Cites: A Toothless Tiger In The Black Market For Traditional Chinese Medicines?, Jacquelyn A. Shaw Jan 2003

Cites: A Toothless Tiger In The Black Market For Traditional Chinese Medicines?, Jacquelyn A. Shaw

Dalhousie Journal of Legal Studies

Traditional Chinese Medicine is a millennia-old ethnic medical system used by an increasing number of adherents of both Asian and non-Asian descent throughout the world, which forms an integral part of the Chinese identity, philosophy and culture. The raw materials used in Traditional Chinese Medical treatments are obtained from naturally-occurring minerals, wild plants, and animals, a percentage of which are, unfortunately, dangerously rare species prohibited from international trade by CITES, (the Convention on the International Trade in Endangered Species of Fauna and Flora). CITES has been declared to be one of the most successful international environmental agreements of all time, …

Sex Trafficking From Thailand To Japan: Human Being Or Illegal Goods?, Kara Patterson Jan 2003

Sex Trafficking From Thailand To Japan: Human Being Or Illegal Goods?, Kara Patterson

Dalhousie Journal of Legal Studies

The international sex trafficking market allows traffickers to reap enormous profits from the exploitation of women. Sex trafficking is a complex interplay of several factors, including sexual and economic exploitation, illegal migration, and human rights abuses. Traffickers prey on vulnerable women by promising them high-paying jobs in foreign countries. After being smuggled into a foreign country, many trafficked women find themselves outside the scope of legal protection. This article focuses on sex trafficking between Thailand and Japan, and analyzes existing legal protections for trafficked women in current international and domestic Japanese and Thai law. As sex trafficking objectifies trafficked women …

Digital Architecture As Crime Control, Neal K. Katyal Jan 2003

Digital Architecture As Crime Control, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

This paper explains how theories of realspace architecture inform the prevention of computer crime. Despite the prevalence of the metaphor, architects in realspace and cyberspace have not talked to one another. There is a dearth of literature about digital architecture and crime altogether, and the realspace architectural literature on crime prevention is often far too soft for many software engineers. This paper will suggest the broad brushstrokes of potential design solutions to cybercrime, and in the course of so doing, will pose severe criticisms of the White House's recent proposals on cybersecurity.

The paper begins by introducing four concepts of …

Judging The Next Emergency: Judicial Review And Individual Rights In Times Of Crisis, David Cole Jan 2003

Judging The Next Emergency: Judicial Review And Individual Rights In Times Of Crisis, David Cole

Georgetown Law Faculty Publications and Other Works

How should we judge judicial review from the standpoint of protecting the constitutional rights and liberties of the vulnerable in times of crisis? It is in times of crisis that constitutional rights and liberties are most needed, because the temptation to sacrifice them in the name of national security will be at its most acute. To government officials, civil rights and liberties often appear to be mere obstacles to effective protection of the national interest. As Bush-administration supporters frequently intone when defending their post-September 11th initiatives, “the Constitution is not a suicide pact.” Judicial protection is also critical because crisis …

Sequencing, Acoustic Separation, And 3-D Negotiation Of Complex Barriers: Charlene Barshefsky And Ip Rights In China, Rebecca Green, James K. Sebenius

Faculty Publications

Taking the perspective of the lead U.S. negotiator, Charlene Barshefsky, this article details and analyzes the negotiations that took place in the mid-1990s between the United States and the People's Republic of China over intellectual property rights (IPR). Employing a "negotiation analytic" methodology, Charlene Barshefsky's actions are interpreted to suggest a number of promising approaches to managing the daunting complexities of trade and other negotiations: recognizing the multiparty aspects of apparently bilateral dealings and capturing them in a "deal diagram;" carefully assessing "barriers" to agreement; sequencing to build a winning coalition and overcome potentially blocking ones; "acoustic separation" of issueframes; …

Integrity: Its Causes And Cures, David Luban Jan 2003

Integrity: Its Causes And Cures, David Luban

Georgetown Law Faculty Publications and Other Works

Integrity is a good thing, isn't it? In ordinary parlance, we sometimes use it as a near synonym for honesty, but the word means much more than honesty alone. It means wholeness or unity of person, an inner consistency between deed and principle. "Integrity" shares etymology with other unity-words-integer, integral, integrate, integration. All derive from the Latin integrare, to make whole. And the person of integrity is the person whose conduct and principles operate in happy harmony. Our psyches always seek that happy harmony. When our conduct and principles clash with each other, the result, social psychology teaches us, is …

“Save The Emigrants” Joseph Clewes On The Mountain Meadows Massacre, Ronald W. Walker

BYU Studies

Occasionally a major, previously published document such as this one falls between the historical cracks and becomes virtually forgotten. Although Joseph Clewes's statement on the Mountain Meadows Massacre was published in 1877 and was widely discussed at the time, current scholars have made little or no use of it. Their omission is unfortunate.

The Effects Of Composition And Processing Of Milk On Foam Characteristics As Measured By Steam Frothing, Michael Levy Jan 2003

The Effects Of Composition And Processing Of Milk On Foam Characteristics As Measured By Steam Frothing, Michael Levy

LSU Master's Theses

Steam frothing of milk is required to produce an acceptable foam for many espresso coffee drinks. Specific aspects of composition and processing may affect the foaming properties of milk. The aim of this study was to determine the effect of fat content, heat treatment, free fatty acid addition and storage time on the frothing properties of milk. The four treatments included: fat content (0.08% and 3.25%), pasteurization temperatures (171°F for 15 seconds and 210°F for 45 seconds), pre and post-pasteurization addition of lauric acid solution (0.0% and 2.0% of 0.5 M concentration) and storage time (1 and 10 days). For …

A Time For Change : Improving Salt Lake City, 1890-1925, J. Michael Hunter

Faculty Publications

Although visitors to Salt Lake City during its earliest years described the valley as a place of order and beauty, by the 1880s the city had become dirty, polluted, and unsanitary. This article details the efforts at improvement beginning in the 1880s, including the installation of water and sewer systems, public transportation, electricity, paved streets, and the beautification of parks and playgrounds.

The Social Context Of Norse Jarlshof, Marcie Anne Kimball Jan 2003

The Social Context Of Norse Jarlshof, Marcie Anne Kimball

LSU Master's Theses

A series of excavations from 1897 to 1951 showed the site of Jarlshof in Shetland to have been occupied by proto-Pictish, Pictish, and Viking peoples. These inquiries culminated in J.R.C. Hamilton’s 1956 monograph Excavations at Jarlshof, Shetland. In the years since the writing of the monograph, much new information has come to light that relates to the time periods found at Jarlshof. The concern of this thesis is how the new findings relate to Viking Age Jarlshof and how Viking Age Jarlshof relates to this new information. In order to set Viking Age Jarlshof into its overall historical context regarding …

Micropropagation Of Carnivorous Plants, Kenneth Stephen Uhnak Jan 2003

Micropropagation Of Carnivorous Plants, Kenneth Stephen Uhnak

Open Access Dissertations

A simple, efficient system for seed surface disinfestation and in vitro germination was developed for the carnivorous pitcher plants Darlingtonia californica and Sarracenia leucophylla. Of the disinfectants tested, hydrogen peroxide or 10% Clorox® were most effective for disinfesting seeds of D. californica, while concentrated sulfuric acid worked best for S. leucophylla. Differences in the effectiveness of sterilants were associated by differences in seed coat morphology. Seeds of D. californica imbibed at 4-7°C in sterile deionized water with surfactant and gibberellin germinated earlier than seeds without exposure to gibberellin. Unimbibed seeds of S. leucophylla germinated …

Sand Creek Watershed Project / Sand Creek Watershed Management Plan, Annis Water Research Institute Jan 2003

Sand Creek Watershed Project / Sand Creek Watershed Management Plan, Annis Water Research Institute

Watershed Management Plans and Reports

The overall goal of the Sand Creek Watershed Project is to improve and protect the designated uses of the watershed. In order to achieve this overall goal and attain compliance with the TMDL established in Sand Creek, four goals have been established and prioritized. The primary goal of the Sand Creek Watershed Project is to restore or improve the cold water fishery. The secondary goal of the project is to protect and improve the habitats of native aquatic life and wildlife. Both goals can be achieved by reducing the amount of known pollutants affecting both of these uses. Pollutant reduction …
