Humanity’S Law: Rule Of Law For The New Global Politics, Ruti G. Teitel
Humanity’S Law: Rule Of Law For The New Global Politics, Ruti G. Teitel
Cornell International Law Journal
This Article proposes that international law is undergoing a paradigm shift, which will have significant implications for foreign affairs. A dramatic expansion of legal machinery, institutions, and processes is occurring in the international sphere. Now, more than ever before foreign policy decision-making occurs in the shadow of the law. The conception of a new rule of law is at stake; appropriate to the present state of global politics, as it aims to manage heightened political conflict and violence through law. The impact of the juridical paradigm shift is primarily discursive. The expanded legal discourse represented by the present international human …

Grain Production & Handling Trends In South Dakota And Their Implications, Bashir Qasmi, Clayton Wilhelm
Grain Production & Handling Trends In South Dakota And Their Implications, Bashir Qasmi, Clayton Wilhelm
Economics Staff Paper Series (1969 - 2017)
Over the last three decades, producers in South Dakota have planted increasingly more acres under corn and soybeans and have moved away from producing oats and barley. The wheat production in the state has also increased during this period. The grain handling industry in South Dakota has also changed over time. The number of commercial elevators has significantly decreased during the past 30 years, and the operating capacities of the remaining ones are much larger. Genetically modified (GM) or transgenic corn and soybeans were introduced in 1996. Presently, South Dakota is leading the nation in adoption of transgenic corn and …

Reduced Methane Emissions From Large-Scale Changes In Water Management Of China’S Rice Paddies During 1980-2000, Changsheng Li, Jianjun Qiu, Steve Frolking, Xiangming Xiao, William A. Salas, B Moore, Stephen Boles, Yao Huang, Ronald Sass
Reduced Methane Emissions From Large-Scale Changes In Water Management Of China’S Rice Paddies During 1980-2000, Changsheng Li, Jianjun Qiu, Steve Frolking, Xiangming Xiao, William A. Salas, B Moore, Stephen Boles, Yao Huang, Ronald Sass
Earth Sciences
Decreased methane emissions from paddy rice may have contributed to the decline in the rate of increase of global atmospheric methane (CH4) concentration over the last 20 years. In China, midseason paddy drainage, which reduces growing season CH4 fluxes, was first implemented in the early 1980s, and has gradually replaced continuous flooding in much of the paddy area. We constructed a regional prediction for China's rice paddy methane emissions using the DNDC biogeochemical model. Results of continuous flooding and midseason drainage simulations for all paddy fields in China were combined with regional scenarios for the timing of …

Quibbles'n Bits: Making A Digital First Sale Doctrine Feasible, Victor F. Calaba
Michigan Telecommunications & Technology Law Review
Whereas the first sale doctrine historically permitted the transfer and resale of copyrighted works, license agreements used by software companies and the DMCA's strict rules prohibiting tampering with access control devices frustrate exercise of the first sale doctrine with respect to many forms of digital works[...] This article explores the first sale doctrine as it pertains to digital works and proposes ways to make a digital first sale doctrine feasible. Part II describes the first sale doctrine as it has traditionally been applied to non-digital works. Part III discusses modern technology's impact on the distribution and use of copyrighted material. …
Constitutional Issues In Information Privacy, Fred H. Cate, Robert Litan
Constitutional Issues In Information Privacy, Fred H. Cate, Robert Litan
Michigan Telecommunications & Technology Law Review
The U.S. Constitution has been largely ignored in the recent flurry of privacy laws and regulations designed to protect personal information from incursion by the private sector despite the fact that many of these enactments and efforts to enforce them significantly implicate the First Amendment. Questions about the role of the Constitution have assumed new importance in the aftermath of the September 11, 2001 terrorist attacks on the World Trade Center and the Pentagon. Recent efforts to identify and apprehend terrorists and to protect against future attacks threaten to weaken constitutional protections against government intrusions into personal privacy. However, these …

Researching Remedies In Intellectual Property Actions Involving Computer Technology: A Research Guide, Daniel N. Kassabian
Michigan Telecommunications & Technology Law Review
The purpose of this research guide is not to answer the question "What remedies are available to an owner of computer related technology whose rights have been infringed?" but to provide a methodology by which a legal practitioner can find the answer to this question. This guide sets forth materials and methods of research that can be used for an inquiry that is broad in scope, such as researching which legal scheme's remedial component best suits a client's technology, but that are also capable of being used for a narrow or limited inquiry, such as looking for specific remedies available …

The Development And Validation Of The Ethical Climate Index For Middle And High Schools, Laura E. Schulte, Franklin Titus Thompson, Jeanie Talbott, Ann Luther, Michelle Garcia, Shirley Blanchard, Laraine Conway, Melanie Mueller
Counseling Faculty Publications
One school characteristic that needs to be considered as important in keeping schools safe is school climate. The purposes of this study were to develop and validate an instrument that measures the ethical climate of middle and high schools. To create the School Ethical Climate Index (SECI), we adapted the Ethical Climate Index for graduate and professional school programs to apply to middle and high schools. The SECI measures a school’s sense of community by assessing student and teacher interactions and relationships through the application of five ethical principles: respect for autonomy, nonmaleficence, beneficence, justice, and fidelity. To provide evidence …

A Case Study In The Use Of Cognitive-Behavioral Treatment Of Emotional And Behavioral Symptoms Related To A Traumatic Brain Injury, Urszula Kobylinska
Theses and Dissertations
The purpose of this study was to examine the effectiveness of cognitive-behavioral therapy techniques with traumatic brain injury (TBI) individuals using a case study format. The subject of this study was a 54-year-old woman who suffered a traumatic brain injury in an automobile accident. For the purpose of this study, she was seen over a six-month period beginning in January 2002.
