A Framework For Aggregating Network Performance In Distributed Brokering Systems, Gurhan Gunduz, Shrideep Pallickara, Geoffrey C. Fox Jan 2003

A Framework For Aggregating Network Performance In Distributed Brokering Systems, Gurhan Gunduz, Shrideep Pallickara, Geoffrey C. Fox

Electrical Engineering and Computer Science - All Scholarship

The Internet is presently being used to support increasingly complex interaction models as a result of more and more applications, services and frameworks becoming network-centric. Efficient utilization of network and networked resources is of paramount importance. Network performance gathering is a precursor to any scheme that seeks to provide adaptive routing capabilities for interactions. In this paper we present a network performance aggregation framework that is extensible and appropriate for distributed messaging systems that span multiple realms, disparate communication protocols and support different applications.

The Changing American Hospital In The Twenty-First Century, Ralph W. Muller Jan 2003

The Changing American Hospital In The Twenty-First Century, Ralph W. Muller

Center for Policy Research

One is always hesitant to speak about the future. A famous philosopher from New York, Yogi Berra, said "Making predictions is difficult, especially about the future," and I have some trepidation about doing so now. There is also the difficulty of understanding what really has happened in the past. I recall the Bolshevik general in 1917 who said "The future is clear, but the past is very murky." We anticipate the future with more clarity than is justified, even as we disagree on what is happening right now or what happened before. In that vein, I will describe the role …

Data Mining Mining Data: Msha Enforcement Efforts, Underground Coal Mine Safety, And New Health Policy Implications, Thomas J. Kniesner, John D. Leeth Jan 2003

Data Mining Mining Data: Msha Enforcement Efforts, Underground Coal Mine Safety, And New Health Policy Implications, Thomas J. Kniesner, John D. Leeth

Center for Policy Research

Studies of industrial safety regulations, Occupational Safety and Health Administration (OSHA) in particular, often find little effect on worker safety. Critics of the regulatory approach argue that safety standards have little to do with industrial injuries and defenders of the regulatory approach cite infrequent inspections and low fines for violating safety standards. We use recently assembled data from the Mine Safety and Health Administration (MSHA) concerning underground coal mine production, safety inspections, and workplace injuries to shed new light on the regulatory approach to workplace safety. Because all underground coal mines are inspected at least once per quarter, MSHA regulations …

Building Problem Solving Environments With Application Web Service Toolkits, Choonhan Youn, Marlon Pierce, Geoffrey C. Fox Jan 2003

Building Problem Solving Environments With Application Web Service Toolkits, Choonhan Youn, Marlon Pierce, Geoffrey C. Fox

Electrical Engineering and Computer Science - All Scholarship

Application portals, or Problem Solving Environments (PSEs), provide user environments that simplify access and integrate various distributed computational services for scientists working on particular classes of problems. Specific application portals are typically built on common sets of core services, so reusability of these services is a key problem in PSE development. In this paper we address the reusability problem by presenting a set of core services built using the Web services model and application metadata services that can be used to build science application front ends out of these core services.

Ideas, Artifacts, And Facilities: Information As A Common-Pool Resource, Charlotte Hess, Elinor Ostrom Jan 2003

Ideas, Artifacts, And Facilities: Information As A Common-Pool Resource, Charlotte Hess, Elinor Ostrom

Librarian Publications

"The goal of this paper is to summarize the lessons learned from a large body of international, interdisciplinary research on common-pool resources (CPRs) in the past 25 years and consider its usefulness in the analysis of scholarly information as a resource. We will suggest ways in which the study of the governance and management of common-pool resources can be applied to the analysis of information and 'the intellectual public domain.' The complexity of the issues is enormous for many reasons: the vast number of players, multiple conflicting interests, rapid changes of technology, the general lack of understanding of digital technologies, …

The Effect Of Aposematic Coloration On The Food Preference Of Aphelocoma Coerulescens, The Florida Scrub Jay, Mary Elizabeth Hill Jan 2003

The Effect Of Aposematic Coloration On The Food Preference Of Aphelocoma Coerulescens, The Florida Scrub Jay, Mary Elizabeth Hill

Theses and Dissertations

Aposematic coloration, commonly observed in noxious organisms, serves as a warning to predators to avoid attacking specific prey. This coloration is conspicuous in nature, with one of the most common examples being a red and black pattern. The plant Abrus precatorius exhibits this warning signal in its seeds, which resemble lady beetles and contain the concentrated toxin abrin. Aphelocoma coerulescens, an endemic and federally threatened bird in the state of Florida, shares a similar distribution with Abrus precatorius, making interaction between the two species possible. Using an edible model of the Abrus seed, this potential interaction was tested in Martin …

Formulating Fantasies: Marriage In Victorian England And George Eliot's Middlemarch, Liza Welch Barnes Jan 2003

Formulating Fantasies: Marriage In Victorian England And George Eliot's Middlemarch, Liza Welch Barnes

Theses and Dissertations

One of the oldest states of existence known to humanity, marriage is a traditional state of being, uniting one man and one woman to love, honor, cherish, and protect each other for the rest of their lives. In Victorian England, however, many men and women questioned traditional expectations concerning marriage. Society's norms in Britain dictated that marriage was the ultimate goal in the nineteenth century, and, according to Barbara Weiss, "there has perhaps never been an age (or a literature) as relentlessly pro marriage as the Victorian period" (67).

However, many issues concerning marriage disturbed some freer-thinking Victorians, including novelist …

The Reversibility Of Differential Rearing In Rats, Leann M. Taylor Jan 2003

The Reversibility Of Differential Rearing In Rats, Leann M. Taylor

Theses and Dissertations

Two groups of rats were raised in two different environments for 75 days beginning at 25 days of age. One group was raised in an enriched condition (EC), and one group in an impoverished condition (IC). At 91 days of age, all rats were tested on a spatial reversal learning task to determine if their early environments had affected their learning ability (Test 1). After Test 1 was completed, the rats were then placed in the opposite environment for another 75 days, with a second testing (Test 2) beginning at 165 days of age to determine if the new environment …

Destruction Of Documents Before Proceedings Commence: What Is A Court To Do?, Camille Cameron, Jonathan Liberman Jan 2003

Destruction Of Documents Before Proceedings Commence: What Is A Court To Do?, Camille Cameron, Jonathan Liberman

Articles, Book Chapters, & Popular Press

The effective performance by courts of their adjudicative role depends on the availability of relevant evidence. In civil proceedings, the discovery process aims to ensure that such evidence is available. If documents that would be relevant evidence in a trial are destroyed, a fair adjudication is made difficult, if not impossible. This is so whether the destruction of documents occurs before or after proceedings commence. This article asks what a trial judge should do in a situation where relevant evidence is unavailable because one of the parties has destroyed documents before the proceedings commenced but anticipating that such proceedings were …

Devolution And Discrimination, Victor C. Romero Jan 2003

Devolution And Discrimination, Victor C. Romero

Faculty Scholarship

This essay explores the issue of whether discrimination against two historically disadvantaged groups - racial minorities, on the one hand, and gays and lesbians, on the other - might increase or decrease should the federal immigration power devolve to the individual states. I conclude that while the lack of uniformity that accompanies immigration law devolution might lead to undesirable results in welfare reform and criminal law enforcement, and would likely not stem the tide of racism, it might lead to the opening of opportunities for gay Americans to petition their binational partners for immigration benefits. Such a development would turn …

Making Sense Of Successor Liability, Marie T. Reilly Jan 2003

Making Sense Of Successor Liability, Marie T. Reilly

Faculty Scholarship

A firm that buys assets from another firm ordinarily does not acquire liability to the seller's creditors simply by buying its assets. This ordinary rule is subject to important exceptions. The buyer's consent triggers an exception. If a buyer agrees to assume the seller's liability to third parties, it is for that reason liable. This article considers a more controversial exception - successor liability. When a court decides that an asset acquirer should be treated as a "successor" to the transferor, it is liable for the transferor's debts as though it were the transferor.

Modeling Nonintersective Adjectives Using Operator Logics, Paul Bankston Jan 2003

Modeling Nonintersective Adjectives Using Operator Logics, Paul Bankston

Mathematics, Statistics and Computer Science Faculty Research and Publications

Our topic is one that involves the interface between natural language and mathematical logic. First-order predicate language/logic does a good job approximating many parts of (English) speech, i.e., nouns, verbs and prepositions, but fails decidedly when it comes to, say, adjectives. In particular, it cannot account for the quite different ways in which the adjectives green and big modify a noun such as chair. In the former case, we can easily view a world in which the class of green chairs is the intersection of the class of green things with the class of chair-things. By contrast, the way …

Advocacy And Compassion In The Jewish Tradition, Daniel B. Sinclair Jan 2003

Advocacy And Compassion In The Jewish Tradition, Daniel B. Sinclair

Fordham Urban Law Journal

This essay surveys the Talmudic sources dealing with the issue of advocacy in Jewish law, and highlights the element of compassion that underlies the permissive approach to advocacy in the Talmudic sources. It outlines post-Talmudic developments with a special emphasis on the way in which the medieval authorities synthesized the views of the two Talmuds on the question of advocacy, and how later halakhists pushed this synthesis to its limits in order to pave the way for the emergence of the rabbinical pleader of modern times. This essay concludes with a brief remark on the link between compassion and advocacy …

Starting Over With A Clean Slate: In Praise Of A Forgotten Section Of The Model Penal Code, Margaret Colgate Love Jan 2003

Starting Over With A Clean Slate: In Praise Of A Forgotten Section Of The Model Penal Code, Margaret Colgate Love

Fordham Urban Law Journal

Convicted felons have no realistic hope of full reintegration into society when jurisdictions do not provide for eventual removal of collateral penalties and when relief mechanisms are insufficient or ineffective. Because Americans are uncomfortable with such an unforgiving system and states are considering the economic burdens of such a system, jurisdictions should take steps to limit the scope and duration of these collateral consequences. This Article proposes a legal framework aimed to fully reintegrate an offender into society post incarceration. It urges a return to the reforms of the 1960s and 70s, the ABA Standards on Collateral Sanctions, and Section …

A New Code Of Ethics For Commercial Arbitrators: The Neutrality Of Party-Appointed Arbitrators On A Tripartite Panel, Olga K. Byrne Jan 2003

A New Code Of Ethics For Commercial Arbitrators: The Neutrality Of Party-Appointed Arbitrators On A Tripartite Panel, Olga K. Byrne

Fordham Urban Law Journal

This article discusses ABA and AAA revisions to the ethics code for commercial arbitrators with respect to the neutrality of arbitrators. This Note describes the importance of the tripartite panel and the new standards in the revised code of ethics. It further examines the opposing arguments concerning the role of party-appointed arbitrators with respect to neutrality. Finally, the Note proposes that the revisers educate participants in the arbitral process of the new standard demanded of all arbitrators, so as to maintain confidence and stability in arbitration.

A Second Take: Re-Examining Our Regulatory Takings Jurisprudence Post-Tahoe, Robert W. Diubaldo Jan 2003

A Second Take: Re-Examining Our Regulatory Takings Jurisprudence Post-Tahoe, Robert W. Diubaldo

Fordham Urban Law Journal

This Note discusses the aftermath of the landmark case, Tahoe-Sierra Preservation Council, Inc. v. Tahoe Regional Planning Agencey. This Comment first discusses the background of regulatory takings jurisprudence, from Justice Holmes' landmark Pennsylvania Coal opinion to the present. It further analyzes the recent Tahoe decision, focusing on both the strengths and weaknesses of the decision and its potential impact on the future of takings. Finally, the Comment offers a different analytical framework from which to analyze regulatory takings. Under this theory, courts would abandon the partial/total distinction, and instead focus on the actual loss from the landowner's point of view. …

Day Laborers, Friend Or Foe: A Survey Of Community Responses, Mauricio A. Espana Jan 2003

Day Laborers, Friend Or Foe: A Survey Of Community Responses, Mauricio A. Espana

Fordham Urban Law Journal

This comment discusses the various ways that communities that benefit from day laborers respond to the presence of the "underground" employment phenomenon. Part I provides some background into the day laborers' situation, livelihood, and legal rights. Part II discusses the competing issues faced by day laborers, as well as the issues the laborers present to community residents, employers, and the United States Government. Finally, Part III discusses the different solutions that communities confronted with day laborers have proposed and implemented, and concludes that it is in the best interests of all parties involved that communities accept day labors and accommodate …

"Forgive Me Victim For I Have Sinned": Why Repentance And The Criminal Justice System Do Not Mix - A Lesson From Jewish Law, Cheryl G. Bader Jan 2003

"Forgive Me Victim For I Have Sinned": Why Repentance And The Criminal Justice System Do Not Mix - A Lesson From Jewish Law, Cheryl G. Bader

Fordham Urban Law Journal

This essay will critique the Georgia Justice Project's encouragement of confessions in the context of the secular American justice system via comparison with the treatment of confessions under ancient Jewish law. Specifically, this essay posits that the absolute prohibition on the use of confessions in a legal system firmly rooted in religious values recognizes the danger inherent in combining the act of speaking of one's sins for religious penance with the use of such confessions in the criminal adjudication process. The Jewish legal system avoids these inherent dangers by completely devaluing the accused's confession. The GJP, in contrast, merges the …

The Fallacy That Fair Use And Information Should Be Provided For Free: An Analysis Of The Responses To The Dmca's Section 1201, Mauricio España

Fordham Urban Law Journal

This Note argues that 17 U.S.C. § 120, Digital Millennium Copyright Act, is not only necessary to ensure that copyright law is able to progress and advance in the digital revolution, but more importantly, that the protection of copyrighted works will benefit the public in ways the analog world cannot. It also argues that legal commentators' fears about § 1201 are misplaced.
