The American ‘Dust Bowl’ landscape of the 1930s has been etched into the global imagination through powerful narratives: Farm Security Administration photography (1935–43), Per Loretz’s film, The Plow that Broke the Plains (1936), and John Steinbeck’s Grapes of Wrath (1939). In the last quarter of the twentieth century, historians such as Donald Worster (1979) have constructed their own narratives of this time and place. Caroline Henderson’s Letters from the Dust Bowl, edited by Alvin O. Turner, provides a counterpoint, in the form of a first-hand account and a woman’s voice, to the news stories, government propaganda, and historians’ analyses …

I consider in this paper the extent to which courts rationally and on a principled basis can deny to aboriginal claimants, despite the ancientness of their claims, the specific relief of being restored to possession of their aboriginal lands where the case for such specific relief is otherwise made. The paper begins with a brief discussion of the foundations of property in the Western conception, then goes on to discuss the Europeans' asserted title to indigenous lands and the various theories of aboriginal title that have emerged. This Article focuses upon a persistent problem of the nonprofit sector--its lack of accountability to the public. Director, officer, and organizational responsibilities will be analyzed. Past and current approaches to secure accountability of charitable assets will be discussed, and a proposal for improving charitable accountability will be suggested through the creation of public-private charity commissions at the state level under the aegis of the attorney general.

Recently there has been a considerable amount of pressure to accelerate consumer access to generic drugs, which are significantly less expensive than their brand-name counterparts. One way to bring generic drugs on to the market sooner is through revision of the existing law relating to pharmaceutical patents. This iBrief describes recent regulatory changes to the Drug Price Competition and Patent Term Restoration Act (the Hatch-Waxman Act), which governs the patenting process for new drug products, as well as current legislative efforts to speed generic access through Hatch-Waxman reform. Influence Of Normal Daytime Fat Deposition On Laboratory Measurements Of Torpor Use In Territorial Versus Nonterritorial Hummingbirds, Donald R. Powers, A R. Brown, J A. Van Hook

Fat deposition and torpor use in hummingbirds exhibiting distinct foraging styles should vary. We predicted that dominant territorial hummingbirds will use torpor less than subordinate nonterritorial species because unrestricted access to energy by territory owners allows for fat storage. Entry into torpor was monitored using open-flow respirometry on hummingbirds allowed to accumulate fat normally during the day. Fat accumulation was measured by solvent fat extraction. Territorial blue-throated hummingbirds (Lampornis clemenciae) had the highest fat accumulation and used torpor only 17% of the time. An adjustable systemic-pulmonary artery (SPA) shunt is being developed that consists of apolytetrafluoroethylene (PTFE) graft with a screw plunger mechanism. This device would allowfull control of flow through SPA shunts used to augment pulmonary blood flow in neonates bornwith single ventricle physiology. The objective of this study is to evaluate the changes this mechanismhas on flow fields for a 4 mm and 5 mm adjustable SPA shunt. Two in vitro models wereexamined; an idealized model with an axisymmetric constriction and a model developed from 3-Dreconstruction of the actual shunt under asymmetric constriction. Dementia is not a natural and normal part of aging, but rather a symptom of a disease process. Most individuals with dementia experience emotional distress or behavioral problems best summed up by the term agitation. Approximately 90% of individuals with dementing illnesses demonstrate problem behaviors ranging from repetitive verbalizations and wandering to verbal and physical aggression toward self or others. Each evening thousands of older adults in the community and in institutions become agitated, restless, and confused and begin to wander about or scream. This phenomenon is referred to as sundown syndrome, since it occurs in the evening hours after …

The term "fundamentalism" has been used to describe a host of religious movements across the globe that are militantly antimodernist, aggressively patriarchal, literalist in their reading of sacred texts, and assiduous in their efforts to draw boundaries between themselves and outsiders. While "Islamic fundamentalism" has received the most attention, particularly after the September 11, 2001, terrorist attacks, scholars and journalists have also applied the term to movements within such disparate traditions as Judaism, Sikhism, and Hinduism, as well as to various Christian groups.

Many companies lack efficient management of the early phases of new product development (NPD) - the socalled fuzzy front end (FFE). Rather than on structured methods, decision makers rely on ?gut ?feel? or ?guessing?. In an attempt to ?educate the guess? this paper discusses the activities and challenges of the FFE, as well as strategies to manage them successfully. It then briefly presents traditional and recent approaches to front-end management support.
