Rethinking Prosecution History Estoppel, Douglas Gary Lichtman Oct 2003

Rethinking Prosecution History Estoppel, Douglas Gary Lichtman

Coase-Sandor Institute for Law & Economics Research Paper Series

Under the rule of prosecution history estoppel, patent applicants who amend their claims during the course of patent prosecution assume a significant risk: namely, the risk that a court will later construe the changes as concessions that should be read to limit patent scope. This risk is exacerbated by strong evidentiary presumptions under which courts are to assume, unless the patentee presents sufficient evidence otherwise, that every change triggers estoppel, and that the resulting estoppel forfeits everything except that which the revised language literally describes. The justification for these presumptions is that, implemented in this fashion, prosecution history estoppel makes …

Copious Electronic Text On Small Screen Interfaces: A New Method Of Displaying Text On Cell Phones, William Fitzpatrick Oct 2003

Copious Electronic Text On Small Screen Interfaces: A New Method Of Displaying Text On Cell Phones, William Fitzpatrick

Master's Theses - Daytona Beach

A modified form of RSVP (rapid serial visual presentation) was presented to 15 male and 15 female undergraduate and graduate students from Embry-Riddle Aeronautical University. The participants read 9 short passages electronically presented as 2, 4, or 6 lines of text in rapid sequence on a simulated cell phone display interface, at three speeds. Comprehension of text passages was examined in an attempt to find an ideal method of presenting lengthy text on a small screen interface. The results indicated that as participants were exposed to greater speeds and an increasing number of lines their comprehension of the passages decreased. …

How Safe Do Individuals Feel In Clayton County?, Scott M. Clemens Oct 2003

How Safe Do Individuals Feel In Clayton County?, Scott M. Clemens

Theses and Dissertations

To determine if individuals feel safe in their communities, a self- administered questionnaire was distributed to six hundred residents of Clayton County, Georgia. In addition to overall safety, the survey sought to measure how being a victim of a burglary or rape and the level of income impacts the individuals' feeling of safety. The survey also sought to measure how safe those same individuals believed the community was for their children and how likely a terrorist attack was in the county. Non- probability sampling, specifically the accidental sample, was used for conducting the research. The results of the survey show …

The Exclusion Of Felons From Jury Service, Brian C. Kalt Oct 2003

The Exclusion Of Felons From Jury Service, Brian C. Kalt

American University Law Review

The lifetime exclusion of felons from jury service is the majority rule in the U.S., used in thirty one states and in federal courts. The result is that over 6% of the adult population is excluded, including about 30% of black men.

The parallel issue of felon disenfranchisement has drawn considerable scholarly attention, despite its lower, declining, and less racially charged numbers. The racial composition of juries has been widely discussed in the literature as well. By contrast, felon jury service has been almost entirely ignored, despite a mass of legislation and appellate litigation, and despite glaring racial disparities.

One …

Evaluation Of The Hud Elder Cottage Housing Opportunity (Echo) Program, C Theodore Koebel, Julia Beamish, Karen A. Danielsen, Virginia Polytechnic Institute And State University

Public Policy and Leadership Faculty Research

ECHO housing was introduced in the United States in the 1980s based on a program started in Australia in 1975. An ECHO unit is a small house in which an elderly person resides and which is placed near the home of a host (either relatives or close friends of the elderly person). The purpose of this arrangement is to make it convenient and efficient for the occupants of the host family dwelling to provide assistance to the elderly person residing in the smaller ECHO house.

Although ECHO housing provides a means for keeping an elderly resident close to family and …

Corrosion And Mass Transport Processes In Carbon Steel Miniature Waste Packages, James Cizdziel, Kaveh Zarrabi, Susan Lestrange, Amy J. Smiecinski

Publications (YM)

In this study, we have systematically investigated corrosion and mass transport processes in carbon steel miniature waste packages (MWP) in dynamic systems (water in, water out) under varying chemical conditions. The MWP were fabricated to have similar configuration to the DOE Spent Nuclear Fuel (SNF) waste package and that individual components to be in scale with each other compare to the SNF waste package. Two MWP configurations were studied: a "bathtub" model and a "flow-through" model. By slowly dripping 4 different solutions (groundwater obtained from well water J-13 located near Yucca Mountain, and J-13 water adjusted to low-pH, high-salinity, and …
