Marital Immunity, Intimate Relationships, And Improper Inferences: A New Law On Sexual Offenses By Intimates , Michelle J. Anderson Aug 2003

Marital Immunity, Intimate Relationships, And Improper Inferences: A New Law On Sexual Offenses By Intimates , Michelle J. Anderson

Working Paper Series

Today, to one degree or another, marital immunity for sexual offenses persists in over half the states. Underlying the marital rape immunity has been the assumption that when a woman enters into a marriage, she is giving her ongoing consent to sexual intercourse. Professor Michelle Anderson argues that states must abolish this immunity to make the law formally neutral on the marital status of the parties. However, Professor Anderson argues, such formal neutrality is insufficient. The ideology of ongoing consent underlying the marital rape immunity has infected the way the legal system treats sexual offenses among intimates who are not …

Rocky Mountain Wolf Recovery: Annual Reports

Introduction

Gray wolves (Canis lupus) are thriving and expanding in number and distribution in Montana. This is because of natural emigration from Canada and a successful federal effort that reintroduced wolves into Yellowstone National Park (YNP) and the wilderness areas of central Idaho. There are probably more wild wolves in Montana now than at any time in the past 70 years. Since 1974, the U.S. Fish and Wildlife Service (USFWS) has managed wolves in Montana, under the authority of the Endangered Species Act (ESA). The biological recovery goal for the northern Rockies wolf population is a total of …

When Animals Invade And Occupy: Physical Takings And The Endangered Species Act, Rebecca E. Harrison Aug 2003

When Animals Invade And Occupy: Physical Takings And The Endangered Species Act, Rebecca E. Harrison

Washington Law Review

Government actions implementing the Endangered Species Act (ESA) on private lands have sparked extensive debate and litigation over whether such actions result in Fifth Amendment takings. To date, courts have uniformly rejected regulatory takings claims under the ESA, leading several landowners to advance a different theory-physical takings claims. Successful physical takings claims require landowners to show that government actions resulted in either per se physical takings or compensable physical invasions of their land. In two recent decisions, Boise Cascade Corp. v. United States,/i> and Seiber v. United States, courts rejected per se physical takings claims under the ESA, finding …

Lipopolysaccharide Induced Septicemia In Chronic Morphine Treated Rats, Frank Ocasio Aug 2003

Lipopolysaccharide Induced Septicemia In Chronic Morphine Treated Rats, Frank Ocasio

Seton Hall University Dissertations and Theses (ETDs)

Opiate-addicts have been known to show increased susceptibility to bacterial infection. Lipopolysaccharide (LPS), which is a cell wall component in gram-negative bacterial, is a potent stimulator of inflammation. We investigated how treatment with morphine alters LPS-induced inflammatory responses in the rat. Chronic morphine exposure alone elevated serum endotoxin levels. Animals treated with morphine and LPS (250 µglkg) developed hypothermia, decreased mean arterial pressure (MAP), increased plasma thrombin anti-thrombin III (TAT) complex, and approximately 67% exhibited progressive intramicrovascular coagulation. Morphine also enhanced LPS induced leukocyte endothelial adhesion (LEA), suppressed leukocyte flux and corticosterone production, and elevated interleukin- I, tumor necrotic factor-a, …

One Bug, Two Drugs : A Mathematical Model Of Resistance Dynamics In The Icu., Susan L. Calcote White 1971-

Electronic Theses and Dissertations

Antibiotic resistance is a problem causing growing concern in the medical community, leading some to speculate that a return to the preantibiotic era is imminent. The problem of antibiotic resistance is particularly significant in the intensive care unit (ICU), due to the weakened immune responses of the patients and quantity of antibiotics administered. One theory proposes that the policy of cycling, or rotating, the antibiotics used in the ICU may minimize the development of resistance. Few clinical trials investigating the effects of cycling have been conducted, and many questions concerning the impact of cycling policies are unanswered at this point. …

Analysis Of Soil Lead Levels In An Historic District Of A South Central Kentucky City, Robert Cummins Aug 2003

Analysis Of Soil Lead Levels In An Historic District Of A South Central Kentucky City, Robert Cummins

Masters Theses & Specialist Projects

Lead in soil has been shown to be a significant pathway of lead exposure in children. Several factors including age of housing units, exterior composition, and paint loading may affect the amount of lead present in the soil. The purpose of this study was to analyze soil lead levels on properties located in an historic district and relate those levels to the variables previously mentioned. A total of 30 soil samples were collected from housing units in a nationally recognized historic district. Concentrations of lead in the soil were analyzed using a NITON X-ray Fluorescence Spectrum Analyzer, following EPA Method …

Fish As Pollutants: Limitations Of And Crosscurrents In Law, Science, Management, And Policy, Jeremy Firestone, Robert Barber Aug 2003

Fish As Pollutants: Limitations Of And Crosscurrents In Law, Science, Management, And Policy, Jeremy Firestone, Robert Barber

Washington Law Review

When we think of pollutants, we either consciously or unconsciously draw a bright line between pollutants and what might be called "natural." That which is natural cannot be a pollutant; that which is a pollutant cannot be natural. It seems odd to speak of live fish as pollutants, as odd as it would be to speak of dioxins as natural. Nevertheless, the traditional definition of fish as natural may be fading as our awareness of the adverse environmental effects of accidental or poorly planned fish introductions increases. Along these lines, a federal court recently found that non-native Atlantic salmon that …

Security Interests In Intellectual Property Rights: The Time Has Come For The Enactment Of New Laws, Esteban Mazzucco Aug 2003

Security Interests In Intellectual Property Rights: The Time Has Come For The Enactment Of New Laws, Esteban Mazzucco

LLM Theses and Essays

This study deals with all the problematic issues surrounding the use of intellectual property as "collateral," analyzing two legal systems, and addressing that the time has come for the enactment of laws which regulate how security interest in intellectual property should effect. This study also points out the importance of intellectual property rights as another asset in business transactions and the difficulties that the valuation process presents. The central idea of this work is that if lenders and borrowers can successfully utilize IP assets for collateral, borrowers can tap and additional source of funding, and creditors can finance a broader …

Recently Integrated Alu Elements And Human Genomic Diversity, Abdel Halim Salem, Gail E. Kilroy, W. Scott Watkins, Lynn B. Jorde, Mark A. Batzer

Faculty Publications

A comprehensive analysis of two Alu Y lineage subfamilies was undertaken to assess Alu-associated genomic diversity and identify new Alu insertion polymorphisms for the study of human population genetics. Recently integrated Alu elements (283) from the Yg6 and Yi6 subfamilies were analyzed by polymerase chain reaction (PCR), and 25 of the loci analyzed were polymorphic for insertion presence/absence within the genomes of a diverse array of human populations. These newly identified Alu insertion polymorphisms will be useful tools for the study of human genomic diversity. Our screening of the Alu insertion loci also resulted in the recovery of several "young" …

Concentrated Hog Feeding Operations And The Animal Rights Movement: A Website Diagnostic Frame Analysis, Venita M. Quamme

Theses and Dissertations

The volume of online texts designating hog concentrated animal feeding operations (CAFOs) as problematic serves to illustrate an emerging social problem. The purpose of this exploratory study was to investigate how five online animal advocate organizations present hog CAFOs as problematic, and warranting intervention. The units of study include: The Animal Welfare Institute, Farm Sanctuary, Humane Farming Association, Humane Society of the United States, and People for the Ethical Treatment of Animals. Together, they represent an integral part of the animal rights movement, a descriptive label that does not imply consensus regarding animal “rights.”

In the procedures used to explore …

Understanding Latitudinal Trends In Fish Body Size Through Models Of Optimal Seasonal Energy Allocation, James E. Garvey, Elizabeth A. Marschall Aug 2003

Understanding Latitudinal Trends In Fish Body Size Through Models Of Optimal Seasonal Energy Allocation, James E. Garvey, Elizabeth A. Marschall

Publications

For fish at high latitudes, short growing seasons should constrain size-at-age, although the converse often occurs. We used a dynamic state variable model to find energy allocation strategies to length, fat, and ovaries that maximize expected egg production of largemouth bass (Micropterus salmoides). We determined how latitudes and rations affect optimal allocation and then simulated growth using optimal strategies. A theoretical reciprocal transplant explored how latitude-specific optimal strategies affected growth at other latitudes. At low ration, allocation and growth were similar among latitudes, with length selected in small individuals and reproductive tissue and fat in large counterparts. At …
