The Juridical Origins Of The International Patent System: Towards A Historiography Of The Role Of Patents In Industrialization, Ikechi Mgbeoji Jan 2003

The Juridical Origins Of The International Patent System: Towards A Historiography Of The Role Of Patents In Industrialization, Ikechi Mgbeoji

Articles & Book Chapters

Given the controversial and indeed, ideological tenor of the various claims by many “patent systems” as to authorship of the patent system, this article engages in an historical reconstruction of the evolution and development of the modern juridical system of patents. In the analysis, various competing “histories” of the patent system are examined, evaluated and their veracity as the origin of the patent system are resolved. In my view, the competing claims to the origins of the patent systems can only be resolved on the basis of certain criteria which constitute the irreducible essence of a patent system. In other words, …

Value Shift: Why Companies Must Merge Social And Financial Imperatives To Achieve Superior Performance, Carol M. Sanchez Jan 2003

Value Shift: Why Companies Must Merge Social And Financial Imperatives To Achieve Superior Performance, Carol M. Sanchez

Peer Reviewed Articles

In Value Shift. Lynn Sharp Paine argues that modern corporations are now expected to meet moral, as well as financial, performance standards to be considered superior performing firms. Paine calls this a return to, or a shift in, values that now emphasize ethics, culture, environmental standards, product safety, and community investment—what students of management might call a broad stakeholder model of the firm. The author, who is professor of leadership and values at the Harvard Business School, reflects on the recent crises in corporate America that began in 2001 with the Enron scandal. These disgraceful misdeeds and the public reaction …

Hard Choices And Soft Law: Ethical Codes, Policy Guidelines And The Role Of The Courts In Regulating Government, Lorne Sossin, Charles Smith Jan 2003

Hard Choices And Soft Law: Ethical Codes, Policy Guidelines And The Role Of The Courts In Regulating Government, Lorne Sossin, Charles Smith

Articles & Book Chapters

The authors examine a number of examples of "soft law": written and unwritten instruments and influences which shape administrative decision making Rather than rendering bureaucratic processes more transparent and cohesive, or fostering greater accountability and consistency among decision-makers, "soft law" in this context frequently reinforces artificial divisions. Moreover, it insulates decisions and decision-makers from the kinds of critical inquiry typically associated with "hard law. " If it is to realize its potential as a bridge between law and policy, and lend meaning to core principles - like fairness and reliability - soft law ought to be subjected to similarly critical …

A Failed Experiment? Investigative Detention: Ten Years Later, James Stribopoulos Jan 2003

A Failed Experiment? Investigative Detention: Ten Years Later, James Stribopoulos

Articles & Book Chapters

Ten years ago, the Ontario Court of Appeal introduced the investigative detention power to Canada with its decision in R. v. Simpson. After providing some necessary background about the realities of police detention practices, the author offers a critical evaluation of Simpson and the ancillary powers doctrine that it relied upon to create this new police power. The author then proceeds to consider how well the investigative detention experiment has fared over the last decade, examining whether it has lived up to the goal that provided its inspiration, namely, the regulation of police detention practices. The author advances two major …

Petrochina Syndrome: Regulating Capital Markets In The Anti-Globalization Era, Stephen F. Diamond Jan 2003

Petrochina Syndrome: Regulating Capital Markets In The Anti-Globalization Era, Stephen F. Diamond

Faculty Publications

To explore this new social fracture and its challenge to the legitimacy of Anglo-American capitalism, this Article presents a case study of the attempt by the Chinese government and major Wall Street investment banks to complete an initial public offering by a major Chinese corporation. Their efforts represented a classic example of the effort to build a new global capitalist order from above without significant concern for the legitimation question. And, as we shall see, the effort was met from below with a vigorous social response. Thus, I suggest that a kind of syndrome, the PetroChina Syndrome if you will, …

Reflections On The Myth Of Icarus In The Age Of Information, Allen S. Hammond Iv Jan 2003

Reflections On The Myth Of Icarus In The Age Of Information, Allen S. Hammond Iv

Faculty Publications

It is economics, policy, law, and indeed, for some, religion that advanced information technology should be eventually accessible to the masses. To this end, the federal and state governments are establishing goals and guidelines for advanced information technology's equitable deployment. Chief among the governments' intended beneficiaries are our children, Generations X,Y, Z, and beyond. The explicit expectation, however, is that every individual and group in our society would benefit from such deployment.

Efficiencies in the computer augmented generation, embedded in the processing and storing of information are expected to enhance education, commerce, the economy, political discourse, individual self actualization, and …

Investigation Of The Role Of Self-Efficacy In Postoperative Outcomes In Spinal Fusion Patients, Karen Roberts Burritt Jan 2003

Investigation Of The Role Of Self-Efficacy In Postoperative Outcomes In Spinal Fusion Patients, Karen Roberts Burritt

Masters Theses

A descriptive correlational design was utilized to explore the relationship between preoperative self-efficacy and the postoperative outcomes of distance ambulated, brace application, discharge disposition and length of stay in surgical spinal fusion patients. Social cognitive theory and the concept of self-efficacy were used to provide the theoretical framework. A novel self-efficacy questionnaire was developed to measure the independent variable, it was tested for reliability and validity in a 16 patient pilot study. The pilot study was followed by a study of 52 post-operative patients. Preoperative self-efficacy significantly correlated to distance ambulated in the entire sample. Females in this sample demonstrated …

Isolation Of Intragenic Suppressor Mutations Of A Dominant-Negative Ftsz Allele, Carla Ciccone Jan 2003

Isolation Of Intragenic Suppressor Mutations Of A Dominant-Negative Ftsz Allele, Carla Ciccone

Electronic Theses and Dissertations

Streptomyces coelicolor, a gram-positive bacterium containing division genes that are dispensable for growth and viability. ftsZ encodes the earliest acting cell division protein in prokaryotes. In S. coelicolor a mutation at codon 275 in ftsZ (ftsZ25), changes an alanine to a valine causing a block in division. Using a homology model of the crystal structure of FtsZ, I hypothesized that changing another amino acid having direct interaction with amino acid 275 might restore function. The structure-directed mutation changed a leucine to a valine at codon 259. The double mutation did not restore division to the organism; this change alone also …

Relating To Students Through Young Adult Literature, Joshua K. Lynch Jan 2003

Relating To Students Through Young Adult Literature, Joshua K. Lynch

Senior Honors Theses and Projects

No passionate reader, or lifetime reader, goes around reading books that they hate. They are what they enjoy. No single book can meet the individual likes and dislikes of each student. So why can students not read what they choose, and still learn? Based on the works of Donald Gallo, an interview with Jennifer Bueler, and the writers own personal experience with children and literacy, strictly as giving students choice in what they read.

Choosing and evaluating books is part of reading, and it is part of teaching reading. Young Adult Literature (YAL) should not be excluded from student choice, …

Variability Of Metals In Soils In The Sudbury Area (Ontario), Vera Spektor Jan 2003

Variability Of Metals In Soils In The Sudbury Area (Ontario), Vera Spektor

Theses and Dissertations (Comprehensive)

Industrial development influences the natural and human environment. At the local scale, the most intensive industrial pollution is in the area of factories and industrial centers. Industrial pollution is concentrated in soil and vegetation (then, using water systems and trophic chains it may enter all ecosystem components). The industrial pollution of the Sudbury region includes mostly sulfur dioxide and heavy metals. The main goal of this study was to examine spatial variability in metal distribution in soil for the Sudbury area. Objectives of the work were to describe metal distribution depending on geographic factors such as topographic location, vegetation cover, …

French And English Word Reading And Word Decoding Performance In Bilingual Children: How Are Phonological Processing Skills Related?, Catherine Adèle Lafrance Jan 2003

French And English Word Reading And Word Decoding Performance In Bilingual Children: How Are Phonological Processing Skills Related?, Catherine Adèle Lafrance

Theses and Dissertations (Comprehensive)

The French (L1) and English (L2) reading development of bilingual children in French schools was examined using measures of oral language proficiency, letter-name and letter-sound knowledge, phonological processing (phonological awareness, naming speed and working memory), and word decoding over an eight month period. At Time 1 (Senior Kindergarten), a series of multiple regressions indicated that, when controlling for oral language proficiency, letter name knowledge and non-verbal reasoning, L1 phonological awareness was the only consistent and unique predictor of French and English word reading and word decoding performance. At Time 2 (Grade 1), French and English phonological awareness were consistent and …

Silica Coating Of Gold Nanoparticles, Milind Laxman Surve Jan 2003

Silica Coating Of Gold Nanoparticles, Milind Laxman Surve

Masters Theses

“Gold colloids have been homogenously coated with silica using silane coupling agents as a primer to make the gold surface vitreophilic. After adding active silica, the particles are transferred in ethanol for uniform silica coating by using the Stober method. Gold nanoparticles used for this study ranged from 5 nm up to 40 nm with mixed results. Silica condensation can be controlled to produce different silica thicknesses on gold. The main problem while coating smaller particles (5 nm and 10 nm) was the final coagulation or necking of silica after coating the gold surface. The possible causes for this effect …

An Early Intervention Program To Teach Readiness Skills To At–Risk Kindergarten Students, Marcell E. Hooks Jan 2003

An Early Intervention Program To Teach Readiness Skills To At–Risk Kindergarten Students, Marcell E. Hooks

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was implemented as a developmentally appropriate total language arts program to teach readiness skills to kindergarten children at risk of failure. Assessment data for the past 2 years showed literacy deficits among kindergarten students at Bouchet.

Possible causes for early reading difficulties included (a) insufficient teacher training on how to work with children who are low achievers; (b) insufficient parental involvement in the educational process; (c) lack of early literacy experiences, exposure, and skills; and (d) lack of opportunities for collaborative student learning.

The researcher conducted workshops for three kindergarten teachers, the teacher assistant, and parents on …

Martel's Routes In Mammoth Cave, Kentucky, 1912, Trevor R. Shaw Jan 2003

Martel's Routes In Mammoth Cave, Kentucky, 1912, Trevor R. Shaw

International Journal of Speleology

Martel’s own copy of the Hovey 1912 guidebook to Mammoth Cave has his routes marked faintly in pencil on the printed cave plans. These plans are reproduced here, with his routes indicated on them. He generally followed the four standard tourist routes which now included Kaemper’s 1908 discoveries to Violet City, but instead of visiting the Maelstrom he went to Hovey’s Cathedral and Gerta’s Grotto.

Tree-Mould Caves In Slovakia, Ludovít Gaál

International Journal of Speleology

Four tube-shaped caves are described in this work, which origined in consequence of weathering the trees. Their length ranges from 5.8 to 17 m. All of them occur in neovolcanic rocks of Middle Slovakia, in epiclastic andesite conglomerates, breccias or in the tuffs. Some other caverns are close to the entrance of this caves, however they are inaccessible for a man. Thin rim of silicates (opal or chalcedony) occurs in some of them.
