Caller Id, Plamen Ivanov Arnaudov Jan 2003

Caller Id, Plamen Ivanov Arnaudov

LSU Master's Theses

As one might expect from a young poet writing at the turn of a millennium, recurrent in "Caller ID" is the theme of struggle with literary tradition and of seeing it as both necessary and constricting to the project of forging one's own creative identity. The collision between history and the self is visible in the often conflicted references to great philosophers and poets of the past as well as in the call for renewal of the body poetic after an envisioned 'end of history' marked by creative sterility and exhaustion. The proposed renewal does not entail destruction of tradition …

Keys Of War, Clay Carter Weill Jan 2003

Keys Of War, Clay Carter Weill

LSU Master's Theses

At the dawn of time the gods created heaven and earth. The creator of the moon joined with the creator of the sun and together they produced the first Empress. She is the embodiment of all that is good and holy. She is the spiritual guide to all the tribes of man. The tribes are ruled by men. When one man, Baron Stier, rises above the others he is crowned Archduke. He rules in the Empress’s name and his dynasty lasts for half a millennia. Upon the discovery of the land beyond the sacred islands the dynasty falls. And tribes …

Exedra: Form And Function In The Landscape, Daniel W. Mcelmurray Jan 2003

Exedra: Form And Function In The Landscape, Daniel W. Mcelmurray

LSU Master's Theses

This study resulted in the development of design guidelines used to create a contemporary exedra, in relationship to commemoration in the landscape. Through research and field investigation, an assessment of forms, materials, uses and locational characteristics of the exedra provides an understanding of the dynamics of the relationships between the elements of the exedra. By understanding the historical and commemorative nature of the exedra, landscape architects can utilize the form to create freestanding or structurally-integrated exedral forms as a solution to the identified need for the development of human-scale, urban places which commemorate people, places, and events.

On Researching Music In Everyday Life:Assessing The Musician As Producer Of Commercialised Music, Alan Bradshaw, Roger Sherlock, Pierre Mcdonagh

Articles

Adorno & Horkheimer (1998) argue that the Culture Industry generates cultural artefacts that fail to develop human consciousness and hence support the domination of the capitalist system. Steinert (2003) states that the pressures facing musicians to negotiate between the demands of the culture industry and the traditional role of the artist generates a fundamental contradiction within art which is symbolically enacted through artistic production. This study, which draws on on-going postgraduate research aims to develop a research framework that investigates how musicians negotiate this contradiction. The study considers if a more reflexive approach to art exists, typified by the Pop …

Moral Development Of The Characters Of The Harry Potter Series, Amy J. Grundmeyer Jan 2003

Moral Development Of The Characters Of The Harry Potter Series, Amy J. Grundmeyer

Graduate Research Papers

Many parents, teachers, and students are unaware of the level of moral development exhibited by characters in the Harry Potter series. The purpose of this study was to explore moral development in the first four novels of the series in an attempt to find positive examples of moral decision-making. Using Kohlberg's Theory of Moral Development, adolescent characters were evaluated for higher-level moral development and adult characters were evaluated for moral development at a higher level than that shown by the adolescent characters.

A content analysis was performed on the first four novels in the Harry Potter series by J. K. …

Carnegie Library Buildings In Iowa Today, Terri Hudachek Jan 2003

Carnegie Library Buildings In Iowa Today, Terri Hudachek

Graduate Research Papers

The purpose of this study was to present the history of four Iowa Carnegie Library buildings: Cedar Rapids, Iowa, Cedar Falls, Iowa, West Liberty, Iowa, and Eldon, Iowa. These four building histories were selected because together they represent the common fates of such buildings, not only in Iowa, but across the country. The Carnegie Library in Eldon remains much the same as the day it opened in May 9, 1913 with many original features intact. The West Liberty Carnegie Library building has been renovated to retain the Carnegie appearance. Cedar Falls had renovated its Carnegie library building with no regard …

A Textual Analysis Of The Portrayal Of Parents In Young Adult Literature, Kathryn L. Reisetter Houck Jan 2003

A Textual Analysis Of The Portrayal Of Parents In Young Adult Literature, Kathryn L. Reisetter Houck

Graduate Research Papers

This research examined the way in which parents are portrayed in young adult literature. Textual analysis was the methodology used to sort and code the 24 books that met the researcher's criteria, which were that books had to be published within the last decade and characters had to be from two-parent, intact families. By looking at the themes, the researcher attempted to interpret the information and draw inferences. The research yielded some surprising results as to how parents are portrayed. in the majority of young adult novels, parents are present at least to some degree. They are typically portrayed in …

Advancing U.S. Interests With The International Criminal Court, David J. Scheffer Jan 2003

Advancing U.S. Interests With The International Criminal Court, David J. Scheffer

Vanderbilt Journal of Transnational Law

It is a great pleasure to be here in this beautiful lecture hall at Vanderbilt University Law School and to have the opportunity to speak to you this afternoon about the International Criminal Court (ICC). In recent months, one newspaper or magazine article after another, in examining the foreign policy of the current administration and the gulf (which seems to be so pronounced now) between the United States and even its closest allies throughout the rest of the world, has listed a basic set of treaties as being partly explanatory of that gulf. The Kyoto Protocol, for example, is always …

On Virtue And Peace: Creating A Workplace Where People Can Flourish, Caryn L. Beck-Dudley, Steven H. Hanks Jan 2003

On Virtue And Peace: Creating A Workplace Where People Can Flourish, Caryn L. Beck-Dudley, Steven H. Hanks

Vanderbilt Journal of Transnational Law

In this Article, Professors Beck-Dudley and Hanks explore the virtues necessary for individuals to flourish within a business organization. Through this exploration, they conclude that modern discussions of business ethics fail to account for the value and virtue of peaceableness. Then, focusing on the freedom from conflict aspect of peaceableness, they use Champion Paper Products, Sartell Minnesota Paper Mill, as a case study in the significant improvements in human flourishing and organizational performance that can occur when management and labor choose peaceable solutions to labor conflicts.

Serving Pro Se Patrons: An Obligation And An Opportunity, Kerry Fitz-Gerald Jan 2003

Serving Pro Se Patrons: An Obligation And An Opportunity, Kerry Fitz-Gerald

Faculty Articles

Historically, non-lawyer patrons in law libraries have been viewed with discomfort, and library services, even in libraries open to the public, have been geared toward members of the legal community. However, changes in both the needs of the public and in the demographics of library patrons are challenging the traditional allocation of services in public law libraries. This article discusses the reasons for the traditional allocation of services, the cultural and economic forces that are bringing the public to law libraries in greater numbers, and new modes of service that can better meet the needs of public patrons.

The Intricacies Of Commercial Arbitration In The United States And Brazil: A Comparison Of Two National Arbitration Statutes, Matthew Heaphy Jan 2003

The Intricacies Of Commercial Arbitration In The United States And Brazil: A Comparison Of Two National Arbitration Statutes, Matthew Heaphy

University of San Francisco Law Review

AS TRADE WITHIN the Western Hemisphere proliferates, transnational trade partners increasingly rely on arbitration as a means of dispute resolution in lieu of litigation. Brazil, the largest economy in Latin America, has historically been slow to adopt arbitration due to a lack of enforcement of arbitration agreements by the courts beyond the remedy of contractual damages and the requirement of judicial ratification of arbitral awards. The perception of Brazil's cautious approach to arbitration changed with the passage of Law No. 9.307 of 26 September 1996 ("Law No. 9.307"), bringing it closer in line with the pro-arbitration United States Federal Arbitration …

Musical Sound Recordings As Works Made For Hire: Money For Nothing And Tracks For Free, Scott T. Okamoto Jan 2003

Musical Sound Recordings As Works Made For Hire: Money For Nothing And Tracks For Free, Scott T. Okamoto

University of San Francisco Law Review

While the entire Copyright Clause has been the subject of extensive academic and judicial dissection, two phrases in particular are relevant to this discussion. "Author" means not only the narrow definition of a writer, "but rather [has] reach necessary to reflect the broad scope of constitutional principles." "[T]he term, in its constitutional sense, has been construed to mean an 'originator," 'he to whom anything owes its origin."' Thus, under this broad construction, an "Author" means anybody who creates an original work; that is, produces something "of one's own independent efforts".

Doe 1 V. City Of Murrieta: How The California Court Of Appeal Missed The Mark On Vicarious Liability For Sexual Torts Committed By On-Duty Police Officers, Tara L. Pennington

University of San Francisco Law Review

The California Supreme Court held that the first situation involves such a powerful use of authority that the city employing the officer can be held vicariously liable for his sexual torts. However, in Doe 1 v. City of Murrieta, the California Court of Appeal decided that the City cannot be held vicariously liable in the second situation.

Contractual Arbitration, Mandatory Arbitration, And State Constitutional Jury-Trial Rights, Stephen J. Ware Jan 2003

Contractual Arbitration, Mandatory Arbitration, And State Constitutional Jury-Trial Rights, Stephen J. Ware

University of San Francisco Law Review

PROFESSOR JEAN STERNLIGHT believes that courts should be more reluctant to enforce arbitration agreements than they are to enforce contracts generally. In other words, she believes that contract law's standards of consent are not as high as the standards of consent that should be applied to arbitration agreements. This belief puts her at odds with the Federal Arbitration Act ("FAA"), which requires courts to enforce arbitration agreements "save upon such grounds as exist at law or in equity for the revocation of any contract," and with the Supreme Court, which continues to recognize that the FAA places arbitration agreements "upon …

This collection offers an economics-based overview of the various facets of risk. It contains six papers that examine a broad array of research relating to risk. Two papers examine risk management and its application to decision making as well as what researchers have learned over the past few decades in their theoretical investigations of risk.
