Expert Information And Expert Evidence: A Preliminary Taxonomy, Samuel R. Gross, Jennifer L. Mnookin

Articles

Federal Rule of Evidence 702 speaks in very general terms. It governs every situation in which "scientific, technical or other specialized knowledge will assist the trier of fact," and provides that, in that situation, "a witness qualified as an expert by knowledge, skill, experience, or education, may testify thereto in the form of an opinion or otherwise . . . .' In 2000, following a trio of Supreme Court cases interpreting Rule 702, the Rule was amended to include a third requirement, in addition to the helpfulness of the testimony and the qualifications of the witness: reliability. Under Rule 702 …

Experience, Culture And Reality: The Significance Of Fisher Information For Understanding The Relationship Between Alternative States Of Consciousness And The Structures Of Reality, Charles D. Laughlin, Jason C. Throop Jan 2003

Experience, Culture And Reality: The Significance Of Fisher Information For Understanding The Relationship Between Alternative States Of Consciousness And The Structures Of Reality, Charles D. Laughlin, Jason C. Throop

International Journal of Transpersonal Studies

The majority of the world’s cultures encourage or require members to enter alternative states of

consciousness (ASC) while involved in religious rituals. The question is, why? This paper suggests

an explanation for the culturally prescribed ASC from the view of Fisher information. It argues

from the position, first put forward by Emile Durkheim in his magnum opus, The Elementary

Forms of the Religious Life, that all religions are grounded in reality. It suggests that many of the

structural elements of cultural cosmologies are similar and that the ritual induction of ASC may

help to bring individual experience into greater accord …

Gnostic Dilemmas In Western Psychologies Of Spirituality1, Harry T. Hunt Jan 2003

Gnostic Dilemmas In Western Psychologies Of Spirituality1, Harry T. Hunt

International Journal of Transpersonal Studies

Early Gnosticism is identified as a form of Weber’s inner-worldly mysticism that, following the

critique of Plotinus, entailed spiritual metapathologies of inflated grandiosity, despair, and/or

social withdrawal. These vulnerabilities re-emerge in the naturalistic psychologies of spirituality

begun by Emerson, Nietzsche, Jung, and Maslow and more implicitly within contemporary personality

and neuropsychological research on numinous/transpersonal experience. An updated

version of Gnostic dilemma and its conflicted dualism may be endemic to any would-be science

of the spiritual and to much current transpersonal psychology as well.

The Rise Of The Perpetual Trust, Jesse Dukeminier, James E. Krier Jan 2003

The Rise Of The Perpetual Trust, Jesse Dukeminier, James E. Krier

Articles

For more than two centuries, the Rule against Perpetuities has served as the chief means of limiting a transferor's power to tie up property by way of successive contingent interests. But recently, at least seventeen jurisdictions in the United States have enacted statutes abolishing the Rule in the case of perpetual (or near-perpetual) trusts. The prime mover behind this important development has been the federal Generation-Skipping Transfer Tax. This Article traces the gradual decline of the common law Rule against Perpetuities, considers the dynamics behind the recent wave of state legislation, examines the problems that might result from the rise …

Complementary Resources And The Exploitation Of Technological Innovations, David R. King, Jeffrey G. Covin, W. Harv Hegarty Jan 2003

Complementary Resources And The Exploitation Of Technological Innovations, David R. King, Jeffrey G. Covin, W. Harv Hegarty

Management Faculty Research and Publications

Technological innovation often results when the resources of a small firm are combined with those of a large one. This is because small and large firms characteristically possess complementary resources whose combination can facilitate innovation success. The possession of complementary innovation-producing resources by small and large firms helps explain patterns of interaction among firms in dynamic, technology-based industries. Propositions are developed that outline how typical resources of small and large firms can be used to explain industry-level phenomena surrounding technological change.

Se Battre Our Ses Droits Écritures, Litiges Et Discrimination Raciale En Louisiane (1888-1899), Rebecca J. Scott

Articles

Title in English: Fighting for public rights: writing, lawsuits and racial segregation in Louisiana (1888-1889).

This article explores the links between the fight against compulsory racial segregation and the day–to–day operation of the law in nineteenth century Louisiana. Using the figure of Louis A. Martinet, one of the organizers of the test case that yielded the U.S. Supreme Court decision Plessy v. Ferguson, the essay argues that Martinet’s role as notary reflects the central importance to the community of color of questions of public standing and written records. The article also identifies the concepts of "public rights" and "public liberties" …

A Cultural Assessment Of Employee Motivation In The Brazilian Hotel Industry: A Comparison Between The Northeast And The Southeast, Ana Claudia Quadros Gomes Jan 2003

A Cultural Assessment Of Employee Motivation In The Brazilian Hotel Industry: A Comparison Between The Northeast And The Southeast, Ana Claudia Quadros Gomes

UNLV Retrospective Theses & Dissertations

This study used Hofstede's (1980) Value Survey Module to compare culture and Hackman and Oldham's (1980) intrinsic motivation six-item measure to compare motivation to work between hotel employees in Northeast and Southeast Brazil. The results of this study showed there are significant cultural differences between the two regions. These differences are correlated to motivation; Sub cultural differences found between Northeast and Southeast Brazil require that training contents and organizational culture differ between the regions since employees' values and needs and values are not the same. The correlation between culture and motivation suggests that cultural differences may be used by managers …

Teachers' Perceptions Of Societal Factors In Teacher Education During The 1980s, Suzanne Michele Katz Jan 2003

Teachers' Perceptions Of Societal Factors In Teacher Education During The 1980s, Suzanne Michele Katz

UNLV Retrospective Theses & Dissertations

Over the past 150 years teacher education has continually been accepted as a necessity for those charged with instructing the young, especially when paired with the common school movement. If all school-aged children were to be in classrooms it followed that teachers trained in educating students needed to be available. As school populations exploded from the mid 1800s to the early 1900s, most communities called for teachers in increasing numbers. Such is an example of the link between societal factors and the education of teachers. The political, historic, and societal foundations on which the practice of teacher education is grounded …

Rockfall Modeling In Jointed Rock For Underground Openings With Consideration Of Seismic And Thermal Effect, Ming Lin Jan 2003

Rockfall Modeling In Jointed Rock For Underground Openings With Consideration Of Seismic And Thermal Effect, Ming Lin

UNLV Retrospective Theses & Dissertations

A rockfall model for underground excavation in the jointed rock is developed using the three-dimensional discontinuum code, 3DEC. The factors considered in this model include the stochastic attribute of the joint network, the joint mechanical properties, the seismic loading, and the thermal loaDing The Yucca Mountain site data were compiled and analyzed to feed into the numerical model. The 3DEC rockfall model incorporates the development of joint patterns generated from multiple sampling from a synthetic rock mass volume that contains a realistic joint population based on field mapping data. Site-specific ground motions and waste generated heat load are included in …

The Effect Of Video Instruction On Social Interactions Of Children In The Inclusive Preschool, Catherine Doyle Lyons

UNLV Retrospective Theses & Dissertations

Social competence is an important consideration for early childhood education. Furthermore, young children with disabilities are increasingly being placed in community preschool programs therefore necessitating strategies to increase the number and quality of social interactions between young children with and without disabilities. Beginning at a very young age nearly all children have access to television, VCR or DVD, and cable or satellite. Therefore, media may serve as a vehicle to increase the number and quality of social interactions between young children with and without disabilities; This study had two purposes. The first was to investigate the effect of scripted video …

Satellite Wars: Culture Vs. Expression, Alex Colangelo Jan 2003

Satellite Wars: Culture Vs. Expression, Alex Colangelo

Vanderbilt Journal of Entertainment & Technology Law

This Article first describes satellite technology and the process by which Canadians access American satellite broadcasts. It then examines the competing issues of preservation of Canadian business and culture, versus the freedom of expression as set forth in section 2(b) of the "Canadian Charter of Rights and Freedoms" (hereinafter "Charter"). Next, the Article considers case law preceding Bell ExpressVu, and presents an examination of the findings of the Supreme Court of Canada in Bell ExpressVu. The Article will then argue that the Supreme Court incorrectly found that there existed no ambiguity in the various interpretations of section 9(l)(c), and that …

Plagiarism And Its (Disciplinary) Discontents: Towards An Interdisciplinary Theory And Pedagogy, Lisa Maruca Jan 2003

Plagiarism And Its (Disciplinary) Discontents: Towards An Interdisciplinary Theory And Pedagogy, Lisa Maruca

English Faculty Research Publications

Despite the abundance of literature on the topic, there is very little that can be called “common” about our common sense understanding of plagiarism. Taking a closer look at the history, rhetorical uses, and cultural practices of plagiarism, this essay reveals that this concept is multiple and heterogeneous, riddled with contradictions and blind spots. As a result, the article argues the overlapping, inter-related, yet distinct discourses of plagiarism that circulate within the academy can be usefully described as a “complex system.” In positing plagiarism as a complex system, this article has several goals. First, it shows how singular approaches to …

It Is Not So Simply Because An Expert Says It Is So: The Reliability Of Gang Expert Testimony Regarding Membership In Criminal Street Gangs: Pushing The Limits Of Texas Rule Of Evidence 702., Placido G. Gomez Jan 2003

It Is Not So Simply Because An Expert Says It Is So: The Reliability Of Gang Expert Testimony Regarding Membership In Criminal Street Gangs: Pushing The Limits Of Texas Rule Of Evidence 702., Placido G. Gomez

St. Mary's Law Journal

The mechanisms developed by the criminal justice system addressing the criminal activities of street gangs, for the most part, have proved ineffective. The evolution of gangs, their complex structure, and multipurpose focus keep them one step ahead of law enforcement. The most recent weapon created to fight the war on gangs, the civil injunction, suffers from numerous inadequacies. One concern is that civil injunctions raise numerous constitutional concerns. Another is that these injunctions fall short of constitutional demands. Furthermore, the practical implementation of the injunction forces an analysis of the reliability of the gang expert’s testimony. This Article proposes courts …

The Secession Reference And The Limits Of Law, Richard Kay Jan 2003

The Secession Reference And The Limits Of Law, Richard Kay

Faculty Articles and Papers

When the Supreme Court of Canada issued its judgment on the legality of unilateral Quebec secession in August 1998 many Canadians did not know what to make of it. The Court held that the only lawful way in which Quebec might depart the Canadian federation was through one of the amendment mechanisms provided in the Constitution Act 1982. It thus affirmed that Quebec could not secede without the agreement of at least the Houses of the federal Parliament and some number of provincial legislative assemblies. Prime Minister Chretien declared the next day that the judgement was a victory for all …

The Supremacy Clause As A Constraint On Federal Power, Bradford R. Clark Jan 2003

The Supremacy Clause As A Constraint On Federal Power, Bradford R. Clark

GW Law Faculty Publications & Other Works

Today, it is widely accepted that the Constitution authorizes courts to review and invalidate state laws that conflict with federal statutes. At the same time, prominent commentators and even some judges maintain that courts should not seriously review the constitutionality of federal statutes alleged to exceed the scope of Congress' enumerated powers. In their view, the constitutional structure protects the states (and thereby reduces the need for judicial review of federal power), but establishes no comparable safeguards to deter states from interfering with federal prerogatives. Contrary to this position, there is an express textual basis for judicial review of federal …
