Pax genes encode transcription factors that are highly evolutionarily conserved and are vital for animal development. Vertebrate Pax group III genes Pax3 and Pax7 are required for proper development of muscular and central nervous systems. In their roles in muscular systems, Pax3 and Pax7 specify myoblasts (muscle progenitor cells). Pax3 is predominantly involved in embryonic myogenesis and specifies embryonic myoblasts. In contrast, Pax7 specifies adult myoblasts (muscle satellite cells), and has been demonstrated to be vital for adult muscle regeneration. Recent evidence also implicates a role for Pax7 in the conversion of certain stem cells to the myogenic lineage. The …

This article analyzes the U. S. constitutional law interpreting the concept of “same offence.” Included is a survey of the Supreme Court's attempts to interpret constitutional text in order to provide adequate protection for the underlying double jeopardy interest against vexatious reprosecutions, which have frequently produced inconsistent and illogical results. Part III of this article analyzes U.K. law relating to the concept of “same offence,” where the same narrow double jeopardy protection adopted by the U.S. Supreme Court is supplemented with a broad discretion to prevent unfair successive prosecution that constitutes an abuse of process. Stake Your (Linking) Claim: Assessing The Impact Of In Re Doyle On Patent Reissue, 2 J. Marshall Rev. Intell. Prop. L. 360 (2003), Grace C.Y. Leung
UIC Review of Intellectual Property Law
A common problem encountered during patent prosecution is a restriction requirement. According to In re Doyle, the failure to assert linking claims that readon non-elected claims is an error correctable by reissue. This paper argues that the Doyle court was correct in holding that Doyle was distinguishable from In re Orita. Allowance of genus claims that link previously non-elected claims comports with the patent statute. As the public is on notice that patent claims may be broadenedwithin two years, the Doyle holding ensures that the patentee is given the fullbreadth of protection necessary to “promote the Progress of Science and …

The Interactive Work Of Prosody In The Irf Exchange: Teacher Repetition In Feedback Moves, John Hellermann

This article examines the interactive import of prosody from a perspective of participants' orientation to talk in interaction, taking advantage of data from institutional discourse to focus on the prosodic packaging of recurring turn sequences of the same discourse activity. The analysis focuses on the third slot of a ubiquitous three-part classroom discourse sequence, the IRF exchange (Sinclair & Coulthard 1975), a site in which teachers make repetitive feedback moves following student responses. Examination of more than 25 hours of classroom discourse and more than 300 third-turn teacher feedback types uncovered a systematic use of prosody for these teacher repetitions …

Record companies have in recent years begun production of compact discs containing “no-copy” technology. These CDs appear to be classic CDs but are alleged to have poorer sound quality and often will not play in computers. The recording industryhas used this and other methods to stem the increasing popularity of CD copying and unauthorized music file distribution online. Part II of this Comment explains why the DMCA was created, beginning with a brief discussion of modern copyright justifications. Part III lays out the mechanics of the notice requirement and the safe harbor protection for ISPs. Part IV focuses on inconsistencies among the courts and the enforcement dilemma posed by the DMCA. Part V proposes a different standard for the initial notice, encouraging ISPs to work cooperatively with independent copyright holders. This part includes a preview of services and software that exist and that are being developed to ease the burden of finding and managing digital content. Finally, Part …

Two commercially available, qualitative, on-farm test kits (Midland BioProducts Inc., Boone, lA), utilizing either serum or whole blood to evaluate failure of passive transfer (FPT) of immunoglobulins, were evaluated using 38 Holstein calves. Results from the kits were compared with refractometry determination of serum proteins and radial immunodiffusion determinations specific for IgG (RID; Triple J Farms, Bellingham,WA). Blood samples were collected immediately following birth before first colostrum feeding and at 48 h. At birth, serum protein concentrations averaged 4.52 g/dl and IgG averaged 8.6 mg/dl, respectively, for refractometer and RID. Toxicity Potential Of Aqueous Kava Extracts On Liver Function Tests In Rats, Ashwini K. Devkota

Kava, prepared as the traditional aqueous infusion, was tested in the rat for possible effects on liver function tests. Extracts were administered in dosages containing 200 or 500 mg of the active kavalactones per kg for two or four weeks. Sera were assayed for four enzymes that are markers of liver toxicity and liver homogenates for malondiadehyde formation that indicates changes in lipid peroxidation. The data showed that none of the enzymes, alanine aminotransferase, aspartate aminotransferase, alkaline phosphatase, and lactate dehydrogenase, nor malondialdehyde levels were elevated, in fact in some cases they were significantly reduced, suggesting the lack of a …

Feral hogs (Sus scrofa) recently have been introduced to Illinois. They are important to resource managers because of their potentially negative ecological and economic impacts. We assessed the distribution, habitat use, and body morphology of feral hogs in Illinois. We confirmed the occurrence of feral hogs in Fulton, Hardin, Johnson, Lawrence, Massac, Pope, Randolph, and Union counties. Forest and croplands probably are the most important habitats for feral hogs in Illinois. We found free-ranging hogs in Illinois included four previously described morphotypes with distinguishable physical/cranial characteristics: domestic hogs, feral hogs, hybrids, and Eurasian wild hogs. Chronic wasting disease (CWD), a fatal transmissible spongiform encephalopathy of deer (Odocoileus spp.) and elk (Cervus elaphus), presents a challenge to wildlife managers because little is known about its transmission, yet it could severely threaten wildlife populations if action is not taken rapidly. Published mathematical models predict that CWD could devastate populations of free-living deer and elk, prompting wildlife managers to attempt large-scale eradication of deer in hopes of containing CWD outbreaks. Our objective is to critically examine the theoretical and empirical support for current models of CWD epizootiology, in light of herd health-management actions. We identify …

Medicinal herbs constitute an effective source of traditional (Ayurvedic, Unani and Homeopathy) and modern medicine. The plant is a biosynthetic laboratory, not only for chemical compounds, but also a multitude of compounds like glycosides, alkaloids etc. These exert physiological and therapeutic effect. The compounds that are responsible for medicinal property of the drug are usually secondary metabolites. Alkaloids, glycosides, neutral principles, resins, oleoresins, sesquiterpene lactones are some of the common active constituents of medicinal herbs. The article reviews distribution of steroid like compounds and their pharmacological importance.

The total area covered by forest in Pakistan is 4.8%. Forest resources directly contribute to 80% of livelihood of people living in extreme poverty. Important NTFPs are; morels, honey, fruits and nuts, vegetable, condiments and spices, mazri palm, silk cocoon, and many other. 17 species of mushrooms are reported during the study and about 34% of local people are dependent on NTFPs for income generation from these products.
