“Strange Ramblings”: The Ideal And Practice Of Sermons In Early Mormonism, Davis Bitton
“Strange Ramblings”: The Ideal And Practice Of Sermons In Early Mormonism, Davis Bitton
BYU Studies
People who attended meetings of The Church of Jesus Christ of Latter-day Saints during its first seventy years heard many sermons preached (fig. 1). But the sermons often seemed different from those heard in Protestant and Catholic congregations. For the Saints, this was further evidence that Mormonism was not tied to a professional clergy but, like primitive Christianity, allowed wide participation by parishioners. Outsiders, however, were often less than favorably impressed with Mormon sermons. According to one observer, most Mormon speakers he heard were guilty of "strange ramblings." Before examining in detail the peculiarities of preaching among the Latter-day Saints, …

An Introduction To The Kirtland Flats Ashery, Benjamin C. Pykles
BYU Studies
Reflecting a recent resurgence of interest in one of its most important historic spaces, The Church of Jesus Christ of Latter-day Saints is currently restoring a number of historic structures in Kirtland, Ohio, including buildings in the lowland area known as Kirtland Flats (fig. 1). These buildings are part of a major restoration plan designed to significantly increase the quantity and quality of historical interpretation at the site by introducing visitors to the major doctrinal and historical developments of the Church during the seven years its followers resided in Kirtland (1831-1838).

Giving Suckers (And Salmon) An Even Break: Klamath Basin Water And The Endangered Species Act, Reed D. Benson
Giving Suckers (And Salmon) An Even Break: Klamath Basin Water And The Endangered Species Act, Reed D. Benson
Faculty Scholarship
An extreme drought hit the Klamath River Basin of southern Oregon and northern California in 2001, and a remarkable water controversy soon followed. Hundreds of farmers, who for decades had reliably received irrigation water from the federal government's Klamath Project, were told, for the first time, that they would get none that year. Instead, the government would hold the water in Upper Klamath Lake and release it to flow down the Klamath River in an effort to ensure the survival of fish protected by the Endangered Species Act.
The Youngs At West Point, J. Michael Hunter
The Youngs At West Point, J. Michael Hunter

In 1871, Willard Young, eleventh son of Brigham Young, was the first Mormon to receive an appointment to West Point Academy. His attendance at the military academy drew national attention and criticism from opponents of polygamy. Despite the opposition, he soon gained the respect of his classmates and graduated fourth in his class. He returned to teach engineering in 1879, served in the Spanish-American War, earning a commendation from President McKinley, and during World War I was supervisor of army engineering work on the Missouri River. In 1877, one of Brigham's grandsons, Richard W. Young, was the second Mormon to …
Rice V. Cayetano: The Supreme Court Declines To Extend Federal Indian Law Principles To Native Hawaiians Sovereign Rights, Jeanette Wolfley
Rice V. Cayetano: The Supreme Court Declines To Extend Federal Indian Law Principles To Native Hawaiians Sovereign Rights, Jeanette Wolfley
Faculty Scholarship
As I read and reread the Rice decision, I realized how similar it is to the trend in the recent Indian law cases decided by the Supreme Court. For example, Rice, in many respects, represents the discomfort the Justices feel for upholding "special treatment" of Native Americans under the law. The Court in Rice reversed the Ninth Circuit's decision allowing the State of Hawaii to conduct a Natives-only election of trustees to administer a trust to benefit Native Hawaiians. It found that the Fifteenth Amendment, adopted after the Civil War to prevent states from denying the elective franchise to former …

Reshaping World Politics: Ngos, The Internet, And Global Civil Society, Ann Florini
Reshaping World Politics: Ngos, The Internet, And Global Civil Society, Ann Florini
Research Collection School of Social Sciences
This largely descriptive book sets out three questions of interest to international relations scholars and policy-makers: What is global civil society? What are its origins? And what are the roles of individuals in creating and maintaining it? After a brief literature review, the book provides a definition: global civil society is 'a socially constructed and transnationally defined network of relationships that provides ideologically variable channels of opportunity for political involvement' (p. 19). This definition reflects the book's grounding in 'people-centered' International Relations theory, drawing on the English school of Wight and Bull and paralleling the American constructivist paradigm to focus …
Externalism And Knowledge Of Comparative Content, Yoo Guan Tan
Externalism And Knowledge Of Comparative Content, Yoo Guan Tan
Research Collection School of Social Sciences
Concepts are the constituents of thoughts, which in turn, are the contents of propositional attitudes. They are also what the predicates of our language express. According to a tradition going back to Plato, questions about comparative content – questions of the form Is concept F the same as concept G? – are purely about relations of ideas, and so are answerable a priori. This does not mean that no experience at all is necessary to answer such questions, for experience may be needed to grasp their content. Call a piece of information about Fs extraneous if it is not required …

The Rehnquist Court And The End Of Constitutional Stare Decisis: Casey, Dickerson And The Consequences Of Pragmatic Adjudication, William S. Consovoy
The Rehnquist Court And The End Of Constitutional Stare Decisis: Casey, Dickerson And The Consequences Of Pragmatic Adjudication, William S. Consovoy
Utah Law Review
In light of the Rehnquist Court's misuse of stare decisis, and the Court's repeated admonitions that stare decisis is a doctrine of policy, not a command, this Article suggests the abrogation of stare decisis from the Supreme Court's analysis of constitutional issues. Policies are designed to foster beneficial outcomes. When stare decisis is viewed in the context of relevant case law, particularly Casey and Dickerson, it is apparent that this haphazard and consequentialist application of stare decisis is not a benefit, but a detriment. Although abandoning stare decisis has consequences, those consequences are administrative and have no impact on the …

Access To Justice For The Self-Represented Litigant: An Interdisciplinary Investigation By Designers And Lawyers, Ronald W. Staudt, Paula Hannaford-Agor
Faculty Publications
To assist courts, the National Center for State Courts, in partnership with the Illinois Institute of Technology's Institute of Design and the Chicago-Kent College of Law, launched a research project to examine court processes and recommend modifications to eliminate or reduce procedural barriers to access for self-represented litigants. The projects had three major tasks: (1) to identify major barriers to access to justice that self-represented litigants encounter due to court procedures and administrative requirements; (2) to employ system design methodology to redesign court processes to remove those barriers, and (3) to translate the conceptual model for redesigned court system into …

Effects Of Some Dna Gyrase Inhibitors On The Survival And Development Of Pimpla Turionellae (Hymenoptera: Ichneumonidae) Larvae Reared On An Artificial Diet, Kemal Büyükgüzel
Turkish Journal of Zoology
The effects of novobiocin, nalidixic and oxolinic acids, which are potent antibacterial agents, on the survival and development of the hymenopterous endoparasitoid Pimpla turionellae L. were investigated alone by rearing the larvae aseptically on chemically defined synthetic diets. The percentage of fifth instar larvae was not significantly affected by the diets with different levels of the antibiotics used in the study. A diet containing the lowest level of novobiocin significantly increased the yields of pupae and adults. This level also significantly shortened the developmental time for fifth instar, but had no significant effect on the complete development of the larvae …

Degradation Products Of Adenine Nucleotide In Rainbow Trout (Oncorhynchus Mykiss) Stored In Ice And In Modified Atmosphere Packaging, Yeşi̇m Özoğul, Fati̇h Özoğul
Turkish Journal of Zoology
The breakdown products of adenosine triphosphate (ATP) were separated using a rapid HPLC method. The K-value, Ki-value and H-value were also determined as a means of evaluating the quality of rainbow trout held in ice and modified atmosphere packaging comparing with sensory and microbiological analysis in terms of fresh fish quality. Results from the present research indicated that modified atmosphere did not extend the shelf life of trout but inhibited microbial growth compared to ice storage. However, there was no significant difference (P>0.05) between the two conditions. K and Ki-values provided a useful freshness index of fish for both …
