' roots originate with the Divisions of Language and Literature, Social Sciences, and part of the Division of Science and Mathematics. In the 1956-57 school year, these divisions were grouped together to become the School of Liberal Arts and Sciences. For …

Top Management Team Heterogeneity And Sme Export Performance: Investigating The Role Of Environmental Uncertainty, Franz T. Lohrke, Geralyn Mcclure Franklin, Vinay Kothari Jan 2003

Top Management Team Heterogeneity And Sme Export Performance: Investigating The Role Of Environmental Uncertainty, Franz T. Lohrke, Geralyn Mcclure Franklin, Vinay Kothari

Faculty Publications

Research has generally found that firms competing in high uncertainty environments gain advantages from having diverse (heterogeneous) management teams (TMTs). Employing a national survey of 70 small- and medium-sized enterprises (SMEs), the present study examined whether TM T heterogeneity in functional background, international work experience, and foreign language proficiency had a stronger relationship with export performance for firms competing in high than those competing in low uncertainty environments. Results were generally weak when market and industry factors contributing to uncertainty were examined separately; however, additional analysis showed that the hypothesized relationship did exist when uncertainty was measured employing both factors …

The Development Of An Agricultural Landscape Along A Portion Of The U.S. Highway 277 Corridor, With A Case Study Of The Cotton Industry In Haskell, Texas, Martha Doty Freeman

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

In February 2002, Prewitt and Associates, Inc., contracted with the Texas Department of Transportation, Environmental Affairs Division, to complete tasks describing the history and architectural resources of the U.S. Highway 277 Wichita Falls, to Abilene, Texas, corridor. Task 1 involved producing a broad overview of the corridor focusing on railroad construction and development of an agricultural landscape. The overview, constituting the first part of this report, provides a history of agriculture, transportation, and community development along the corridor, and identifies the forces at play in the development of the corridor that resulted in construction of specific properties. Task 2 involved …

Sphericules And Fragments: Minding The Gaps, Ted M. Coopman Jan 2003

Sphericules And Fragments: Minding The Gaps, Ted M. Coopman

Faculty Publications

Michael McGee exemplified the scholar embracing all tools and ideas, the fragments that make up our existence, in exploring and explaining our world. I argue that bridging the gaps that separate these fragments, or what Gitlin (1989) called sphericules, is the essence of what constitutes public scholarship. Starting from Habermas' (1989) description of the public sphere I explore how interdisciplinarity holds the keys to bridging the gaps between publics. I supported this with a discussion of the history of academe in America and the brief survey of the new infrastructures being built to expand our fields of exploration and the …

Beads In The Straits Settlements: Trade And Domestic Demand, 1827-1937, Hwei-Fe'n Cheah

BEADS: Journal of the Society of Bead Researchers

Beads have long been a part of the exchange of goods in Southeast. Indo-Pacific beads were traded in Southeast Asia and colored beads from China were exchanged for spices and forest products from the Indonesian archipelago. The Straits Settlements, comprising the ports of Singapore, Malacca, and Penang, was formed in 1826, to consolidate the trading position of the British in Southeast Asia. Singapore, in particular, developed into a major entrepot of the 19th and early 20th centuries. Research by the late Peter Francis, Jr., drew attention to its role as a channel for a part of the Southeast Asian bead …

The Tenuous Nature Of The Medicaid Entitlement, Timothy Stoltzfus Jost Jan 2003

The Tenuous Nature Of The Medicaid Entitlement, Timothy Stoltzfus Jost

Scholarly Articles

Though Medicare was from the outset an entitlement under federal law, the status of Medicaid has always been less certain. Arguably, it was the Supreme Court, rather than Congress that first recognized that Medicaid recipients (and providers) could sue the states in federal court to enforce federal Medicaid requirements. A recent widely reported federal court decision, however, called radically into question the continuing existence of a federal Medicaid entitlement. Though this decision has now been reversed, and rejected by other courts, it illustrates the tenuous nature of the Medicaid entitlement, and the need to reconstitute Medicaid as an exclusively federal …

Australia And Its Regions - People And Place, Neil Drew Jan 2003

Australia And Its Regions - People And Place, Neil Drew

Sciences Conference Papers

This discussion focuses on how regions are created in political, geographical and in social terms within Australia and whether regions matter and if regional governance is important.

In almost every indicator regional communities are worse off than their city counterparts: domestic violence is higher; suicide rates are higher; computer literacy and usage is lower; unemployment rates are higher; and, incomes are lower.

• Today 66 per cent of people live in cities, a further 20 per cent in inner regional areas.

• At the beginning of last century 37 per cent of the population lived in cities and 54 per …
