Fetal Surgery And Wrongful Death Actions On Behalf Of The Unborn: An Argument For A Social Standard, Jonathan D. Stanley Oct 2003

Fetal Surgery And Wrongful Death Actions On Behalf Of The Unborn: An Argument For A Social Standard, Jonathan D. Stanley

Vanderbilt Law Review

Imagine a young couple in the not-too-distant-future who are eagerly awaiting the birth of their first child. During the eighteenth week of the pregnancy, the mother has an ultrasound performed to detect possible developmental problems with the child. To their dismay, the ultrasound reveals a malformation in the fetus. The defect will not be fatal, but if left untreated will cause the child severe breathing problems once born. The problem can be fixed with surgery after birth, but such a procedure will result in disfiguring facial scars. After thoroughly considering their options, which range from an abortion to carrying the …

Going-Concern Opinions: Broadening The Expectations Gap, Michael D. Akers, Meredith A. Maher, Don E. Giacomino

Accounting Faculty Research and Publications

A rash of high-profile bankruptcies has led to a search for answers. Many hold auditors responsible for not detecting the potential for bankruptcy during the most recent audit. The Weiss Report, a study of several dozen bankrupt companies submitted to the U.S. Senate during its deliberations on the Sarbanes-Oxley Act, found a "broad and massive failure" on the part of auditors to raise "yellow flags" that indicate potential bankruptcy. The authors examined Weiss' methodology and found that, applied to a broader group of companies, Weiss' criteria would have incorrectly predicted bankruptcy for nearly half of the non-bankrupt companies studied. This …

Robot Heavens And Robot Dreams: Ultimate Reality In A.I. And Other Recent Films, Frances Flannery-Dailey Oct 2003

Robot Heavens And Robot Dreams: Ultimate Reality In A.I. And Other Recent Films, Frances Flannery-Dailey

Journal of Religion & Film

Numerous recent films understand ultimate reality to be multi-layered. This article examines the various formulas films use to express this idea, such as heaven, dreams, technology, temporal loops and altered mental states, while also exploring the various religious and philosophical traditions on which these "ultimate reality films" draw. Next, I suggest a postmodern framework as a way of accounting for the ubiquity of the reality theme across filmic genres and I argue that film is a unique medium for expressing this epistemology. Finally, I turn to an extensive analysis of A.I. as a case study of a postmodern, multivalent "ultimate …

The Supreme Court's Labor And Employment Decisions: 2002-2003 Term, Maria O'Brien Oct 2003

The Supreme Court's Labor And Employment Decisions: 2002-2003 Term, Maria O'Brien

Faculty Scholarship

This article summarizes U.S. Supreme Court cases from the October 2002 term that related directly or indirectly to labor or employment law or have implications for labor and employment practitioners. Of particular interest are the University of Michigan affirmative action cases' and the Texas criminal sodomy case. 2 Although not nominally "labor and employment" cases, these cases will profoundly affect labor and employment issues. Lawrence v. Texas has already altered the lenses through which society views homosexuality and altered public discourse related to homosexuality and same-sex relationships. 3 The reasoning of the Court shows how far issues of sexuality have …

Law And The Future Of Organized Labor In America, Keith N. Hylton Oct 2003

Law And The Future Of Organized Labor In America, Keith N. Hylton

Faculty Scholarship

This paper, prepared for "The Future of Organized Labor in America" symposium at Wayne State University Law School, examines two questions: 1) what are the implications of the decline of unions for the future of labor law, and 2) what are the implications of labor law for the decline of unions? After documenting the recent trends (decline in the private sector coupled with slight growth in the public sector), I argue that the change in the public-versus-private composition will lead unions to pursue legislative strategies that will further reduce the share of the private sector workforce in unions. A law …

A Miscarriage Of Justice In Massachusetts: Eyewitness Identification Procedures, Unrecorded Admissions, And A Comparison With English Law, Stanley Z. Fisher, Ian K. Mckenzie Oct 2003

A Miscarriage Of Justice In Massachusetts: Eyewitness Identification Procedures, Unrecorded Admissions, And A Comparison With English Law, Stanley Z. Fisher, Ian K. Mckenzie

Faculty Scholarship

Like many other states, Massachusetts has recently known a number of acknowledged miscarriages of justice. This article examines one of them, the Marvin Mitchell case, in order to ask two questions: "What went wrong?" and "What systemic reforms might have prevented this injustice?" In seeking ideas for reform, we look to English law.

In 1990 Marvin Mitchell was convicted of rape in Massachusetts. Seven years later he became the first Massachusetts prisoner to be exonerated by DNA testing. In this article we describe the two key factors leading to Mitchell's wrongful conviction: faulty eyewitness identification procedures, and inadequate safeguards surrounding …

Alternative Approaches To Judicial Review Of Social Security Disability Cases, Paul R. Verkuil, Jeffrey S. Lubbers Oct 2003

Alternative Approaches To Judicial Review Of Social Security Disability Cases, Paul R. Verkuil, Jeffrey S. Lubbers

Articles

The article evaluates proposals for reforming the judicial review process for Social Security disability determinations, highlighting inefficiencies and variability in the current system. It compares the Social Security Administration (SSA) adjudication process with the Department of Veterans Affairs (VA) appeals system, emphasizing the need for a specialized court to address growing caseloads and improve decisional consistency. The analysis advocates for the creation of a Social Security Court, modeled after the Court of Appeals for Veterans Claims, to enhance uniformity, reduce delays, and alleviate the burden on federal courts.

A Renewable-Resource Approach To Database Valuation, Xavier Dreze, Andre Bonfrer Oct 2003

A Renewable-Resource Approach To Database Valuation, Xavier Dreze, Andre Bonfrer

Research Collection Lee Kong Chian School Of Business

We demonstrate in this paper that firms should view customers in a database as a renewable resource when valuating them. Indeed, customer names flow in and out of the firm’s databases, and the goal of the firm is to optimize the overall customer acquisition/cultivation/attrition process. The renewable resource approach to the problem of maximizing the profits generated by a flow of customer names is more appropriate than the traditional Customer Lifetime Value (CLV) approach. We show that CLV underestimates the true value of names (by more than 400% in some cases) and leads to sub-optimal customer relationship management and acquisition …

Corporate Social Responsibility Reputation Effects On Mba Job Choice: Controlling For Region Of Origin, David B. Montgomery, Catherine A. Ramus Oct 2003

Corporate Social Responsibility Reputation Effects On Mba Job Choice: Controlling For Region Of Origin, David B. Montgomery, Catherine A. Ramus

Research Collection Lee Kong Chian School Of Business

In a preliminary study with 279 MBA’s from two European and three North American business schools we find that reputation-related attributes of caring about employees, environmental sustainability, community/stakeholder relations, and ethical products and services are important in job choice decisions. We use an adaptive conjoint analysis survey tool to discover the relative weighting of a new set of social responsibility job search criteria, including these attributes with traditional job search criteria like financial package, geographical location, etc. In addition, our results show that more than ninety percent of the MBAs in the sample were willing to forgo financial benefits in …

Organizational Preparation For Terrorist Attack, Alan Wallace, Vernon Harper Oct 2003

Organizational Preparation For Terrorist Attack, Alan Wallace, Vernon Harper

Mountain Plains Journal of Business and Technology

In the event of a terrorist attack causing mass casualties or nuclear, biological, or chemical contamination, emergency responders easily can be overwhelmed by demands for their services. Advance planning by organizations with the advice of emergency responders to safeguard people from becoming victims, to care for victims before emergency responders arrive, and to render assistance to emergency responders once they arrive is critical to mitigating damage.

Navigating The Statute Of Limitations Maze In The Federal Income Tax Arena, Joseph S. Merrill, Katherine D. Black Oct 2003

Navigating The Statute Of Limitations Maze In The Federal Income Tax Arena, Joseph S. Merrill, Katherine D. Black

Mountain Plains Journal of Business and Technology

Individual taxpayers frequently realize that a tax return filed with the IRS needs to be changed for various reasons that may include: previously estimated amounts may later be discovered to have been in error, prior ignorance may have been rectified, or new interpretations of law may have been rendered by the courts or the IRS. The need to adjust a previously filed return may be discovered in the year of filing, or several years later.

State and federal laws generally create statutes of limitation that let the parties to litigation know when the deadlines for bringing the suit expire. Sometimes …

Integrating Network Attached Mass Storage Systems Into Educational Networks: An Initial Examination Of Performance And Security Issues, Dennis Guster, James E. Weber, Charles Hall Oct 2003

Integrating Network Attached Mass Storage Systems Into Educational Networks: An Initial Examination Of Performance And Security Issues, Dennis Guster, James E. Weber, Charles Hall

Mountain Plains Journal of Business and Technology

As colleges and universities digitalize record storage, classroom support and administrative processes, data storage needs are increasing dramatically. Institutions of higher education are turning to mass storage systems to fill these needs. NAS (network attachedstorage) is often selected over alternatives for cost, scalability and ease of administration reasons. This paper reports the results of an initial study assessing security concerns, performance characteristics, ease of installation, configuration, upgradeability, and use by end users, in an academic installation of network attached storage.

"Real Men" Curriculum, Jessie Daniels, Ronald Shuler, Nina Aledort, Nicholas Freudenberg Oct 2003

"Real Men" Curriculum, Jessie Daniels, Ronald Shuler, Nina Aledort, Nicholas Freudenberg

Open Educational Resources

This is the curriculum for a program known as "REAL MEN," an acronym for "Returning Educated African American and Latino Men to Enriched Neighborhoods." A collaborative effort, the REAL MEN program was a public health intervention based at Rikers Island and at a community-based organization, Friends of Island Academy, for young men, ages 15-19, who were leaving jail and returning to their home communities. The curriculum for this program was designed to reduce drug use, HIV risk, and rearrest by helping participants examine alternative paths to manhood and consider racial/ethnic pride as a source of strength.
