Enforcement Of Wto Rulings: An Interest Group Analysis, Mark L. Movsesian Jan 2003

Enforcement Of Wto Rulings: An Interest Group Analysis, Mark L. Movsesian

Hofstra Law Review

This essay explains the WTO's enforcement mechanism in terms of interest group theory. Under the Dispute Settlement Understanding, a WTO member that fails to comply with a ruling in a trade dispute is subject to "retaliation" from the complaining member: the complaining member may raise tariffs against the offending member's products. This remedy creates incentives for exporters in the offending country to lobby their government in favor of compliance. As a result, the retaliation remedy promotes compliance without intruding directly on national institutions. It is thus superior to suggested reforms, like direct effect, that would commandeer courts or other national …

Management Of Rodent Populations At Airports, Gary W. Witmer, Jessica W. Fantinato Jan 2003

Management Of Rodent Populations At Airports, Gary W. Witmer, Jessica W. Fantinato

United States Department of Agriculture Wildlife Services: Staff Publications

Birds pose serious hazards at U.S. airports because of the potential for collisions with aircraft. Raptors, in particular, are hazardous to aircraft safety due to their size, hunting behavior, and hovering/soaring habits. Reduction of rodent populations at an airport may decrease raptor populations in the area and therefore, reduce the risk that raptors pose to aircraft. Rodent populations can be reduced by population management (i.e., use of rodenticides) or by habitat management (i.e., vegetation management, barriers, and land uses) that reduces the area’s carrying capacity for rodents. We discuss potential approaches to reduce rodent populations at airports within the context …

Comparison Of Isoflurane And Sevoflurane For Anesthesia In Beaver, Stewart W. Breck, James S. Gaynor Jan 2003

Comparison Of Isoflurane And Sevoflurane For Anesthesia In Beaver, Stewart W. Breck, James S. Gaynor

United States Department of Agriculture Wildlife Services: Staff Publications

We compared the hemodynamic and respiratory effects, recovery time, and cost of two gas inhalants (isoflurane and sevoflurane) for anesthetic induction and maintenance of beaver (Castor canadensis) during surgery to implant radio transmitters in the peritoneal cavity. Heart rate, respiratory rate, relative hemoglobin saturation with oxygen (SpO2), and body temperature were measured every 5 min for the first 45 min, and arterial blood gas was measured once, 25 min into the anesthetic procedure. Induction for either agent was smooth and rapid. Heart rate and respiratory rate both decreased during the procedure though neither was lower than …

Re-Imagining Justice: Progressive Interpretations Of Formal Equality, Rights, And The Rule Of Law, Robin West Jan 2003

Re-Imagining Justice: Progressive Interpretations Of Formal Equality, Rights, And The Rule Of Law, Robin West

Georgetown Law Faculty Publications and Other Works

Resurrecting the neglected question of what we mean by legal justice, this book seeks to re-imagine rather than simply critique contemporary notions of the rule of law, rights and legal equality. A work of reconstruction, it offers a progressive and egalitarian approach to concepts that have become overly associated with the idea of limited government and social conservatism. Focusing on the necessary conditions of cooperative community life, the book presents a vision of law that facilitates rather than frustrates politics, an analysis of rights that boosts our capacities for caring, and an idea of equality that captures a cosmopolitan vision …

That Wonderful Year: Smallpox, Genetic Engineering, And Bio-Terrorism, David A. Koplow

Georgetown Law Faculty Publications and Other Works

The thesis of this Article is that the United States, Russia, and by extension, the world as a whole, are pursuing a fundamentally sound strategy in retaining, rather than destroying, the last known remaining samples of the variola virus. For now, those samples are housed in secure, deep-freeze storage at the U.S. Centers for Disease Control and Prevention (CDC) in Atlanta, Georgia and at the comparable Russian facility, known as Vector, near Novosibirsk, Siberia. But that basic decision is about the only correct move we are making at this time - and even it is animated by fundamental misapprehensions about …

Alarmism Versus Moderation In Responding To The Rehnquist Court, Mark V. Tushnet Jan 2003

Alarmism Versus Moderation In Responding To The Rehnquist Court, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

I begin in Part I by offering a description of the Supreme Court's recent decisions as a less substantial repudiation of prior principles than many think them to be, and as leaving Congress with the means to achieve a quite substantial proportion of the policy goals it pursued in the statutes the Court invalidated. Part II explains why Congress is unlikely to do so, in light of our apparent commitment to divided government, and parties that are organized around distinctive ideologies because of divided government. Part III turns to the prospect for continued policy transformation, identifying the conditions under which …

Sustainable Development In The Negotiation Of The Ftaa, Marie-Claire Cordonier Segger Jan 2003

Sustainable Development In The Negotiation Of The Ftaa, Marie-Claire Cordonier Segger

Fordham International Law Journal

First, I will briefly explain what is meant by hemispheric sustainable development law. Then, I will discuss the current progress of the FTAA from a sustainable development law perspective. To illustrate the links between trade liberalization, social and environmental law and policy in the Americas, I will briefly highlight potential social and environmental impacts and opportunities in several important areas of negotiations: services, intellectual property rights, competition law, government procurement and investment. (The directions of agricultural liberalization, market access and subsidies are also crucial to sustainable development, but are too extensive to discuss here). Then, I will consider the institutional …

No Recourse: Transnational Corporations And The Protection Of Economic, Social, And Cultural Rights In Bolivia , Maria Mcfarland Sánchez-Moreno, Tracy Higgins

Fordham International Law Journal

This Report analyzes two cases in which TNC activities have had an impact on Bolivian citizens' enjoyment of economic, social, and cultural rights (“ESC rights”). In so doing, it analyzes not only corporate conduct but also the Bolivian government's role in protecting ESC rights from violation. The cases involve an oil spill by Transredes, a TNC partly owned by Enron and Shell, in Bolivia's Desaguadero River, which affected over one hundred indigenous communities; and the water war that took place in the city of Cochabamba over the privatization of Cochabamba's water system and its operation by the consortium Aguas del …

Clothes Talk: Youth Modernities And Commodity Consumption In Dakar, Senegal, Suzanne Scheld Jan 2003

Clothes Talk: Youth Modernities And Commodity Consumption In Dakar, Senegal, Suzanne Scheld

Dissertations, Theses, and Capstone Projects

Based on twelve months of fieldwork in Dakar, Senegal and funded by the Wenner Gren Foundation, this thesis examines how in the context of contemporary globalization, increased volumes of luxury commodities shape the modern consciousness of individuals in a developing African city. This project specifically examines this phenomenon through a study of youth clothing consumption. Dakar is a consumer society with particular consumer dynamics. In addition to class, patron-clientage and kinship are central to understanding contemporary patterns of consumption in Dakar. Clothing is a commodity that has been radically altered by urbanization and the globalization of manufacturing processes and advertising. …

Doing All You Can, Brother?': Visual Themes Of World War Ii American Propaganda Posters, Justin Rives Nicholas

Honors Theses

This thesis is a result of an in-depth analysis of the three thousand plus propaganda posters used in the United States during World War II. The bulk of these posters are housed at National Archives II in College Park, Maryland. The analysis was conducted within the context of several questions. What were the goals of the propagandists? How were those goals visually represented in the posters? What were the visual themes? Why were these goals and themes deemed necessary? How do the goals and themes fit into the overall context of a total war? The concept of being in a …

Second Natures: Media, Masculinity And The Natural World In Twentieth-Century American Literature And Film., Jeanne E. Hamming Jan 2003

Second Natures: Media, Masculinity And The Natural World In Twentieth-Century American Literature And Film., Jeanne E. Hamming

Graduate Theses, Dissertations, and Problem Reports (ETD)

This multidisciplinary dissertation examines the cultural anxieties associated with masculine identity in relation to both technology and nature in key literary texts and contemporary films of the twentieth-century: Ray Bradbury's “The Veldt” and The Martian Chronicles, Philip K. Dick's Do Androids Dream of Electric Sheep?, James Dickey's Deliverance , Don DeLillo's White Noise, Fight Club, American Psycho, Brazil, 12 Monkeys, and Dark City. Exploring the theoretical intersections of technoculture, ecocriticism, and gender studies, this dissertation analyzes the relationship between masculine identity and nature, as it is mediated by American technoculture. This relationship is marked by a discernible cultural malaise—a sense …

Experimental Support For The Use Of Story Telling To Guide Behavior: The Effects Of Story Telling On Multiple And Mixed Fixed Ratio (Fr) /Differential Reinforcement Of Low Rate (Drl) Schedule Responding., Michelle Heffner Jan 2003

Experimental Support For The Use Of Story Telling To Guide Behavior: The Effects Of Story Telling On Multiple And Mixed Fixed Ratio (Fr) /Differential Reinforcement Of Low Rate (Drl) Schedule Responding., Michelle Heffner

Graduate Theses, Dissertations, and Problem Reports (ETD)

Story telling is universal, and the significance of stories may lie in their ability to guide behavior. An informal analysis of story telling suggests that stories provide a model of behavior, establish motivation, and stimulate the development of self-generated rules. In psychotherapy, stories illustrate points, suggest solutions, improve client insight, increase motivation, and establish rapport (Barker, 1996; Zeig, 1980). Despite the popular use of stories across theoretical orientations and treatment approaches, it is not clear if stories facilitate behavior change. Observational and correlational data suggest that stories may guide behavior, but there is no experimental support for these findings. The …

Gender, Gender Role, And Gender Role-Orientation Of Exercise Task: Effects On Cardiovascular Reactivity And Confidence., Andria Leigh Doyle

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present study was conducted to examine gender and gender role differences in cardiovascular reactivity and confidence in relation to performing gender role-oriented exercise tasks. Sixty-four participants were selected to view videos of male and female models performing two exercise tasks [baton twirling (the feminine gender role-oriented task) and martial arts (the masculine gender role-oriented task)]. Participants then completed the exercise tasks while following along with the same video models. Heart rate (HR) and systolic and diastolic blood pressure (SBP and DBP) were measured during experimental conditions. Participants completed questionnaires to assess their level of confidence to perform each exercise …
