Kajian ini dijalankan untuk melihat tanggapan responden terhadap keberkesanan pengurusan kaunseling Program Bantuan Pekerja (EAP) di Telekom Malaysia. Subjek kajian terdiri daripada 30 orang klien yang mewakili 75% responden yang pernah mengikuti kaunseling Program Bantuan Pekerja (EAP) di Telekom Malaysia. Satu set borang soal selidik yang dibentuk sendiri oleh penulis telah digunakan sebagai alat untuk mendapatkan maklumat kajian. Manakala kiraan kekerapan, peratus dan min digunakan untuk melihat tanggapan responden terhadap penekanan dalam kaunseling EAP, kesesuaian modul, kepakaran kaunselor EAP dan prestasi mereka selepas mengikuti kaunseling. Three themes animate Martin Lipton and Paul Rowe's thoughtful response to my critical evaluation of Unocal's fifteen-year history. First, they maintain that affording shareholders a primary role in the governance of takeovers depends on a commitment to the stock market's informational efficiency. Second, they claim that allowing shareholders to amend or repeal a poison pill ignores empirical evidence that the existence of a poison pill is associated with higher takeover premiums. It is challenging for Christian pastors and counselors to discuss human sexuality in ways which do not alienate liberals on the left, conservatives on the right, or biologists in the middle. Feminists frequently see males as dominating or insensitive, and conservative Christians sometimes feed into this by emphasizing patriarchal models of marriage as if this were the biblical paradigm for all time. Evolutionary biologists view sexuality primarily as a means of propagating the species. Without external interference, governments make value judgments as to what would best promote the creation and dissemination of intellectual works in their own countries. Combined together, these disparate judgments form an intellectual property system that is tailored to the country's level of wealth, economic structure, technological capability, political system, and cultural tradition.

This Article addresses the problems with our nation's cultural and legal prohibitions against certain pain management treatments. The practice of pain management has not kept pace with the many medical advances that have made it possible for physicians to ameliorate most pain. The Author notes that some patients are denied access to certain forms of treatments due to the mistaken belief that addiction may ensue. Additionally, some individuals are under-treated for their pain to a greater degree than are others. This is especially the case for our nation's prisoners. Behavioral economics is an increasingly prominent field within corporate law scholarship. A particularly noteworthy behavioral bias is the "endowment effect" – the observed differential between an individual's willingness to pay to obtain an entitlement and her willingness to accept to part with one. Should endowment effects pervade corporate contexts, they would significantly complicate much common wisdom within business law, such as the presumed optimality of ex ante agreements. Existing research, however, does not adequately address the extent to which people manifest endowment effects within agency relationships. To combat the epidemic of youth gun violence in the 1980s and 1990s, law enforcement agencies across the United States adopted a variety of innovative strategies. This article presents case studies of eight cities' efforts to police gun crime. Some cities emphasized police-citizen partnerships to address youth violence, whereas others focused on aggressive enforcement against youth suspected of even minor criminal activity. Still others attempted to change youth behavior through "soft" strategies built on alternatives to arrest. Finally, some cities used a combination of approaches. A cone beam micro-CT system is set up to collect truncated helical cone beam data. This system includes a micro-focal X-ray source, a precision computer-controlled X-Y-Z-theta stage, and an image-intensifier coupled to a large format CCD detector. The helical scanning mode is implemented by rotating and translating the stage while keeping X-ray source and detector stationary. A chunk of bone and a mouse leg are scanned and quasi-exact reconstruction is performed using the approach proposed in J. Hu et al. (2001). This approach introduced the original idea of accessory paths with upper and lower virtual detectors having infinite axial extent. …

Functional magnetic resonance imaging (fMRI) techniques have great potential for identifying which neural structures are involved in the control of goal-directed reaching movements. However, fMRI techniques alone are not capable of probing the neural mechanisms involved in acquisition of novel motor behaviors because such studies require that the moving limb be perturbed in a controlled fashion. We outline a plan to design and develop a non-metallic, pneumatically actuated tool that, along with systems identification techniques and functional magnetic resonance imaging (fMRI), will characterize and quantify how the human central nervous system uses sensory information during practice-based motor learning.

This article describes the development of the competing regulatory bodies for banking, insurance, securities and derivatives. It then focuses on the regulatory roles of the Securities and Exchange Commission ("SEC") and the Commodity Futures Trading Commission ("CFTC"). The competition between those two agencies and its effects are described. After that review, the article examines the roles of the FSA-GB and FSA-Japan. Finally, the article discusses the arguments favoring and disfavoring competitive regulation and tries to discern whether a unified regulatory structure such as that in Japan and England is preferable to the competitive approach of the SEC and CFTC. In this article, I will explore the concept of control and the meaning of exclusive rights in the constitutional text, the pre-1976 Copyright Act regime, and the 1976 Act. I then consider the new technology cases from piano rolls through videotaperecorders, as well as Congress' responses to new technological means of exploitation. I make two submissions. First, I conclude that when copyright owners seek to eliminate a new kind of dissemination, and when courts do not deem that dissemination harmful to copyright owners, courts decline to find infringement, even though the legal and economic analysis that support those determinations often …

A full understanding of how the federal enforcement bureaucracy will elude us without a rich understanding of what makes prosecutors (or agents) tick. However, I suspect that the best way to reach that goal is not to start with this ultimate question. After all, to look closer to home, what do professors “maximize” when they grade papers? Progress is much more likely to be made if we follow Jim Eisenstein and focus on, first, identifying the most salient features of the bureaucratic environment, and, second, getting a handle on their relative influences.

The question of the appropriate role of law in regulating marriage and divorce is the subject of much controversy in the United States – a raging battle of the “Culture Wars” (Hunter, 1991). On one side are social conservatives, who view divorce and family instability as an important source of societal decline. These advocates of “family values” adopt a somewhat punitive tone, arguing that the family can be saved only if the government restricts divorce, by reinstituting fault grounds and discouraging unhappy spouses from selfishly defecting from their responsibilities. Innocent fatalities are a concern of all social activity with a capacity to kill. This is especially true when the social activity is the death penalty since an innocent person's execution is not simply a tragic collateral consequence of activity with a non-fatal objective. Instead, the taking of life is the goal of the enterprise, and the killing is the intended act of the state.

A recurring fallacy in any debate over legal ethics or public policy is to assume that the particular problem under examination is unique and unprecedented. Expand one's field of vision, and precedents and analogs quickly turn up. This rule applies with special force to the debate over retention by state attorneys general of private counsel to represent them on a contingent fee basis in the recent litigation against the tobacco industry. In August 13,2001 the National Conference of Commissioners on Uniform State Laws voted eighty-nine to fifty-three to reject the Amendments to Article 2 of the Uniform Commercial Code that had just been approved in May by the American Law Institute. The vote followed a last minute effort by the Article 2 drafting committee to amend the scope provisions of Article 2 in response to continuing criticism from representatives of the software and information industries.
